      @@UncleTonysGarage What is the connection between us repairing our machinery, and a regulating agency? Putting the regulation into Congress, and the courts will not serve the little guy. It will only allow the big guys to stall, and manipulate the system. The SOCTUS opinion was in support of big business, not the little guy.

      The decision was for neither the little guy or the mega corporation. The decision was to return balance to the system...what we the people do with that going forward remains to be seen.
      Now, apply logic to your assertment.
      Chevron has been in place for 40 years. During that time we've seen unprecedented growth in corporate size, power and of course debt.
      Now, if you remove Chevron from the equation, does it not stand to reason that a reversal of that trend is more likely than not?

      Well us older guys have known about what it means to be a has-been drip under pressure for ages. Now for the younger guys and those in the back playing diddly winks, the pandemic response should be an eye opener about the credibility of ex-spurts. They are all motivated to back the narrative of their bosses, the sources of their paychecks. Whoever that may be. It's their job at stake. It's a tiny percent willing to go broke and be shunned simply for the sake of being neutral. And those guys are always labelled quacks by the opposing side.
      But that's why it's important to be able to let opposing experts present opinions in court. Otherwise it's just authoritarianism. "You have to do this because I say so, and I know what's best for you, you dumbo!"
      Talk about stealing our democracy...

    Every time Congress is in session and every time State Legislatures are in session they pass new laws, but hardly ever rescind old ones. It has become over burdensome to say the least. They say ignorance of the law is no excuse, but how is someone to know 100,000 laws? Are we all to become lawyers just to exist? One top of that, we have to put up with agencies adopting new rules every year. Unelected bureaucrats should NOT have this power over our lives!!

      This is so pervasive there are even still sundown laws on the books in a lot of places, that would become active again as soon as a potential supreme court ruling comes out overturning the laws that nullified them. It's not even malicious as much as negligent in many places, politicians hate to clean up after themselves, and even moreso when it's their predecessors' deeds most people have forgotten about.

      @@williebrother9518 You can easily read the Bible through, its not that hard. I used to read a couple books (history, novels, Lord of the Rings etc) per week... if you like to read, it's quick.
      Also, Jesus Christ fulfilled the law in our place... there isn't 637 Laws to maintain perfectly any more. We are saved by grace and God only looks at our salvation, not our works. Yes, we will be judged and disciplined for our bad deeds, but it's actually extremely simple going by the Bible; Do what is right, don't do what is wrong, and go the extra mile for people like you would HOPE they would for you.
      Being able to understand AND find all the literal HUNDREDS OF THOUSANDS OF LAWS in the United States and all it's jurisdictions is impossible.

    What is bizarre to me is that in the ten or so years DEF and problematic diesel emissions have been in place costing big trucking companies billions nobody has ever put their foot down and said there has to be a better way. BUT the government vehicles don’t have DEF and emissions. FOLLOW THE MONEY

      I believe, based on my being a car guy and a mechanic, who works at a major parts store, that DEF AND/OR excessive emission preventing destroys a wonderfully working engine. Like how EGR clogs up an engines intake ports.

      Agreed, but you and I both know they have become way too big, and powerful. They aren't just going to give up power. I'm in CA, don't hate, but our governor Gavin signed a deal with Stellantis, that no matter what happens in the 24 election cycle, and Supreme court decision, they still commit to an electric future. So it's hard for me to admit, but the company I have loved for 40+ years is dead. Chrysler, Dodge, Jeep, and yes Ram are dead. It makes me sick I crashed my early vin TRX. But they are essentially in the middle of demise now. Stellantis is now a European company, and they have long hated our loud thirsty V8's that we all love, because THIS IS FREAKING AMERICA!!

    Louis began his fight against Apple as he was repairing so many of them that were rejected by Apple's own repair shops who were telling customers they needed a new board at $1500 for a device that costs $2000 when the only thing wrong is a $0.35 capacitor. The "Apple way" is to just replace something because there's a new one out! Then Apple started using tactics to make it impossible to repair their boards. So he started the Right to Repair cause!
    But this spans into something every one of us own, our cars. Even in my generation 2 escape (2008-2012) I have to own an $8000 scan tool with a $2000 annual license to use that scanner in order to fix my own truck in many ways. For instance, if my seat gets tore up and I get one in near brand new shape from a junkyard, I have to take it to a dealership for a couple hundred bucks to have them connect the scanner and tell it to simply re-calibrate the seat sensors that run the (gov't mandated) 2 stage airbag systems, or pay $10,000 and $2000 more every year to just put in a new seat.
    Today's cars newer than that are RIDICULOUS with the amount of things you need a scanner to resolve, why can that not be a part of the user interface on these stupid screen filled cars????????
    Wanna change your car battery on these cars that shut off and restart at red lights....take it to the dealer and have them do it or spend $10,000 to do it yourself because now the battery has to be calibrated to the system!
    This government overreach is getting really ridiculous. I don't have kids, I don't need rear set kid lookout protection. I actually know how to back up a vehicle using my windows and mirrors rather precisely...I don't need mandated back up cameras. I won't be drunk driving, I don't need mandated drunk sensors (it's coming in 2026 as a mandate...or maybe even next year). I don't need LED headlights, I don't need a stupid screen covering my dashboard, I don't need tire sensors, I don't need built in WIFI. I don't need a LOT of the junk they are requiring us to spend money on when we want or NEED to buy a car.
    I will continue to buy G2 Escapes until I can no longer find them in good shape and I will repair them until the government pulls something stronger than the last thing they did where they gave you good money to turn in your about 10 year old vehicle and then the gov't bricks the engines. The WILL be doing that again when the new drunk sensors come out I promise, and it will be by force this time. They may not come take your car but they'll make you pay a lot for plates and such, and force the aftermarkets to stop making parts available....they WILL do it. When that happens, it's time to overthrow our insubordinate government.
    I could say more but rant over, nobody reads this far anyways. Be careful with your old vehicles everyone, you need to keep it as long as you can!

      Well your part right. You do need a scan tool, but topdon, launch, and others can supply you with a very capable tool for less than 2k. I have an Autel , a Launch. Both less than $2k. I also have a $10k snap on that only gets used as a scope these days.

      What you're explaining is CORPORATE overreach, not government overreach. It's THE CAR COMPANY that's stopping you from repairing your vehicle, it's APPLE stopping you from repairing your computer. Because they want the profit for themselves. I mean you make a lot of good points otherwise, but I don't see the government connection in this case of right to repair.

    As a local matter, Chevron forced local commercial fishermen to have an on board government 'inspector' paid at 750.00 per day by the boat owner, regardless of class or size of vessel! And thats just a tiny example.

    Big Money interests run the actual show. All you have to do is ask yourself one question about almost anything the government does: will it hurt the Big Money interests? If the answer is "No" it will be allowed, if the answer is "Yes" it will be destroyed.

    Our Founding Fathers (despite what’s taught in schools today) were very intelligent men seeking to create a form of government that had equal rights for the wealthy and the poor. However the bureaucracy that has existed for the last 50 years is designed to perpetuate a gap in social and legal standing vehemently opposed to our Constitutional Republic. Americans way out of this is to elect candidates that demonstrate their understanding and preservation of our Constitutional even though IT would limit their power and length of time they can serve.
    Hence “Drain The Swamp.”

No def, no egr ,no evap , no dpf, no cat, no infotainment center, no touch screens, no can buss, no throttle by wire, no electric emergency brake, no bullshit, and no problems.. simple,affordable and reliable

It seems after 2005 or so the direction of automotive development went in a strange direction that consumers didn’t want. Just look at the $6000 broken taillight. Or the cars getting stolen through can bus injection through headlight bulb sockets that feed data straight to the engine computer. Or electric parking brakes that the computer can turn on wether it’s a safe place to stop or not.

    Executive branch executes, enforces law. Legislative branch writes the laws. Judicial branch decides questions about the law.
    Too much legal bribery on every level these days to be any sort of checks and balances. They simply pay everyone involved off.

    Excellent talk, good job of boiling it down to basics. Glad you put it out there in plain language, that most anyone can understand. It really is a momentous decision, with far reaching implications. Bottom line is unelected bureaucrats, can no longer run amuck with impunity. It goes far beyond our sphere of activity. Such as the insane regulation of mere mud puddles being classified as navigable waters. It means that this crazy push to electrify our vehicles, will have to make economic sense. Rather than trying to force technology to happen. Long live the hemi, they just got a legislative reprieve!

    And my 2nd comment: you touched on diesels Tony. Heres the the thing nobody ever points out about diesel emmisions: less efficient engines use more fuel!!!! I know for a fact that the original Dodge Cummins equipped 4x4! trucks would get over 20mpg city. And close to 25hwy empty, unloaded. And that is a lifted truck with 3.73 gears and 35" tires no less! Although the engine was completely stock, and untampered. I know this because I've owned them and studied the mileage myself! I currently own an '06 common-rail injected Cummins truck (only emissions being a catalytic converter). Truck is bone stock with manual transmission. The best empty, unloaded mileage I have ever gotten city is 17mpg. I have never gotton over 21hwy empty, unloaded (all figured long-hand math on paper). Now, the '06 will out-pull the old mechanically injected 6bt hands down. But, at what cost? Pulling 10k lbs on mixed Arizona grades? The common-rail gets 10mpg or less. The old 6bt might take a little longer to get there. But, it would still get 15mpg. And, at normal operating temps. I constantly have to stress over temps in the common-rail. I see people throwing big mileage numbers out there all the time. "My truck gets 28mpg city. I get over 15mpg towing. Bla-bla-bla". I'm calling bull-shit based on my experience in stock, factory tuned trucks. My point is: using more fuel is never better for the environment. Never. Which brings us to your video!: I own a machine-shop, and have made parts for a company called Bullet Proof Diesel. It's owners have gotten quite rich making parts that will survive on these stupidly over emmissions equipment laden late model diesel trucks. Why do I mention this? Because: the EPA has taken engines that should, and used to!, last 500k miles, and made it so you are working miracles to get 200k. How is this environmently friendly? Think about it! The resources wasted to manufacture that many more parts! I mean seriously, think about it. This goes far beyond the fuel pump. The mining, the raw materials, the power (Electricity! Do people have any idea how much electricity a steel, iron, or aluminum mill uses? More than you can fathom) even the recycling of raw materials is intensly power hungry. All in the name of engines lasting less than half as long! That is the real scope of what is happening to the environment. And it never gets mentioned.

    We should NOT have agencies telling us how to heat our homes, lightbulbs to use how to power our cars or mow our lawns or fix our equipment ( farm, construction ect) !! Farmers have been fighting to get info to fix their tractors and other equipment!! The factory’s don’t want to release the software and codes and tools!!

    The really bad part of chevron deference is when there are criminal penalties associated with a particular agency’s interpretation. There are people sitting in prison based on inconsistent interpretation of laws by the ATF, for instance.

    My understanding of the 1984 Chevron case, is that it allowed government agencies to prevail if there was a "gray area". This video helps explain how that happens. Good job!

      Not only that it gave specific guidance on how to review these cases and when a constitutional challenge could be applied. The kicker is it was unanimous when ruled on in 1984.

    Buy a million dollar combine it breaks down during harvest because of a computer issue and you can't diagnose the problem! Right to repair has been a ongoing issue

      Maintain your old equipment stop buying things that you cannot afford and pay off in a lifetime a million dollars is a lot for a combine

      The buyer knew the repair scenario before they purchased the equipment. Farmers and business owners don't want to make non-trivial repairs to warrantied equipment. They want timely service and would like a mobile mechanic to come to the equipment rather than the "owner" pay to haul the equipment to a dealer. But the purchaser knew the restrictions when they purchased the equipment.
      In some cases, a handheld scanner and another device could reflash the firmware updates. In other cases it's more complicated. When a novice repairs a sophisticated system, they can make mistakes that a dealer mechanic can clean-up - but probably not under warranty.
      A farmer can negate some of this by keeping some older equipment when the state-of-the-art equipment is broken.

This is a complicated subject and most people will not have a clue how all of this really affects them, and it probably went over most peoples heads.     Chevron difference touched Soooooo many things not just cars. It created issues in the second amendment community/industry the car community/industry the FISHING community/Industry and more things i don’t even know. But I really hope this dismantling put our country back in the right direction. This should definitely show the people how the government can twist and convolute the constitution to control the people.

    I’ve been following 2nd amendment cases for years and I am very familiar with Chevron Deference. You are right it is the most unconstitutional thing ever, the courts interpret the law but Chevron Deference made it so the agencies interpreted the law and in some cases changed definitions, the pistol brace ban and bump stock bans are examples of this. Now the courts get to interpret whether the agencies over stepped their bounds, and Congress has to pass legislation that is clear, and they have to be accountable to the people.

      In a perfect world what Tony described would be how it works. Unfortunately we have too many judges that want to make policy and laws from the bench - and this allows that to be much easier to do. I predict this ruling will have some good outcomes - but also some really bad ones - largely based on the political leaning of the judge. Notice how I don't pick a direction because we have judges that lean hard either way. The good ones are effectively a-political but those are getting harder to find based on how appointments are handled. Some of the judges appointed under Trump and Biden shouldn't be ruling on traffic tickets let alone Federal cases.

    I suggested long ago that those alphabet agencies had no constitutional authority to make rules that had not been voted on by congress. Our system was designed for congress to make laws not the EPA or the DEA, and certainly not the ATF.
    Those agencies should be like we the people. Want a law passed, submit it to your congressperson?

    Tony I agree, I think it's very good. Someone needs to put our government into check. hopefully when they pass the right to repair act they also put a price cap on parts this way if you go fix your TV it doesn't cost more for one part than it does for the whole TV just an example

    I’m left of center, but not allowing expert testimony harms us ALL. It works both ways: let’s say a law is passed that allows dumping of toxic chemicals into a lake.     Now, people can bring up emissions qualifications with the EPA on their classic vehicle. The EPA has always been against aftermarket fuel and spark control systems vs the stock configuration. It has always been strange to see the EPA pass a carburetor on emissions, but never an aftermarket fuel injection system with catalytic converters. If you beat the emission standard for the model year, you should be able to keep it on the vehicle, I say. This is mostly directed at emission controlled states like california.

    What this ruling does is it removed the obligation of judges to give the government agency preference when a regulation is contested in court. This is suppose to reign in the regulatory powers of the agencies putting the rule/law making back to Congress. So if Congress hasn't passed a law pertaining to an issue then the agency can't make a regulation on the issue, they will need to have Congress make a rule/law to address the issue. In a nut shell it removes a lot of rule making power from the Executive Branch and gives it back to Congress, as it should have been. Only problem with this is that Congress is FUBAR so ya it's going to be an endless SNAFU.
