@Albert Munkey yes, it is crazy how many clients we've represented that were charged with DUI without any actual sufficient evidence or probable cause for an investigation. And Keep saying no to those field sobriety exercises! Even completely sober, it's easy to fail them and police can STILL charge you with a DUI even if you haven't been drinking.
At least in florida, there is no negative consequence if you say no to them, so there's no benefit: www.criminal-defense-dui.lawyer/library/never-do-field-sobriety-tests-in-fort-lauderdale-florida.cfm

P.B.C.S.O. At its finest. Surprised this footage was available. Mine wasn't. I beat the case. Only because the judge was an asshole and threatened my previous arrest from 5 years prior. Violated my rights. Believe it or not. The public defender actually filed the appeal!!! I said to him. No way will this work. He said can't hurt to try. It took 3 years of bullshit and waiting for the state to answer the appeal. I asked several local lawyers to sue. They were all to scared and threatened to try and sue the sheriff's office!!! Most corrupt department in the state!!! Bradshaw really has an awful lot of power over that county. I had to serve 70 days in the county jail. What a shit show that was. Those inmates ran that facility. All the workers there were all related to the inmates. The food was a mystery. Some sort of frozen processed meat that was thawed unsanitary. Served to inmates 6 days a week. There were numerous career inmates that claimed the food gave them heart disease.

The other cop knows that too. Which is why he is insisting this cops verbally acknowledges probable cause before he becomes the one responsible for violating the driver. If he was bad cop he would have ran the woman through the tests. He following the law even though he sounds like he trying to fabricate he really just waiting for cop to say yeah ill testify I saw smelled believed yada yada b4 he has to sit on the stand answering questions he dont have the answers to. So maybe he is following the law at worst he is trying to avoid liability. Either way he isnt gonna violate her without that cop being on record as the reason!

Have you found that over the years, the more you did FOR FREE for your public-servants,
the more ungrateful, thankless and abusive they have become, so may we politely suggest
    the following de-escalation-for-remedy?
THE TRUST IS COLLAPSED....in other words, you are no longer granting any more credit.
If the policeman is not lawfully investigating the crime on behalf of the male/female victim and is entering YOUR company jurisdiction without you summonsing them, then would it not be advisable to be politely placing YOUR public-servants/trustees, whom are acting rogue, under your notification that you charge $911 per hour for your time spent in their company and also $777 for YOUR performance.... and that any further communicating with you, is with them accepting the terms & conditions of the commercial contract IN THE PRIVATE (the cop and their CHIEF and their POLICE UNION is now with PERSONAL liability.... because Notice-to-Agent-is-Notice-to-Principal...and also through JOINDER...and they also lose their qualified immunity)
This way, you are NOT resisting/refusing to obey/comply with their orders/demands/policy /questions, because you are now willing to perform WITH THE CONDITION that payment is with you immediately, because you have NO CONFIDENCE with them administrating YOUR company trust!
THE PUBLIC TRUST IS COLLAPSED...Why is YOUR company issuing them extra credit?
Are YOU not the grantor and the beneficiary of YOUR trust? ...making them the trustees, whom are with their fiduciary obligation and duty-of-care to be NOT causing you injury nor damage nor loss nor harm.
Is THEIR job YOUR job? Is THEIR company policy YOUR company policy?
not unless and until they are PAYING for your company time & performance
THE CONSTRUCTIVE TRUST IS COLLAPSED...YOU are no longer performing free-of-charge!
You may be willing to pursue the matter through the small-claims-court and/or through arbitration which is held in-the-private because PUBLIC court is only for the PUBLIC servant.
YOUR TRUST FUND IS NOW WITH RESTORATION....YOU are now making money from every encounter with YOUR trustees because the days of doing something with them for free are over.
PS-Be the BUSINESS man with your trustees.....NOT the victim.

Rossen Law Firm, I don't know you or your firm, but in general I don't like attorneys.
As a romantic I used to think attorneys were the guardians of the courts, that they would point out and not stand by the wrong doing by the courts, however that is not the case. No sure if by choice or by force, but seems to me attorneys have become part of the problem.
For example, in Cancun many taxi drivers from the hotel zone sell drugs, now rumor has it that it is not by choice, that they are forced to sell x amount weekly or face the consequences. At the end of the day, do I feel bad for the taxi drivers that sell drugs or should I be upset at them? Pablo Escobar made it famous "plata o plomo", silver o lead?
Many of the taxi drivers are forced into it, but then they start enjoying the extra income. In a sense it becomes the same for attorneys. Why would attorneys want to fix a system that is providing so many clients/income for them.
Your client didn't deserve everything that happened to her. You guys did a good job and found the evidence needed to get the case dismissed. How ever who is going to refund her all her expenses including her attorney fees? She probably was kidnapped and spent a night in jail, who ends up taking responsibility for that?
Everyone says, you can do a civil suits for civil rights violations, but does anyone know how much it usually costs to get one of those started? Does anyone know how hard it is to find an attorney to help you out?

    • @Rossenlawfirm.
      @Rossenlawfirm.  4 роки тому +7

As you said, we agree our client didn't deserve that, and while justice was served to an extent with us being able to get her charges dropped - you're right that it doesn't solve the issue that, essentially, a law enforcement officer charged her with a crime unwarrantedly that ended up costing her personal time, money and threatened her reputation. It's not OK. And we believe there needs to be more accountability for law enforcement officers in situations like this.

But ultimately it’s a given they must be paid for the jobs that they’re doing. The client after proven innocent has the obligation to continue and sue to get the money time and stress that they’ve suffered through this back. Unfortunately that’s a whole other kind of attorney. But I know in the state of Florida when you sue someone usually you sign a contract with that type of attorney and if you win they get 33 1/2% I believe I could be wrong plus I believe the cost Associated with the case then the client gets the rest. Personally for me if I receive the dollar back but they were made to pay much I would be much satisfied. It’s all about accountability
