So you only need your PSA marriage certificate to start the process, I don't know what a red ribbon is? And you only scan the front page of your passport with your name and pictures and if have traveled with your partner you can scan the stAmps and that could be one of your proof of relationship.

Actually I'm married to a American National and where processing already via immigration consultancy agency here in Cebu we do have the first notice already as the response said the USCIS has been reviewing our application. We did send our application last March 30th of 2022.

I would say the interview. But they would always put on your email that it's not guaranteed until you get to the US and go thru immigration. So just make sure you have all your documents ready to go.
Hi! I got a question. I just recently came back to US last year, I was actually born here in US but I was raised in PH. I’m currently dual citizen. I just want to ask regarding the tax transcripts needed since I am about to file my husband’s petition and our son’s petition as well. My tax record for this year will be available next year. My next question is should I file right now because on the USCIS will take about 10 months or should I wait for next year to receive my tax and file the petition? Thank you!
Mmmm... That's a good question honestly I'm not quite sure about this. I know that tax records are important and one of the main requirements to start an immigration process. I would probably contact an attorney for a consultation or check USCIS website and see if they can provide you any further information for this. Sorry 😐

Well, we decided to do the wedding in the Philippines because my family doesn't have US visa to go to the US. And it's not possible to do the wedding in the US unless you have a fiance visa. And since I did the spousal visa I'm not allowed to go to the US until my visa is approved.

Well if I remember it correctly my attorney said that your name on the passport doesn't have to change unless you really want to you can change it later. But I changed mine in the Philippines so I don't have to worry about it later. ,😊

Yes. For our case my husband needed to go back to work to support our case (income) but I'm not sure if you can stay with your partner when processing your case. I would think that if you have a stable income and you work online then you should be alright staying.

I would probably suggest to get your documents together and get ready for the NVC stage. I just made a video with my NVC process and requirements. But the USCIS stage usually is the one that would take longer to get approved. I don't know if it's the same way with everyone else but for my case it is. This is what I found in the internet. I think this is what we did. $535 USCIS Then you'll have to pay NVC stage $445 . I'M not sure if the cost has changed.

Hi, for my case we did an expedite request po. So all in all we submitted our case February of 2020 and I was approved on September of 2020 about 7 months Po. We received the NOA1 about a week from when we submitted the documents so Bali confirmation sia
We filed online thru the USCIS website in the US po. Then once approved by USCIS and NVC they will pass the case to the US embassy in the Philippines.😊

If I remember it correctly my attorney said that you can change your status when you go to the US. But if I were you I would go ahead and change it so it'll be easier and one of the requirements to change status is CFO certificate which you would also need in order to leave the Philippines to move to the US po. 😊

I would do it in the US. I don't know how it works if you do it in the PH especially if you're wanting to get an immigrant visa. In that way they can send the mail to you here in the US and I just think it's easier. 😊

Well, that would be a great documentation to submit but if you don't have that you can use something else. Like mails/bills, car title, one of the beneficiary on your benefits at work, pictures, etc .

I don't think you need to do anything if you have started the process already. But one thing you probably need to do is inform USCIS that you moved to UAE to work while waiting for your visa.

Mmmm.. in my opinion you can either do a fiance visa or spousal visa. I don't know how quick the fiance visa is going right now. I know when I was doing my cr1 that they prioritize that over the fiance visa because of covid. I would probably do some research to see which one is faster right now. If fiance visa you'll have to get married in the US if spousal visa in the Philippines.
Yes, I think you can submit it at the same time. I actually didnt realized that there 2 i130 forms. I was looking at the instructions online and it says if you are applying for your spouse and if he/she is outside of the US they still need to fill out the I130a form but doesn't have to sign the form. You can go to uscis.gov to check the instructions. 👍

I don't know if there's another way or a document that you can show in behalf of the passport. But as far as I know based on my case we did need the passport for the process. And you definitely need it when you do the interview because they're going to put the visa in the passport.

Well, I did an expedite request and so I'm not sure how long for the regular wait time. We did the expedite because they always postponed the interview and close down because of COVID-19 (2020). So we were afraid that it'll take longer.

Yes, for my case my lawyer was the first one to receive the mail then I think my husband. I'm trying to search my email and I don't think I received one. So I would think they will send that to the petitioner.

First of all congratulations 👏🎉. I personally don't know how long the process would take but it's definitely possible. I actually have a friend who had the same situation but I think her husband came to the usa to visit and they got married here instead. Then he applied for a change of status and was able to stay here. But of course I would still ask an immigration lawyer to make sure that you're doing the right thing and they probably have other options for you too.

base on my experience after NVC DQ'd our case we waited about a month or so then we tried to do an expedite request and month after that got approved then I did the medical and they sent me an interview schedule. I don't know how it works in Thailand but maybe you can try to do an expedite request. The next step would be NVC stage once USCIS Approved your I-130. For me overall took about 7 and half months total because we did an expedited interview request.😊
I don't think you can convert it to IR1 if you're CR1 visa after you arrived in the US you'll get your greencard for 2 yrs then you'll have to apply for removal of condition then you can decide if you want to get 10 yr greencard or become a us citizen after 3 yrs of living in the US. I don't really see the need to change to CR1. I hope this answers your question. 😊

If you file i-130 online you get the noa1 in seconds. Then the noa2 may be 8 to 12 months before getting it.

Yes. For our case my husband needed to go back to work to support our case (income) but I'm not sure if you can stay with your partner when processing your case. I would think that if you have a stable income and you work online then you should be alright staying.

I would probably suggest to get your documents together and get ready for the NVC stage. I just made a video with my NVC process and requirements. But the USCIS stage usually is the one that would take longer to get approved. I don't know if it's the same way with everyone else but for my case it is. This is what I found in the internet. I think this is what we did. $535 USCIS Then you'll have to pay NVC stage $445 . I'M not sure if the cost has changed.

Hi, for my case we did an expedite request po. So all in all we submitted our case February of 2020 and I was approved on September of 2020 about 7 months Po. We received the NOA1 about a week from when we submitted the documents so Bali confirmation sia

If I remember it correctly my attorney said that you can change your status when you go to the US. But if I were you I would go ahead and change it so it'll be easier and one of the requirements to change status is CFO certificate which you would also need in order to leave the Philippines to move to the US po. 😊

I would do it in the US. I don't know how it works if you do it in the PH especially if you're wanting to get an immigrant visa. In that way they can send the mail to you here in the US and I just think it's easier. 😊

Well, that would be a great documentation to submit but if you don't have that you can use something else. Like mails/bills, car title, one of the beneficiary on your benefits at work, pictures, etc .

Yes, you should be able to use your maiden name. You can decide to change that once you get to the USA. Just make sure all your other documents are under your maiden name. 👍

I don't think you need to do anything if you have started the process already. But one thing you probably need to do is inform USCIS that you moved to UAE to work while waiting for your visa.

Mmmm.. in my opinion you can either do a fiance visa or spousal visa. I don't know how quick the fiance visa is going right now. I know when I was doing my cr1 that they prioritize that over the fiance visa because of covid. I would probably do some research to see which one is faster right now. If fiance visa you'll have to get married in the US if spousal visa in the Philippines.

Yes, I think you can submit it at the same time. I actually didnt realized that there 2 i130 forms. I was looking at the instructions online and it says if you are applying for your spouse and if he/she is outside of the US they still need to fill out the I130a form but doesn't have to sign the form. You can go to uscis.gov to check the instructions. 👍

I don't know if there's another way or a document that you can show in behalf of the passport. But as far as I know based on my case we did need the passport for the process. And you definitely need it when you do the interview because they're going to put the visa in the passport.

Well, I did an expedite request and so I'm not sure how long for the regular wait time. We did the expedite because they always postponed the interview and close down because of COVID-19 (2020). So we were afraid that it'll take longer.

Yes, for my case my lawyer was the first one to receive the mail then I think my husband. I'm trying to search my email and I don't think I received one. So I would think they will send that to the petitioner.

First of all congratulations 👏🎉. I personally don't know how long the process would take but it's definitely possible. I actually have a friend who had the same situation but I think her husband came to the usa to visit and they got married here instead. Then he applied for a change of status and was able to stay here. But of course I would still ask an immigration lawyer to make sure that you're doing the right thing and they probably have other options for you too.

base on my experience after NVC DQ'd our case we waited about a month or so then we tried to do an expedite request and month after that got approved then I did the medical and they sent me an interview schedule. I don't know how it works in Thailand but maybe you can try to do an expedite request. How to convert cr1 to ir1? I came with a cr1 visa
I don't think you can convert it to IR1 if you're CR1 visa after you arrived in the US you'll get your greencard for 2 yrs then you'll have to apply for removal of condition then you can decide if you want to get 10 yr greencard or become a us citizen after 3 yrs of living in the US. I don't really see the need to change to CR1. I hope this answers your question. 😊
