In the final clip, Speech explained why he sued the TV sitcom Arrested Development. Using "In Living Color" and "Survivor" as examples, Speech claimed that big broadcasting companies had been using the same names of past musical acts for their shows. The rapper explained that once the name is used for a major show, "it's hard for the group to have a pathway to the public because the public only thinks about the TV show." Speech added that the Arrested Development name was trademarked in 1993, while the sitcom premiered in 2003, so he was well within his right to sue. While the sum "wasn't close" to what Arrested Development was offered for a Coke commercial, Speech said the case was settled out of court.
Speech revealed the current status of his relationship with some of the original Arrested Development members. Speech stated that he's worked things out with Headliner but doubted that the two will ever be as close as they once were. He talked about inviting past members to join him and the group on stage whenever's he's in their area before highlighting his recent solo project, "Expansion." Speech also referred to Arrested Development's recently released album, "Don't Fight Your Demons," as their best album since their solo debut.
I honestly clicked this video because of the show Arrested Development, the show has overshadowed the group its good dey sued

My initial first response is to scoff whenever I hear people forming lawsuits against people or businesses, but Speech just perfectly explained his situation. Good for him..
He seems to be a guy that all about fairness. I love his honesty and how he owns his mistakes.

What an awkward end to the interview. He seemed to have so much more to say. Vlad usually has longer interviews and chops them into 16 parts lol. I looked up Arrested Development music on Amazon and the damn TV show put an album out under that name too. He was right to sue. If I was him, I would have made them change the name of the show altogether for trying to be slick.
The term arrested development dates back to the early 1800's. Its ridiculous that people can sue for a term hundreds of years old

The term trademark refers to a recognizable insignia, phrase, word, or symbol that denotes a specific product and legally differentiates it from all other products of its kind.
My input:
Arrested Development began as a medical term, not the name of a medical device or the name of a medical association. And if it did, it wasn't trademarked. Once the music group used it, and trademarked it they owned the name for specific usage.
At the end of the day, if you came out with a product or service named Arrested Development and it became popular enough to become a blip on the trademark radar, you could be sued and the courts would decide whether the use was fair or not.
The lawyers ALWAYS win.

"Apple" has been around before Steve Jobs created his company and you don't think he should've been able to sue someone trying to use that name. The Beatles actually sued Steve Jobs because their record label which was called Apple predated Jobs' company.

Him and Headliner are 60/40 owners, so he had to split with him I'm sure. That's the "we" he referred to. Plus, the attorney fees too. It was split a few ways actually. Attorneys usually get 30% right off the top, and him and headliner split the rest.
Just found their first album at the thrift store and bought it. Wasn’t a fan back then but I can say that the album is pretty dope and still sounds relevant today.

When he said he trademarked the name, I am wondering if he trademarked the name in all categories. For example you can trademark "Arrested Development" as a musical group, but not trademark "Arrested Development" for a television show which means it can be used. So I am wondering if it was trademarked it in all categories. Like, you cannot use "Apple" has been trademarked in every single category (clothing, products, name of a show etc). The real lawyers that are familiar with this can you clarify?
I am not a lawyer, but I have a law degree. The difference here, is that music and television are both "entertainment." For example, musicians are often on television, and television shows usually have music on them. So, in the world of entertainment, "Arrested Development" was trademarked. The exact example he used, where the announcers were confused about whether Arrested Development the band was coming up next, is the reason why the other side wanted to settle. Music is a "category," as you put it, but it is a category under the umbrella of entertainment. They could have fought to make them change the show's name altogether, which would have been worse for the show.
@@hiphopjewels I hear you, but there are specific classes for each one. There is not an entertainment class where its covered in television and music and theater etc. You'd have to trademark the name for each category. But the group was popular and it was used commercially so the name being used for a television show could show confusion, but in technical terms I dont think the lawsuit was based on trademark infringement because although I am not 100% sure, the name was only trademarked for the name of a group and not the name of a television show.
@@mrbrownroyyal Trust me, it wouldn't matter, because it's all entertainment. Music and TV are intertwined. If you search music for Arrested Development on Amazon, you'll see an album associated with the TV show pop up. With your logic, wouldn't it be a problem if you file under the music category, but the TV people using the name didn't even trademark under TV category, and then start moving into your music lane too? And, to top it off, people in TV land are even thinking the TV show is a music group. No matter what you file under, if you can show that someone is confusing your brand with another brand that is not trademarked, you have standing to sue. That's why they settled. And, trust me, the TV people would have trademarked under TV if they thought they would be granted it. They didn't, because they knew it was too close to qualify for the trademark.
@@hiphopjewels That's why I said then the lawsuit was based on the publics potential confusion and not trademark infringement. Those are two different things. And yes the television company settled because it would be easier than to fight it. I bet the television execs weren't familiar with the band. And I didn't look up Arrested Development on amazon. I looked them up via a trademark website. The band was trademarked as a musical group and not for a television show. Also the trademarked lapsed. The television show had a right to use it but I'm sure didn't want to make any waves and also I'm sure they probably already filmed shows with the name, so they settled with Speech. By the way I've trademarked several things so I know a little bit about this. I just wanted the opinion of a trademark lawyer.
@@mrbrownroyyal I would consider the "confusion" infringement in and of itself, similar to how there is statutory law and case precedent. They're both law, but one has to be argued, and the other is written in the law itself. In this situation, I'd say there is both what you call literal infringement and what you describe as public "confusion." You'd have to agree that the TV show putting a music album out based on the show, is moving into their lane, and not just using the name for TV per se. So, I think it was more than "go away" money to settle. They might have lost, and wanted to use the name for albums and so on too. That's why I mentioned Amazon. Honestly, even though the trademark lapsed, I doubt that matters. AD already documented their interest in the name, and built a reputation around the name, and continue to tour under that name to this day. So, because it's still in use within the market, the name is kept alive and they would never need to prove that they continued to use the name and market themselves with it. Filing that one time gave them standing to sue. I have a trademark myself, and copyrights. I might need a patent next year. I never practiced intellectual property law, just took a class toward the general degree and stating what I remember. It's not as cut and dried as people think.
