    Surveyors won’t be able to cite it during an IJ in the state where I used to work. The (State name) Healthcare Association has set policy there since 2011. I worked as an RN LTC (SMQT certified) surveyor and complaint/abuse investigator, then in the office processing surveys, imposing fines, directing surveys and complaint investigations, tracking enforcement cycles, and representing the state in IDRs for 18 years. I saw the decline in our ability to protect our frail and vulnerable people. It’s sickening.
    CMS needs to clarify and “beef up” this regulation in order for this reg to be cited and retained at IDR, IIDR, hearing, and appeal at both the state and federal level.
    Thank for your videos and efforts to bring abuse and neglect to light. Not all nursing homes are bad, but the ones that are serious and/or repeat offenders need to be held accountable for causing harm.

      Thanks for the info and thanks for the kind words. Yeah, as you know, some of the regs lend themselves to being confirmed or not. The governing body reg would be rather difficult to investigate for a surveyor, or I would imagine so.

      @@justiceforresidentsthere are just so many ways for the owners to weasel out of it since it’s so vague, unfortunately.
