Mudda AapKa: SC declares Benami Transactions(Prohibition)Act 2016 as unconstitutional | 23 Aug, 2022

सुप्रीम कोर्ट ने बड़ा फैसला लेते हुए बेनामी लेनदेन ;निषेध संशोधन अधिनियम 2016 के संशोधन को रद्द कर दिया है। सुप्रीम कोर्ट के मुताबिक कानून को पूर्वव्यापी लागू नहीं किया जा सकता साल 2016 के अधिनियम का केवल संभावित प्रभाव होगा। सुप्रीम कोर्ट ने बेनामी लेनदेन ;निषेध संशोधन अधिनियम 2016 के संशोधन को क्यों रद्द किया। इसका क्या प्रभाव होगा। इसको आज समझने की कोशिश करेंगे।

This judgement is arbitrary. Must be reviewed by a higher bench to facilitate confiscating benami property or pay sufficient taxes on it to regularise. If those who did the crime between 1988 & 2016 get away that would be against the letter and spirit of Constitution. Hence this judgement seems to let these criminals off the hook therefore unconstitutional too. Govt must go for review of the judgement by all means. Just becoz CJI said unconstitutional why shud one accept without substantive reasons supporting that view. Hope foul is termed foul.
