@22:29, Even if she signed the agreement the night before the wedding, it could still be invalidated in court due to claims of 'pressure and duress

I understand that Derek's mortgage-free condo is not the matrimonial home. However, if it were, it would be subject to a 50/50 division. My question is, if Derek purchased the condo with borrowed money from his father, who then placed a lien on the property before Derek got married or entered into a common-law relationship, would Derek still be obligated to repay his father in the event of a divorce? More generally, is a lien an effective tool for protecting property? thank you in advance!

Super interesting, thank you. I've watched this as someone living in BC and believe in this province there were changes to the family act in 2013 that enable division of property in common law relationships, meaning you do need a cohabitation agreement to steer clear of this. At least that's my understanding. I would really really stress that this advice is province-specific to Ontario.

Hey thanks for the BC changes - I'm providing the link to the Government of BC website that cites this for others who happen to be from BC as well: www2.gov.bc.ca/gov/content/life-events/divorce/family-justice/family-law/dealing-with-property-and-debt/common-law
