Local or city cops may comply, many try to BS you into talking.
As one hat I've seen puts it: "Stop self snitching".

My question would be if someone who doesn't have this knowledge of how to ask for a lawyer, wouldn't they be in the understanding that they have asked for a lawyer? I think the best thing to do is ask for a lawyer then stop talking. That way if you haven't asked on a clear manner it doesn't matter because you've stopped talking. I'm so stubborn I would sit there for a week not saying a word until I was allowed to contact my attorney.

There's a reason why whenever Police get into an OIS, they get told "sit in your car, turn off your badgecam and don't talk to anyone but the Union Rep or an Attorney".
Do a UA-cam search for "never talk to the police" and see how many attorneys and legal experts have said this exact phrase. Officer Friendly is a myth; they are not your friends.
Cops were never anyone's friends except for the State.

Massad Ayoob from Wilson Combat made a youtube video trying to convince people to give a brief statement. Thank you for actually being a lawyer James and reminding people the cops are not always on your side.
To be fair I think the brief statement was something like, "He threatened me with a gun, I was in fear for my life, so I had to shoot him".
I've seen Massad give more questionable advice than useful stuff when it comes to Police interactions.
I think the majority of the 2A community has moved-on from Wilson Combat and Mr. Ayoob for advice.
Especially after the whole Weapon Light fiasco. They [Massad, Bill & Ken] also think that carrying a spare magazine is pointless and will only get you into further trouble.
To which I replied: _"I do not carry a spare mag because I expect to get into a protracted gunfight. Quite the contrary. I carry a spare mag because I expect the primary magazine to fail at any given point."_ They promptly blocked me after that rebuttal for the foreseeable future.
Dare I say, Senior Citizens stuck in their antiquated ways while living in the modern world is the _last_ place you look for opinions. In fact, my attorney shutters anytime he hears someone mention those gentlemen.
IMHO, Wilson Combat is good for 1911 mags and parts - that is it.
Of course, YMMV.

Big difference between standing in your loving room with a dead guy and blabbering on, and making a nice concise statement such as, “He broke into my home, I was terrified for my family, He was armed, and I defended myself. Now I want my lawyer”. I don’t agree with a lot of Ayoobs opinions, but making a statement like that is going to be vastly more helpful than either A) not shutting up, or B) saying literally nothing.

I did civil defense litigation/trial work for 16 years in Chicago before just going corporate in-house, and I have no idea how you find the time to do legal work (bill hours) and create all this UA-cam content/travel, etc. (and keep it top notch). Well done. #didyoubillyourhoursforthemonth
In 2020 I split my billable time (and salary 😑) in half to focus on UA-cam garbage.

So many pro-gun folks are hardcore pro law enforcement with no exceptions, it’s nice to hear you say some cops don’t give a shit about your rights in the beginning! Knew I liked this guy
As someone in law enforcement now, the overwhelming majority of those cops are located in big cities with zero training. The small town departments still give a shit and the training budget goes further due to less brass in the mix. The whole defund and ACAB movements are doing damage, for sure, some of it entirely justified, a lot of it is due to not understanding current SCOTUS case law or flat out not understanding the job.
At the end of it all, police training budgets are first to get slashed to the minimums during budget cuts, then equipment, and finally, personnel.

If i was on trial for murder and you were my lawyer i would just be staring at you thinking “does he really like High-Point.. i mean if he can convince people to buy a CF380 he can convince anyone of anything.”
What gets me is that they went with the dog excuse. First because even asking for a canine lawyer would still be asking for a lawyer. Second because he phrased it as a question: "Why don't you get me a lawyer, dawg?" Why not go for the obvious "He never requested a lawyer, just asked us why we weren't giving him one"?
When I got arrested. I said “I want a lawyer” six times. Never stoped questioning me. Never got a lawyer. (Unrelated to that charges ended up being dropped)
The court had not appointed you one yet, unless you had a private party on standby

Someone who claimed to be a lawyer (and ex cop) starting telling me that was ridiculous because "everything is recorded" and he acted like I was an idiot for thinking they could just ignore your request for a lawyer then simply lie about it. He even said something like "even if they 'lied' about it, they'd never get away with it" as if they never lie, ever. Everyone agreed with him that I was asking a stupid question, yet here you are saying that exact thing happened to you.

What baffles me is how many times people admit to their crimes during an arraignment - after they have been advised of their rights by a judge.

As somebody who grew up watching the show cops, and now obsessively watches police body cam videos, I'm blown away by the public's lack of knowledge and misunderstanding of their rights. They think they have rights that they don't, while not using the rights they have. Bring back civics' classes to high school and teach this stuff.
This. As a police officer, I've been, for the last four years of my career, directly citing Supreme Court case law to people who make a claim I can't do something I legally can because of certain rights. Usually, it's probable cause searches of vehicles which smell of Marijuana (illegal in my state, case is Carroll v US). Have yet to have any of those cases to make it to trial. All of them get plead out before getting close.
My DUI cases are the same. I explain everything I'm doing and why. I've gone to ONE DUI court hearing in ten years in law enforcement and it was a DUI Drug case. It never went to trial because after the preliminary hearing to bind it from Misdemeanor Court to Felony court (multiple priors and felony drugs found in the car), the defense attorneys opted to plea it out after seeing the body camera. I've had defense attorneys tell me I make their job difficult and appreciate the time I take explaining things to their clients.

Don't answer questions while under police interrogation. If they're interrogating you, they aren't trying to find you innocent. Ask for an attorney/lawyer and let them take care of it.

The biggest lesson taught to me when training for the security in the private sector. If you have the misfortune of being involved in a shooting. Demand to go to a hospital, demand a lawyer and STFU.
The police are investigating you and the incident. At that point, they are not your friend.
If you don't have any injuries that's going to a hospital in any way do something productive for you? Is there any advantage to Simply allowing them to take you in and then requesting your lawyer and not say anything else?
As a Justice of the Peace here in Texas, I periodically had to perform magistration duty at the county jail. This involved reading probable cause affidavits sworn to by arresting officers and setting bail amounts for arrested persons. In the course of these duties, I routinely had to ask questions of the accused to gather information relative to their employment, standing in the community, etc. Many, many times they would try to offer information related to the circumstances of their arrest, and I would have to admonish them to simply answer the questions I asked and not to give me any other details. There were many times they would just ramble on an on, and I had to firmly tell them to shut up because they were doing damage to themselves. The booking officers used to stand there in amazement because I would tell them not to talk anymore. I would also explain to them that it was my duty as a magistrate that I was there to protect their rights in addition to determining whether or not there was probable cause for their arrest.

As a gun guy and a lawyer I love your content on various channels. Gun guys don't need to be "boot lickers". I know cops who are great and don't want to railroad anyone, I also know that the opposite exists and you never know who you are going to get. this is important advice.

Thanks. I have understood in a self defense situation it is best to first give a brief statement then state I won't say more without a lawyer. Say, "he was attacking me, I feared for my life, I want a lawyer."

Well said James. IMHO, ask to be read your Miranda rights before talking to the police, whether you have been arrested or not. If they do not read you your rights, recite them back to the police (assuming that you have them memorized, which you should have). Then clearing request a lawyer and shut up until your lawyer arrives.
This video is unfortunately short, but necessarily brief so as to hammer its simple point home.

I know too many people that can't spend a full minute in silence and have to start yapping if anyone is around to hear them.

I've seen for myself on this platform persons asking for Lawers multiple times to the police... and the police just ignore their requests.
This just reminds me that we have a Legal System not a Justice System.... well maybe a multiple layer legal system depending on Who you are.

Don't forget Paul Harrell and his great advice - he who calls 911 first wins in the eyes of the police. James is describing when you're already under questioning. But who is determined to be the bad guy can be shockingly simple and nonsensical
While I think Paul Harrell is great and gives outstanding advice I personally was involved in a self defense shooting in late ‘99. I was the person that called the cops. My bad for not keeping my mouth shut and giving what I thought was an easy to understand statement about what happened, as Paul would say, allow me this caveat. I was promptly arrested and charged. After two court appearances and my attorney finally getting to actually talk with the prosecutor and the judge the charges were dropped. No mos or no mas. Whatever the legal term is. I was not exonerated but there was no prosecution. So sometimes, if your stupid enough not to keep your mouth shut, you might still go to jail. Only time I have ever been in jail and shall never return.

As a criminal defense attorney, I 100% agree with this advice. Also, I have a dog named JD (Juris Doggo) and so anyone in my area who requests a “lawyer dog” should not be denied one bc one is in the area.
