Thanks to everyone who worked so hard to shine a light on the many areas where the truth and the facts were not disclosed. Where truth does not travel, justice fails to exist. Thank you, Dr. McGraw.

    I have a newfound respect for Dr. Phil.
    The way people are tried needs to change. There needs to be certain requirements of what needs to be addressed during the course of a trial. That this child's comprehensive medical history wasn't presented to the jury is absolutely outrageous.
    Juries are only allowed to consider what is presented during the trial.

    This is heartbreaking 😢 as a parent with an autistic child, this scares me as to how there is a clear lack of understanding of how neurodivergent individuals communicate differently. And how detrimental to their lives it can be. Ineffective council was most definitely an issue here also.

      My son has Asperger’s and he does not have typical reaction to any emotions at all, he has one face. My son has cried twice in his life, he is 22. He cried when he was born, and when his dog died, if I die tomorrow I don’t know that he would cry. I’ve never seen him laughing, sad, and when he is upset it’s the same face he has when he’s not upset, he can’t even tell me when he’s sick. He graduated high school with a 4.0. He hasn’t gone to college because he can’t be in a room full of people, his anxiety is to the roof. He’s an awesome artist and, this is funny, he works in customer service and his manager told me he wished all his employees had Asperger’s, he works every day, never calls out, works extra hours if asked and it’s at work and hour before clocking in, if asked to work on his day off he goes to work. He’s amazing but a handful at times.

      ​@@jackie_byfaithMy son has a bit of Asperger's and maybe have additional spectrum issues but UC Davis says he is extremely interesting and they want to continue to evaluate him.
      He is a genius (always has been and figuring out his issues was difficult and he would physically manifest his emotions at school with rocks and kicks!)
      But now we know and so does he.
      14 now and finally gaining acceptance at school. ❤
      My son basically has to dumb himself down to hang out with others because others are just so stupid. 😮😢
      Luckily this difference is no longer affecting him at the same level and he's able to enjoy like-minded kids with their matching interests in Roblox and Minecraft.
      Kids need experiences with other kids!
      Bless our children Lord 🙏 amen 🙏

      Exactly a fair concern and easily manipulated in an effort to have a social life. It harkens to the autistic young person killed by police in Colorado I believe.

    I’m so glad they are taking this serious for Mr Robertson, as an Autistic person- my heart breaks for him. This man already had to go through the pain of losing his baby girl, who he took to the hospital 16 times because he was knew she was sick. Nurses and Doctors didn’t take that into account- and the arresting officer agrees that this man needs to be freed.
    I hope he has people who will support him if he is able to be resentenced and let out.

    I have said for many years someone does not have to be held accountable for everything that happens. Sometimes things just happen. Someone is not always at fault. Our legal system has gone overboard with holding people accountable.

      The medication given to the child is no longer used because it depresses breathing in those suffering with pneumonia. That medication may have killed her.

    Our prosecutors in this country need to get their sh** together. There’s no reason other than ego that this man was convicted. Dr. Phil is saving this man’s life.

      How do you know that 100% for sure!? They said in the Hearing that Dr. Phil testified nobody else was at the home!! If so why is Dr. Phil involved in this case & why does he want a new trial. Dr. Phil putting his name behind this is HUGE DEAL & I DOUBT he would if this man was Wrongfully Convicted!!!! Think about that!

    Well done, Phil McGraw. Well done, legislators on the Texas House Committee on Criminal Jurisprudence. I am very grateful that all of you have stepped up to protect a death row inmate.
    No more executions of innocent people, please. We must do our utmost to safeguard the legal system.

    I also don’t believe this man should have to go through another trial at all, he has been through far too much. He should be let out immediately and awarded a extremely large sum of money to at the least start his life and also be provided with free therapy and all sorts of support to cope with all the trauma he has endured because of all the people responsible for putting him in prison. And this still will NOT be enough.

    In the first 17 minutes, it’s proven this case needs to be reviewed. ALL medical records should be put before the jury, every single scan, every single hospital record. Science has proven that the triad of evidence for shaken baby is outdated and in fact false. This man needs to be released.

    I would say standards for death penalty cases should be much higher. The defendant should be provided with the best defense council team available. The prosecutor office should NOT have total immunity.

    Why is there no punishment for officials who hide evidence that does not support their opinion. It should be seen as criminal when prosecutor, law enforcement and others hide exculpatory evidence. As Dr. Phil says, the aim should be justice not conviction. Prosecutors and police who do not understand this should be disqualified!

    Retrying hardly seems reasonable. The conviction ought to be overturned. The judge never reciewed the evidence. A effect counsel would have been valuable but how dare the prosecutor not have shared all the evidence during discovery. Shame on the whole system.

    I disagree that a crime was not committed. The crime that was committed was lies, a horrible lawyer, judge, lack of police work and so much more. Also they took an innocent man’s life and lost years, last moments with his sick daughter and so much more.

      She had pneumonia and was prescribed a drug that suppresses breathing. That drug is no longer prescribed because it is known to cause death in cases of pneumonia. Hello! He should be released from prison and given all the help he needs to adjust to outside life.

      The trial judge ruled to exclude the child's medical history, so her extensive history of her pre-existing health conditions as well as her current condition at her time of death, was withheld from the jury and defense couldn't use her medical history as defense.

    The judge is the one that didnt allow in court the medical history of this child. Therefore the judge holds the responsibility of changes and also has to be part of the fix to this problem.

    After seeing this, I have a lot More respect for Dr Phil . As a black , who been through BS police and the system , i know the laws here are my by enemies. I believe there are lot more innocent people either in jail or serving Time. There are so many without a strong voice, there areso many 1:12:17 injutice , it's definitely touching to see justice is being justified.

      His autism was not brought out at the trial and in fact did not become known until sometime later. That in itself, would constitute a reexamination of the trial records, etc..

    This doesn’t surprise me that all of this was done in Texas. That state just seems to push the guilty button without thinking. And there’s so many people I bet that are in there that are innocent. Dr. Phil is a hero and so glad he has stepped in to save a man’s life.

    That nurse was paid off to accuse this father that he had SA assaulted his child! This is a disgrace all around. So many people need to go to jail. So many people need to be sued and the people that put this poor innocent man in jail are 💩bricks because their credibility and their integrity went down the 💩hole. 😡

    This is where I have a problem with the death penalty. This is when prosecutors are wearing blinders and are determined to get a winning charge REGARDLESS of the evidence.

      Having a committee meeting such as this involves the repetition of key facts. It's also standard practice for the witness to provide their written opening statement to the committee prior to the day of the committee to be approved in advance.

    I listen to every word from Dr Phil he did not say that the accused is gillty or innocent what he said was the accused had some issue and those issues were not addressed and there were quick conclusion render in this case baby shake and bake syndrome case also Dr Phil said the baby had medical issues and he also said he don't know if that causes the baby death ?

      The baby had been to the hospital prior to the dad being around, the baby had been to the hospital many times prior. He never did anything to that baby.

    The conclusion of the autopsy stated that the child died as a result of 9 different blunt force injuries. Perhaps Dr. Phil has not been given this information.

      Nikki was found to have "a bruise on the back of her shoulder, a scraped elbow, a bruise over her right eyebrow, bruises on her chin, a bruise on her left cheek, an abrasion next to her left eye, multiple bruises on the back of her head, a torn frenulum in her mouth, bruising on the inner surface of the lower lip, subscapular and subgaleal hemorrhaging between her skin and her skull, subarachnoid bleeding, subdural hematoma, both pre-retinal and retinal hemorrhages and brain edema."[11] Additionally, four separate doctors testified Nikki had "multiple blows to different points on the head", which could not have been caused by falling off a bed.[12]

      @jackie_byfaith this was recently released by the Attorney General it was extensive but here's a snippets....Dr. Jill Urban, the medical examiner who performed the autopsy on the two-year-old’s corpse, testified during the trial using photographic evidence that Nikki’s head had been repeatedly struck leaving clear impact wounds totally incompatible with merely being violently shaken. Dr. Urban’s findings were reviewed by six supervising medical examiners at the Dallas County Medical Examiner’s Office, all of whom agreed and signed off on her autopsy report. In 2016, when Roberson’s case was being appealed, Dr. Urban unequivocally affirmed that she “quite clearly defined multiple impact sites to the head and ruled that the death was due to blunt force injuries.”

    Didn't realize the extent to which 'Innocent until proven guilty' never existed in America, and even now the constitutional right of Habeas Corpus is not in effect at this point since it is still being used to attempt to amend cases in US courts today that use the 'Guilty until proven innocent' doctrine. We all long for the day when the constitutional Habeas Corpus is finally first applied to the US justice system.

      Dr Phil holds a Doctorate in Clinical Psychology. (PhD). He *is* a Doctor, but not a Medical Dr, which he has repeatedly informed the Public over the last 40 years.
