Firstly, I commend you for doing audits at all. Good for you. That said, I have some suggestions regarding basic protocol. When you are confronted by a security guard out on the sidewalk, he is absolutely no different than any other citizen. You do no answer to him, so explaining your presence and/or your actions is not required and was a tactical mistake because it empowers him. Further, as soon as he touched you or your equipment, you should have advised him that a complaint would be filed against him (and then, of course, followed up by actually filing one). Finally, do not make any deals or arrangements to limit your legal activities (e.g. not filming entry points). If you choose not film these things or anything else, that's fine. But, that should be your choice to make rather than it being part of an 'arrangement' or an 'understanding' as a means to avoid unlawful harassment by security and/or police.

A security guard that openly admits to knowing nothing about any court order in place or the rules on photography at that building. Isn’t that his job to know those things? What exactly does he do, aside from stick his head out the door to question people about reading notices taped to the windows. So many of our employees are utterly useless in their positions...gross. Two point here: (1) That notice posted in the window that you read is not policy, it is LAW. The CFR/Code of Federal Regulations. (2) While you acknowledged the court order part prohibiting photography you glossed over the part right before that; "Except where security orders, rules, regulations or directives apply OR a Federal court order prohibits it...."

I think that security guards do not have jurisdiction on the public sidewalk. So that old guard that told you not to film him is a complete idiot. You were very nice to them. I still think you have the right to go into the courthouse and film in all public areas. it is your constitutional right.
Shouldn't have to make an appointment. Courthouses in public areas are supposed to be protected by the first amendment for recording. The judge can make courtrooms restricted.

I would have a card printed up with the law of Yourktown regarding identification. And the law regarding filming people in public. When a police officer tries to violate you and him a card and then telling you now know that you’re breaking the law this is the code with the PO number on it so feel free to continue and then walk away
You should do an audit in Maryville, TN. Blount County is getting away with UNLAWFULLY posting a sign on the front door of the Blount County Justice Center stating that cellphones or recording devices are prohibited inside the public building. Local policies DO NOT supersede our Constitutional rights!! Freedom of the press or freedom of the media is the principle that communication and expression through various media, including printed and electronic media, especially published materials, should be considered a right to be exercised freely. "Tennessee law permits the use of still photography and audio and video recording devices in any trial, hearing, argument on appeal, or other matter held in open court that the public is entitled to attend." It is also our Constitutional right to record anything we can see in a publicly accessible area. This is a clear violation of our rights. FYI- Government buildings are paid for by the members of the public's taxes so we have every right to record anything that our eyes can see in public!! City, state, or county policies do NOT override the laws or the U.S. Constitution. Every American has a First Amendment right to record in public places, even in government buildings. The First Amendment to the U.S. Constitution states “Congress shall make no law abridging the freedom of speech, or of the press.” This means that no government entity may curtail free speech and press activities. Photography in a publicly accessible area of any government building is our right. Both the public and the press have a right to record government officials or matters of public interest in a public place. But unfortunately, it is one thing for a photographer to know his or her rights when recording public officials and quite another for security guards, police officers, and government officials to be knowledgeable of or even care about those rights. One thing you should always remember is "they are not your friends" they are only there to get you doing something wrong and site you or arrest you so rmb. Give as little information as possible only where necessary!
Even though the Courthouse has posted the GSA _Rules and Regulations for Federal Buildings (Nov 2005),_which state that public recording is permitted within Federal facilities, at least within corridors etc; there is still a caveat in place in that most (if not all) Federal Courts, which includes the Supreme, District, and Appellate Courts do not permit recording by the public within the Courts, as for _Rule 22,_ this *appears* to be a rule that is specific to the State Supreme Court of Georgia so it would not apply to any of the Federal Courts. Even then, _Rule 22_ seems to only address recording within a Court hearing and not within the Courthouse itself. My son went to Hume Fogg. It’s a magnet school. The Estes Kefauver building is off limits to the public. My son used to work there, and I’d stop in to see him. @@civilunrestnews1349 well that is rare in the auditor community. Most are delusional or childish. Since you are new I'll offer some advice. Don't trust anyone that just chimes in. You will find tons of stupid people saying useless shit like wrong or show me the law. I had a comment on something you read in the video. So you can reference back to it. That said you should really not trust that and look into it yourself. From me or anyone. But if you look things up and can't properly understand it. You are putting yourself at risk. And you will be like every auditor that ends up in court trying to beg for funds. To defend their own stupidity. If you read that section on the door and don't understand the press needs permission to film you didn't understand it. It's a common mistake. The auditors find a sentence or fragment that says what they want and they ignore previous or following statements that put conditions on it. Auditors don't like being called sovereign citizens. It's like the people that don't like being called stupid. You have to meet the world half way and stop acting that way. When auditors cry to the police what is your reasonable articulate suspicion. They don't have to tell you. They can tell you they are answering a call. Or investigating a call or report. Your behavior can be suspicious and that us enough. They may have to justify it to a judge or internal affairs. It's the same stupid type shit when sovereigns cry about jurisdiction. I would look into us v grace I think it is. If you read it. The ruling explains how just because a place is publicly accessible. Does not mean it is a public forum. It had to do with a 1st amendment issue on federal property. Not inside the building. But protesters outside the building. Learn about public and non public forums. With rare exceptions every building you enter is going to be a non public forum. Same with the property it's on. So is someone who represents the building tells you to stop filming or to leave that area. The smart thing to do is follow it. Check on it. And if they are wrong go back. When you are talking about federal areas. They usually have a law covering it. Which has jail time and or fines associated with it. Poster 7 lists it in the poster. And I think if you look. The notice you filmed does also. Military bases have one also. And under the right circumstances it can apply to photos, videos, drawings or notes even if you are off base in a public area. In what is known as a public forum. The ACLU defended him. It is what caused the famous DHS memo. The case was dismissed with prejudice. He can't refile against DHS. The ACLU settled with DHS. It only applies to federal court houses. It only applies to the DHS and its staff. And it only applies to the specific law they used to arrest the guy. If they find another law, a new law or its amended or if the situation is different. They can again arrest someone filming a federal courthouse on a sidewalk or park. Or any public forum. The break you have now. Is cops are not lawyers or constitutional experts. So they don't really know this. It's like when a murder happens in mayberry. They usually need the state or feds to help. They now have fusion centers. And as you see the threat of sovereign auditors rise and waste time and money. You will eventually start to see them focus on the problem. So just be careful.

Even though the Courthouse has posted the GSA _Rules and Regulations for Federal Buildings (Nov 2005),_which state that public recording is permitted within Federal facilities, at least within corridors etc; there is still a caveat in place in that most (if not all) Federal Courts, which includes the Supreme, District, and Appellate Courts do not permit recording by the public within the Courts, as for _Rule 22,_ this *appears* to be a rule that is specific to the State Supreme Court of Georgia so it would not apply to any of the Federal Courts. Even then, _Rule 22_ seems to only address recording within a Court hearing and not within the Courthouse itself.
A good question to ask security would be as to which local Court regulations forbid public recording within the entrances, foyers, and corridors of the Federal Courthouse, as per;

@@civilunrestnews1349 Even though it _appears_ that all of the Federal District and Appellate Courts forbid recording within _most_ of their corridors and foyers (or so it appears), it would still be interesting to ask these frontline guards which orders apply to their specific Court, and most importantly, as with this particular Court, why they were not posted for public viewing. From a journalists perspective, if you can apply enough pressure where they are rightfully compelled to properly post these rules then you would have provided a great public service, which in my view, is something that this community rarely seems to do.
From an activists perspective, if certain individual Courts apply rules that go beyond the guidelines of the _National Judicial Conference_ then you will have an opportunity to challenge these rules.

Since you are new I'll offer some advice.
Don't trust anyone that just chimes in. You will find tons of stupid people saying useless shit like wrong or show me the law. I had a comment on something you read in the video. So you can reference back to it.
That said you should really not trust that and look into it yourself. From me or anyone.
But if you look things up and can't properly understand it. You are putting yourself at risk. And you will be like every auditor that ends up in court trying to beg for funds. To defend their own stupidity.
If you read that section on the door and don't understand the press needs permission to film you didn't understand it.
It's a common mistake. The auditors find a sentence or fragment that says what they want and they ignore previous or following statements that put conditions on it.
Auditors don't like being called sovereign citizens. It's like the people that don't like being called stupid. You have to meet the world half way and stop acting that way.
When auditors cry to the police what is your reasonable articulate suspicion. They don't have to tell you. They can tell you they are answering a call. Or investigating a call or report. Your behavior can be suspicious and that us enough. They may have to justify it to a judge or internal affairs. It's the same stupid type shit when sovereigns cry about jurisdiction.
I would look into us v grace I think it is. If you read it. The ruling explains how just because a place is publicly accessible. Does not mean it is a public forum. It had to do with a 1st amendment issue on federal property. Not inside the building. But protesters outside the building. Learn about public and non public forums.
With rare exceptions every building you enter is going to be a non public forum. Same with the property it's on. So is someone who represents the building tells you to stop filming or to leave that area. The smart thing to do is follow it. Check on it. And if they are wrong go back.
When you are talking about federal areas. They usually have a law covering it. Which has jail time and or fines associated with it. Poster 7 lists it in the poster. And I think if you look. The notice you filmed does also. Military bases have one also. And under the right circumstances it can apply to photos, videos, drawings or notes even if you are off base in a public area.

It I think links to the cases file. This case talks about a person who was arrested filming a federal courthouse from a sidewalk or park. In what is known as a public forum. The ACLU defended him. It is what caused the famous DHS memo.
The case was dismissed with prejudice. He can't refile against DHS. The ACLU settled with DHS.
It only applies to federal court houses. It only applies to the DHS and its staff. And it only applies to the specific law they used to arrest the guy.
If they find another law, a new law or its amended or if the situation is different. They can again arrest someone filming a federal courthouse on a sidewalk or park. Or any public forum.
The break you have now. Is cops are not lawyers or constitutional experts. So they don't really know this. It's like when a murder happens in mayberry. They usually need the state or feds to help.
They now have fusion centers. And as you see the threat of sovereign auditors rise and waste time and money. You will eventually start to see them focus on the problem. So just be careful.
I'm walking up to you, putting my face in your camera to tell you not to record me? Bet you that security guard will continue to confront people on the sidewalk because most of the time he gets away with it. Maybe, just maybe someone in authority over his will see this audit and tell him to knock it off. That is unless they just do hi-fives and laugh.
