When someone tells you over and over again "I'm not lying to you, I'm being honest with you, I'm being straight with you." they are LYING TO YOU. You have a right to remain silent, do it. The idea is to wear you down through lack of sleep. Then they drag you back in the interrogation room and the torment resumes. If they go after you this way you will have a breaking point. I don't have any advice on that except Remain Silent. If you talk you will be helping them hurt you. Don't help them hurt you. Be silent. It's your only way out.

@@jonnybaze That's where it gets gray. On a traffic stop precedent generally states a half hour. That means charge the person with something or let them go within the half hour. You can actually have a charge dismissed on the basis of being detained too long. So if a cop thinks you have drugs inside your car yet you tell him "No" to a search of the car and a drug dog is 2 hours away if you are forced to wait you have a good case for dismissal. With this guy here I don't know the exact circumstances but I imagine when he asks for a lawyer they decide to charge him or not with based on if they have enough to charge him. Otherwise questioning can go on for hours until you make an effort for it to be over which if you don't know that is a catch 22.
Breakneck well I've never heard 30 minutes. I've heard 15 or 20 and I believe that might be a Supreme Court ruling. So the cop said "you're not free to leave because you are in a police station". That doesn't equal detention or even make sense. I believe he was possibly illegally detained but at the same time volunteered to go to the police station. I assume they told him that he was coming in for questioning, I would then assume he said something like ok or whatever, then told him to turn around to be handcuffed and he complied. Thus he volunteered but under what could be argued as false pretenses. Or he was under arrest for a different crime or violation but they state he's not under arrest. You're right. If he said no, they would need to charge him or release him immediately. It's not a catch 22. He is aware of his rights and volunteers to talk.

But some cops go too far with long interrogations and lying about details.

He was not under arrest, he needed to be read his 5th amendment rights as he was being questioned. My understanding of it is that unless they have probably cause then they can detain him but not arrest.
They got him to answer several questions by ‘playing nice guys’. He has admitted being a long time member of a MC that has something to do with the death of an individual. He admitted to being one of the leaders of the MC during the death of the former member. He admitted knowing the deceased. He admitted knowing other individuals that were most likely other people being questioned, which gives their answers more credibility. He confirmed other answers they had questions to as well. All this by the investigators ‘playing nice guy’ and keeping the mood light. Make no mistake, these investigators are there to find evidence of your wrong doing. They aren’t there to exonerate you. That’s what a lawyer does. You’re best bet during any questioning is to invoke your rights to remain silent and have a lawyer present. This way you do not incriminate yourself.
Joe he didn’t admit to to anything that wasn’t common knowledge. He played that very well. Even after he said his memory sucks the officer says “oh your neck got cut in 2009 right?” He wisely says “I don’t know, sure.” Those cops sucked. That means charge the person with something or let them go within the half hour.
You can actually have a charge dismissed on the basis of being detained too long.
So if a cop thinks you have drugs inside your car yet you tell him "No" to a search of the car and a drug dog is 2 hours away if you are forced to wait you have a good case for dismissal.
With this guy here I don't know the exact circumstances but I imagine when he asks for a lawyer they decide to charge him or not with based on if they have enough to charge him.
Otherwise questioning can go on for hours until you make an effort for it to be over which if you don't know that is a catch 22.

So the cop said "you're not free to leave because you are in a police station". That doesn't equal detention or even make sense.
I believe he was possibly illegally detained but at the same time volunteered to go to the police station. I assume they told him that he was coming in for questioning, I would then assume he said something like ok or whatever, then told him to turn around to be handcuffed and he complied. Thus he volunteered but under what could be argued as false pretenses. Or he was under arrest for a different crime or violation but they state he's not under arrest.

The only country I know that does this is England.
I’m torn because lying has probably lead to arrests that were totally warranted. But some cops go too far with long interrogations and lying about details.

They got him to answer several questions by ‘playing nice guys’. He has admitted being a long time member of a MC that has something to do with the death of an individual. He admitted to being one of the leaders of the MC during the death of the former member. He admitted knowing the deceased. He admitted knowing other individuals that were most likely other people being questioned, which gives their answers more credibility. He confirmed other answers they had questions to as well. All this by the investigators ‘playing nice guy’ and keeping the mood light.
Make no mistake, these investigators are there to find evidence of your wrong doing. They aren’t there to exonerate you. That’s what a lawyer does. You’re best bet during any questioning is to invoke your rights to remain silent and have a lawyer present. This way you do not incriminate yourself.
