You can thank CDCR for taking away the black box which used to be required for all transports. Black box if applied correctly, would have prevented the inmate from taking his restraints off 99%. But because inmates complained, CDCR decided to be nice and stop the required use of the black box. No law enforcement can shoot a fleeing felon unless they pose a imminent threat to the public or the officer. Police used to be able to but the country has gone soft on crime.
He was cuffed, he was able to pick the cuffs. Proper application of the black box would make it nearly impossible to gain access to the keyhole that would require the inmate breaking the black box which would be hard to do if properly restrained.

First he tried chasing the inmate down and couldn't. now he is breathing real hard, heart rate is really high, it would be difficult to aim steady and hit the intended target. Second, yes he did have the green light legally to shoot the escapee but the policy also states that if an innocent bystander is shot the officer will be held account for that because the policy states that if discharging a round puts an innocent bystander at risk then you don't have a clear shot and you must refrain from shooting. CDCR's shooting policy is pretty clear but sadly it has politicized and I have personally seen officer fired and charged not because he or she didn't follow policy because they did. But you have a lot of higher ups who make the situation political and will burn the officer. The other reason is the officer didn't feel confident in his ability to hit the escape with the bullet and last it is a big deal when you have shoot a person cause you might very well take his life and the person has to live with that and most are not able to live with that.

It also allows deadly force to stop a fleeing person for a felony that resulted in death/GBI...but this is if the crime was just recently committed...not just because they previously committed/been convicted of murder, etc. The new law/policy removed a HUGE and very important escape deterrent.

CDCR amended the shooting/escape policy around 2022. CDCR officers can not use deadly force during an escape if there is no Great Bodily Injury present. Meaning the escape alone does not equate to GBI. However, if in the escape he is beatjng a person unable to defend themselves to jack their car, then they can shoot. But in that same scenario of a car jacking, the driver is able to fight back then the CDCR officer can not use deadly force. CDCR officers do not carry tasers.
