Sir,but the court of one state is not obliged to follow the order passed by a court in other state . It is at the discretion of that other court to follow. so how can res bus judice be applied in such case.
Sir, but how a court would know that there is already a case pending in another court? And one more lay man question why it is called stay of suit, why there is stay and not rejection of the second case having same matter in issue. Thanks
When same case will be filed 2nd time, Court will summon the defendant (who is applicant in 1st case) and the lawyer of the applicant in 1st pending case will draw the attention of the honourable court that, the same kind of case is going in XYZ court, and by confirming it, court will order for STAY. And the reason they jst STAY that case is, if later on, court comes to know tht Court has made any mistake by ordering STAY, thn court could resume the proceedings. Thank you.

Second " it is also a right of ACB to file a case in UP or he is also ready to appear in Delhi as well as in UP " why court should stay on the suit? Sir when a party is not satisfied with the judgement of a competent court then it moves to upper level of the court , so is it not the violation of resjudicata? PLEASE REPLY ASAP..
Because parties same hoti hain dono matters me. Jo pehle wale case ki party hogi, wo ye baat court ko bata skti hai ki matter is pending adjudication in another court.

Second court will apply res subjudice ... coz it means .. Stay of suits... and when first court decide that case then second court apply res judicata on that case ... means apply same judgement
