    Does anyone have knowledge in this topic? I would like consulting on an idea I am trying to create but there is a similar product out there with a patent. My idea is different in several ways, however.

    So, the pending continuation patents must have been filed Before the design around patent or it can be filed After a design around has been filed ? If continuation patent is allowed after a design around has been filed, then it seems to be unfair to the design around inventor because its retrofitted as it were.

      Cosmo John Not copying, if you have an idea you developed on your own, you are almost guaranteed to find someone with a patent for it. Don't bother with the patent unless you get one in every developed country, but China won't stop their people from producing it anyways. Elon Musk and many others avoid patents unless the idea is very basic, as he says theyre "a lottery ticket for a lawsuit"

      Fletcher Hillier Intriguing.... could you kindly elaborate on what is meant by the likes of Elon Musk avoid patenting unless the idea is very BASIC? Basic in what way?

      Basic meaning that if you look at it, you can figure out how it works or how to build it. If it has complex, hidden parts, a patent isn't needed, and just exposes those secrets. Elon Musk does patent their cars, but that's because they intend to openly share the technology and a patent enables that, while defending their right to produce it.       Fletcher Hillier I am intrigued that Basic is regarded as more worthy of patenting. I am still digesting this concept.

    It’s basically dishonest if your strategy is to tweak an existing patent instead of making your own 😔
