The female driver of the car that was still in the street crossed into oncoming traffic and was speeding according to the witnesses. She hit the female driver of the car that is on the sidewalk almost head-on. The collision sent that car onto the sidewalk and hit a street light bringing it down. The victim was transported to a local hospital with a minor injury.
The female that caused the accident admitted to drinking two beers earlier and did not fully pass the field sobriety test, but blew on a .04 on the breathalyzer, which is half of the legal limit. She claims she doesn’t remember how the accident happen. She was not arrested.

She was NOT legally drunk. So, what charges did you want them to file on her? I am a laboratory technician and when the ER got these patients they would bet on what the ethanol level was. Some of these people were absolutely drunk and the nurses would come back with 0.29 and other crazy high levels. And it came back with comparable numbers. Three or four times the legal limit of 0.08 was always a good guess. The highest I ever saw was an alcohol level of 0.42, which is over 5 times the legal limit. Whoever got the closest guess would win a donut or something like that. The nurses are always bringing in food for the break room. But you'll see people with 3 times the legal limit acting normally compared to someone that was right at the limit . I guess your body gets used to all the alcohol after awhile.

I agree the tests are BS for determining whether someone is inebriated, and shouldn't be used to establish probable cause. They are too complex to administer, too subjective in scoring, and a huge number of factors besides those the administrator is interested in can impact a subject's performance on the test.

I got rammed into a parked car by a 18 YO driving under the influence without a DL and she was trying to get to the taco shop on h street, she was not wearing a seatbelt nor her passengers. They let them walk away & UBER HOME. & My car was totaled.

The sobriety physical test will fail 95 % of sober people. Just try ding them on your own ! Admitting to do those tests is admitting your guilty. If it wasn't for the Breathalyzer test that woman driver would be a DUI for sure. Still too many given a drivers license without sense to drive a car. If you can't speak English no drivers license should be given because in an accident they can't communicate with the other drivers.
