He maintained that the impropriety is a "bare assertion and not based in fact" in his ruling, therefore not allowing another Judge to oversee the hearing for recusal. This is just Glanville doing everything he can to drag the process out and try keep the case in his court. Once a superior or Supreme court hears the motions he's done as a Judge.

The idea isn’t to get the judge recused at first, the idea is to keep appealing it. If the other judge denies recusal then a stay and appeal will be filed. If he recuses himself, I’m sure they will file a motion for the new judge to review it for a mistrial and another appeal will ensue.

It has to meet all criteria before it gets passed off to another judge to rule on the motion to recuse. Glanville has to rule it meets all the criteria before it is passed onto the next judge. Now, you can argue that he shouldn’t have any right to make a ruling on his own motion to recuse, but he has to determine it meets all criteria before it moves out of his court.
The lawyers covering it, are saying differently. And in the opinion of the Supreme Court, it states that he can’t rule on it, and it has to go to a different judge because he would be disqualified to rule on it. If that ruling doesn’t satisfy the defense, they can then petition the Supreme Court once again.

It seems unlikely the DA would just drop the charges. At that point, defense would file a number of motions: they would definitely move to have thug released on bond citing the amount of time he’s been held while presumed innocent,,perhaps good behavior in jail, attentiveness in court , etc. , and on that, it would certainly be a non-zero chance of success, provided he offered to pay for extensive security measures, etc., however, it could also be easily denied. Then would come a motion for summary judgment among others; Generally a hail Mary with no real chances but essentially a motion asking for the court to decide the charges on their face are without merit . Assuming no success there, they’d try other avenues but would also have to prepare for the real possibility of another trial starting from scratch which coils easily last into 2027 or longer…

It would make him unpopular in gang circles if he were to testify, but that is his personal problem and the law does not recognize this hurdle. There is no other privilege he can invoke, such as being the doctor of one or more of his defendants or being related to one of them. At this point, the witness was just obstreperous and didn't want to testify without good cause. And it is entirely reasonable to be told what to expect in a situation like this. This is not coercion. You just don't like that he is a witness and that he must testify. Also: the extrajudicial accusations of LW are, in this instance, completely meaningless. It may well go into evidence, but who cares. It isn't automatically presumed to be true or even relevant. He doesn't like how the prosecution applied force to get something they are entitled to. He is in the crucible by his own decisions. Nobody needs to give deference to a witness preferences about what to testify about or not. It is time to grow up.

Then the prosecution immunized him and he still wouldn't talk. There is no real way to un-put someone under oath. He created the conditions that made it necessary to inform him about the consequences of his refusal to testify. They should have involved the defense, but realistically, there is nothing for the defense to influence here.

And the problem with the ex parte is formost that he had already been sworn in, he was in the middle of testifying when this happened.
@@6205100 Authorities can well prosecute him, but they may not use his testimony against him. If they can prove that he committed a crime without his court testimony, he is on the hook for that. He still has nothing to fear from testifying, thus the fifth amendment does not apply.
He was in the middle of testifying, yes, but he was being obstreperous the entire time and he actually did invoke his fifth amendment right on the stand. Then the prosecution immunized him and he still wouldn't talk. There is no real way to un-put someone under oath. He created the conditions that made it necessary to inform him about the consequences of his refusal to testify. They should have involved the defense, but realistically, there is nothing for the defense to influence here.
@@6205100 In fact, the tapes in which he talked for a long time and very freely told a story. It is nearly impossible to negate what he said there or to make it vanish. And jurors can probably tell which version of the story is more correct.
