- Shabnam, Saleem, and Amroha Murder Case: Shabnam is a name that is in the headlines lately because if things do not go her way, she could be the first woman hanged in the history of Indian democracy. Shabnam is accused and found guilty of killing almost 7 members of her own family including her father, mother, brother, sister-in-law, another brother, cousin, and a 9-year-old nephew. She did it all with the help of her lover Saleem.

In the year 2010, the Amroha sessions court, while examining the case, provided them a death sentence which was supported and upheld by the Allahabad High Court. And so was done by the Supreme Court.

Hey Finology Legal! one correction required in this video, i.e. In India, Mercy Petition (To pardon DEATH SENTENCE) can only be filed to President, NOT to Governer. Governer on the flip side, can reduce other forms of punishments, but cannot pardon death sentence. Only this correction needed, rest video is knowledgeable. 😇
she talked about mercy petition in general but what u explained is the difference between pardoning power of governor and president...anyways always good to point out intricacies

(Additional Info:- If the appellant want to approach Governer of her State; she can do so but can apply only for change in nature/gravity of punishment in her Mercy Petition. But cannot ask for acquittal of DEATH SENTENCE to Governer)

A governor can now have pardoning powers over death sentences as well.

The educational qualification was sole reason why the parents opposed the love affair later the father of shabnam clearly states that he will disown her from the property if she marries Saleem after which the conspiration was started by both of them sole purpose being no inheritance from father.

Five types of mercy petition power to President under article 72 and to governor under article 161and they are 1.pardoning(totally forgiveness), 2.commute (change type of punishment), 3.remission(in this reduce the time period of punishment), 4.respite(in this if someone is pregnant or handicapped punishment will be reduced or end) and 5th and the last petition is reprieve ( it means delaying the punishment time in other words giving him time to prove himself innocent)

In Epuru Sudhakar v. Government of Andhra Pradesh, the Court held that the pardoning power of the President under Article 72 of the Constitution is subject to the Judicial Review. The pardoning power of the President cannot be exercised on the basis of the caste, religious, or political reasons.

Both have been given Death Penalty- however she is the 1st woman to be awarded so.
