      That was always the legitimate discussion. But again, Novak hasn’t made the reason for inconsistency, just that there is inconsistencies. If you aren’t clearly about the inconsistencies then they are just hearsay and no change happens when you are not specific

      Agree, I also think Simona's case took a lot longer because for so long she couldn't provide the source of the elevated Roxadustat in her system so she wasn't able to justify it being there. It eventually turned out to be a rogue Collagen supplement.. In Sinners case the source of the substance was easily traceable to the physios spray. It all depends now on whether fans believe the version of events provided but he has ultimately been exonerated.

    I love Jannik: but ito transparency and process, they should've: (1) made it public (2) given Jannik a 3-6 month suspension to investigate (3) drop suspension if cleared, or give longer suspension if found guilty.
    Everybody knows that if it was Djokovic, they, together with the mainstream media, politicians, and oligarchs, would have thrown him to the wolves 🤔🤨

      as Jannik explained, the reason why he received only a short suspension (3-5 days) is because he and his team immediately provided credible evidence about the transmission of the substance from the spray to his body. No need for long suspension.

      Battaglino also an Italian banned for 4 years in 2023 for the same product in his system in tiny amounts. He was playing a tournament in Morocco and his plea was also about a physio - that the the tournament physio had contaminated him. But he has no money and the physio doesn't want to implicate himself for no reward so does not testify.

    What will happen re: counting Sinner (and Djokovic's) week at #1? A metric ATP promotes quite a bit. Because if Sinner's 400 points from Indian wells retroactively subtracted, which would make sense, then Djokovic would've been #1 for additional week (last week)

    Sensible commentary from Novak Djokovic -- nothing to disagree with there. Of course players are troubled by lack of consistency of in application of penalties. Sinner benefitted this time, but next time maybe not. I do not think Sinner is to blame for the inconsistency of treatment. I do not fault him, I don't think he was cheating, nor do I think Simona Halep was cheating.

      Well, I guess it's the responsibility of the player to have a professional team around him/her. If a medical team member makes a big mistake, it should therefore also impact on Sinner, the same way it impacts on other players. Indeed sinner should have been banned for a few months until the issue was cleared up with a final verdict.

      ​​@@richyalexander9206 This idea of Sinner being responsible for his team is nice and all, but you can't control everything a person does so it seems strange for Sinner to have to suffer because of something someone else did.
      And a months long provisional ban wouldn't make much sense either as the amount found was too low to enhance his performance and it's not like he tested positive in subsequent tests so he couldn't have gained an advantage in any way (and gaining an advantage is the reason they provisionally ban players).

It should be noted that Marco Bortolotti faced a similar controversy at the tail end of 2023. Despite being a lower-ranked player (376) his case was resolved within three months, with no suspension. The player's case wasn't made public until a conclusion was reached, just like Sinner's.

    The inconsistencies between cases is what isn't fair. I understand why the players feel there's special treatment in Sinner's case.

      It would be helpful if Sport Resolution commented tbh and explained the process and why it happened this way in this case. It's the lack of clear communication that doesn't help. The legalities are very complicated and there is also a lot of misinformation around

      @@joannemoore3976I think all the information is there… It would be more helpful if someone can actually point out a specific problems or inconsistency… All i hear is very lazy whataboutism by pointing to completely different cases and “oh Sinner is Nr 1 so ofcourse they gave him the benefit of the doubt.”This has now often degraded to the light version: Well he has the best most expensive lawyers noone else can buy and that is why he came out well. How can they reasonably respond to this other then that there was no pref treatment, rules, protocols and independent investigation were conducted as always?

    Everyone talking about Halep when she admitted ingesting something given to her without knowing what was inside. It’s not the same case as accidental exposure. Also, Sinner’s team appealed immediately and won.

      No only the original notification of a positive test. They successfully appealed the provisional suspension. But the final 'verdict' if you like was only given on Monday after the Tribunal hearing on 15th August.

      @@MarcoK6969 I think the confusion is between the original notification of a positive test (back in April) and the outcome of the tribunal in August. What Novak is referring to is that Sports Resolutions upheld the appeal against provision suspension (because the evidence suggested that a ban would be unlikely). But they still had to wait then for the actual hearing which was in August.

    When a suspension was in place, how was Sinner allowed to play in those 5 months just based on his submissions which was prima facie found plausible ?? That is ridiculous and unprecedented.
    Clear favouritism is there without a shade of doubt.

    The Sinner precedent should be viewed as a positive development for all players going forward. It was a blessing in disguise. Perhaps others can now be assisted in the process rather than stumbling through it and ending up penalized unjustly.

    Sorry Cam, i think Djoko doesnt know the whole timeline which makes his statement inaccurate.
    But i do agree that players should be assisted and hearings expedited.
    There are also rules about when to announce the news and it’s AFTER the tribunal has made a ruling, not before.
    (This actually protects ALL players from unnecessary media attention and not just Sinner)
    Halep was initially ruled as guilty bec she couldnt explain where it came from plus the levels were high enough to have been performance-enhancing.
    Halep could have benefitted from Player assistance too.

If you accidentally kill someone or you commit murder, would you expect rhe same judgement for those two scenarios in a court of law? Of course not. They judge intentionality and whether the player had been negligent and also how far they have been diligent in preventing contamination

    Well, the most important thing is that Sinner was cleared to play after a thorough investigation was done. Now, even if the process was not consistent for all the players - while that is a genuine issue no doubt but certainly not that Sinner should be paying for or held responsible!

    It's not about "zero tolerance" - zero tolerance by default leads to witch hunt.
    It is about the double standards.
    It is not hard to imagine that lower ranked players, but some high ranked players as well (Djokovic for sure), would be harshly treated both by the AD agency and Western MSM.

    Sinner employed the very best and most expensive lawyers for this case. That reduced the possibility of him being unfairly treated(Unlike what happened to others). I really do think he is innocent and that the substance didn't affect him due to the low concentration. But you need people that can prove it for you, and Sinner afforded the people he needed.     many keep forgetting that Jannik and his team collaborated with the authorities from day 0 and provided credible evidence about the transmission of the steroid from the spray to his body. In other circumstances, i.e. with other players, this might have not been the case. This, to me, explains the treatment that Jannik received which, incidentally, is identical to the one received by Bortolotti, not a superstar like Sinner. Then, of course, mistakes and unwarranted bans might have been inflicted in the past.

    Why then not speak about Bortolotti case, it was the same and ended in the same way. The question with cross contamination is that if you can explain or not how you were in contact with the substance. In case of sinner and Bortolotti they were and the lab test supporting that.

Gabriel da Silvia Santos a brazilian swimmer was cleared as well. There is for example a study about cross contamination with clostebol "Incidental clostebol contamination in atheles after...". This is a study not an opinion.

    Not sure why people are still surprised that money affords preferential treatment - it's privilege, and it's life.
    In the real (non-tennis) world in legal proceedings if you have the money you can afford to expedite the process and hire top notch legal presentation.
    Novak would do exactly the same and then miraculously forget about fair treatment to all players.

    Did the PTPA also adress the rule loophole where Nardi beat Novak by “stopping to play”?Clearly the rules were very unfair and unclear. The Umpire did not understand it at all and Nardi had to be educated by the wise Djokovic at the net. When Kyrgios stopped playing he never got to win. These inconsistencies are ruining the sport.

      It's not preferential treatment. Any player has 5 days to appeal against the provisional suspension and that is what they did and were successful. In other cases they didn't do this in time OR the appeal was not accepted. THATS what made the difference for Jannik. Now, maybe the Tribunal itself was held quite quickly whereas other players have waited longer but, again, that was probably because all of the evidence was available.

    Novak can speak about this all he wants but to be honest, the ITIA isn’t changing any rules for anyone unless an argument about what was unfair in the administration of the rules between Sinner’s case and others case. As far as everyone calling out unfairness, they aren’t helping solve the issue ITIA needs to address other than feelings!
