      ​@@jasha9sandhu I don't think it's the law that is wrong, but the way it's being implemented. Deeyat in an accident that has uncontrollable variables is ok (Such as the car brakes failed and someone died. Such out of court settlements are very common throughout the world) . But for intentional murder, deeyat should not be an option to put on the table.

    There was an infamous case in saudi where there was a accident killing if i can revise , where victim family didn't pardon after offering millions of money and so many kabilaah were there but victim family didn't pardon and then state took the matter into their hand, was only possible when there was no money,power or pressure involved and there are many cases where Diyat is accepted without any pressure.

      Diyat is halal and has been practiced under Islamic Sharia since the birth of Islam, the law is directly derived from Quran. What do you mean by taking advantage as if it's not originally meant to give advantage to the murderer? What else was it meant to achieve?

      Is it justice for that entitled rich murderer? Is it good for a society as a whole, to let such murderers roam free without any fear of consequences? It's laws like these that help rich landlords dominate/threaten poor people & spread corruption.
      Moreover, how can you as an outsider know for sure whether the family was pressurized or not?
      This inhumane law has done nothing except for enabling injustice, exploitation of the poor at the hand of rich and corruption of society ever since it was created.

    The concept of diyat does exist in Islam. However, the state has the responsibility to set a fixed amount of diyat. The amount should be sufficiently high so as to avoid situations like this whereby the wealthy can buy freedom for a fraction of their net worth.

    The most interesting fact is that the family has denied any financial transaction and said they have pardoned Natasha on the name of Allah( and no money was received.... really????...)My question is that who gives family the right to pardon the criminal, and where does the "State" stands here if family has the right to pardon or prosecute???😮😮

    some of the people in india don't know the incident held by akash ambani in december 2013 where he killed a person by his car but the whole news was wiped out from the media and no party opened by any party later on driver of ambani accepted it and driver got convicted.

    There were multiple crimes with multiple victims. The diyat is only for the deaths of the father and daughter. She should be charged with other crimes including but not limted to: Drug use, drug possession, speeding, reckless driving, property damage, assault, etc. she should not be roaming free.

      Drug use is not a crime. Possession and distribution is. Speeding is a traffic ticket, reckless driving is jail time. Depending on how reckless it was what what it caused. Property damage is a fine too. Assault is bailable but imprisonable crime.

    Good video. I’m surprised and pleasantly so, because I was told this guy is an unreasonable liberal. So imagine me watching this video to the end and agreeing 95% with everything you pointed out, Shahzad. I think a bit more fair presentation of the facts would have included a clear disclaimer to tie everything up neatly and make clear whether the family was forced to take the money or not is completely unknown

      1. She paid more than the prescribed amount in the light of the Quran and Hadees.
      2. Murder was accident/unintentional.
      3. The victim's family accepts the money.

    If i was a mufti or whatever who had a say on islamic law i would have given all the properties and thee companies owned/run by the perpetrator to the victim's family so that the "Islamic law" would have some consequences for the perpetrator

But it's not un-Islamic, it's completely halal as it's directly derived from Quran (Surah Nisah) so stop accusing people of misusing Islam. This is exactly what this law has been enabling, to let rich get away with the most heinous crime by just paying diyat, ever since this law came into existence. And it's not the only law that's inhumane, Islamic Sharia is filled with such laws.

    If court is given authority to whether or not they can further pursue regardless of victims family call, then what on earth ensures that the judge will not be bribed ? Because then it will be no longer about the lawyers debate and solely based on judge’s decision. Through away tribal laws develop and implement new law and let them keep evolving

    for my understanding, Diyat law is good bcz it gives both parties a chance to move on in their lives bajaye iske keh saalon saal jail mein reh kr zindagi barbad kre,sarkar pr bojh rhe etc agr isey istemal kia gya ho as it is mentioned in islamic jurisprudence for unintentional accidents, lekin power,pressure etc involve ho to make diyat as a deal then state should enter into this and i think kisi bhi parhe likhe aalim ko dikkat nhi honi chahiye as uh mention to add some more to Diyat law. mujhe galati Diyat law mein nhi powerful logon ke beimaani mein nazar aa rhi as they can use their power or money to manipulate the law.

    Great video.... although i think the diyyat law is what it is and is not flawed.... the victim's heirs are the ones who hold the power to forgive as per Islam.
    BUT the suggestion given in the video is absolutely spot on... The "free will" has to be ensured by courts. The heirs have to be protected. And definitely a clause, as suggested, to shield against cases where there is any doubt of pressurizing victim's heirs needing extra protection from judge against diyyat, is the best solution to bolster the ISLAMIC DIYYAT LAW. It will remain Islamic, and be more protected from getting abused by elite.

    The fact we don't have any muftis or ulemas raising voice on this issue is baffling! In Pakistan, they're in the driver's seat - from small town mosques to big businesses and ultimately, state.
    Murderers using Islamic rulings to suit their agenda and they're silent? Without the right context, in this case, matter of blood money - more Raymond Davis, Shahrukh Jatoi, and Natasha Danish will prevail.
    Where is the law of the land? Weren't courts supposed to dispense trial and fair play? It's not ONLY the failure of justice system but our clergy too.

    I'll be very honest with you. People take it to court, only when both parties match in status. In this case, there was no match and honestly the victim family knew that the case would be dragged for years and in the end, they will either pull out or case will be in Natasha's favor. Due to this, they ramped up the pressure on her family, and left with a good deal. I used to get upset at this keh "yeh body per sauda ker laingay" but now I understand why this happens. Sad and unfortunate state of justice in Pakistan. With that money, at least, the family will be able to sustain itself for some years, till their other kids become the mother's support.

    Wait, this is actually a thing? Even if the victim's family forgives, shouldn't the state be a party for the case against the perpetrator?
    What if a person was not well liked by his family and they conspired with someone to have the victim killed?
    If that's the case, then do both the conspirators and perpetrators go free just because some money changed hands?

      All the basic principles in the Islam are sacred and holy and it is till the doomsday because these are not made by men it is from god because everything that is from holy prophet is from god, although this principle was first practiced by prophet's (S.A.W) grandfather Abdul muttalib and was also by the god on him as it has a story behind it and prophet (S.A.W) also continued it, therefore it is applicable now and in future as well.

    In Islam, diyat allows for mercy and reconciliation, but it does not override justice. If the crime endangers public safety or involves negligence, the state can still intervene and enforce legal punishments. The Prophet Muhammad (PBUH) emphasized that while the victim's family can accept diyat, justice and public safety remain paramount (Sahih al-Bukhari)​. Thus, even when diyat is paid, the law can still hold offenders accountable to protect society.

    This is why Dr Israr rejected to be a part of Islamic Shariar Council, he knew that establishment only want to have this to exploit the lslamic laws. This council should either have ultimate power or should not exist. Natasha case is one of many reasons where we need unified islamic law system.

    Unfortunately, Islam is interpreted in a very different way in Pakistan. In the rest of the Muslim world, discussing religious issues are highly encouraged. However, in our country talking about religion is considered to be the sole prerogative of the clerics. This leads to a situation where religion remains essentially inaccessible to the common man and the cleric can give whatever interpretation they please. No hope for Pakistan.
