I just thought I would come back to this video to thank you!! I got 74% in my EU law exam I took in May and if it wasn’t for your teaching I don’t think I would’ve got the grade I did honestly thank you!!!
OMG I GOT AN EU LAW EXAM TOMOZ 23hrs onli ne one, i dont know any contnet stuipdly revising the night before, guideeee meeeee any advice or topics that come up often
Marcus this has just saved my Law Degree! Thank you so much! I have been off uni ill and missed so much and was panicking about cramming for my Law exam tomorrow and you have just explained this all so clearly and helped me to be ready for EU Law exam on prelim rulings tomorrow so thank you! However you do need to address the fact that you refer to the CJEU for preliminary rulings as a whole and the CJEU is made up of 2 courts and it is only the ECJ that deals with preliminary rulings and the other court of the CJEU is a general court. This could confuse those watching your videos.
Hi Marcus, just want to say videos are great and really helping me through Irish FE-1 solicitor exams. Thank you for taking out the time to do all of this!
Hey Marcus such a straight forward topic, you broke it down one time! Can you also look at doing a session on Main Role and Functions of EU Institutions (Commission, Council of Ministers and EU Parliament) and the question of democracy in the European Union. Only you know how to break this stuff down into a small topic. Thanks :)
Thank you again I actually understand the process now! But please could you do a video of how leaving the European Union has affected our legislation on the topics you have covered!
Hello. Thank you for your videos! I have read a few blogs suggesting that preliminary ruling procedure should be individualized following the Van Gend en Loos precedent as this would further the EU objectives. Any idea what does that mean in practice? How would it be different from the principle of direct effect?
Hi Marcus! I love your videos they've been really helpful with my exams. Just a quick question. *Can an individual bring a case against the Government of a member state through this procedure, or just against another individual?* Thanks a lot!
This video is brilliant! But in regards to how the court of justice has crafted the preliminary rulings procedure to bring about the constitutionalisation of the community legal order and to empower the individual - how would you critically discuss it ?
Marcus - a popular exam question for me is outlining the four situations that a national court need not, or should not make a preliminary reference. Finding this one difficult. There is obviously - where the reference is not necessary to decide the case (no question of EU law, acte clair and acte eclaire but what is the fourth??
Hi there Marcus, Thank you for your videos, they are brilliant and interesting, keep them coming. Could you please do a video on: The main role and functions of EU Institutions (Commission, Council of Ministers and EU Parliament) and the question of democracy (democratic deficit) in the European Union. Thank you in advance. Regards, Mighty
+The Man Foglia says that there has to be a genuine dispute between the parties in order to ask a question. Factortame allows a national court to grant interim relief (eg injunctions).
Your videos are very helpful :) is there any chance you could do a video on freedom to provide and receive services and freedom of establishment please?
Can you explain what the member states "common constitutional traditions are"? I'm in my first year of law school and having such a hard time understanding what it is and where to find information about it.
Well it can vary a little bit from country to country but it is generally the essential principles that underpin a constitution in any given member state. As these tend to be based on Western values they generally cover things like multiculturalism, human dignity, rights of the accused etc. There is an interesting Austrian example that refers to not putting up barriers to international trade.
This blogpost covers a lot of the issues and refers to the Austrian case of Sayn-Wittgenstein within it. europeanlawblog.eu/2012/10/25/uniformity-or-deference-to-national-constitutional-traditions-in-the-protection-of-fundamental-rights-case-c-39911-melloni-opinion-ag-bot/

Hey Marcus, could a magistrates court be a court or would they be considered too low down?
This video is brilliant! But in regards to how the court of justice has crafted the preliminary rulings procedure to bring about the constitutionalisation of the community legal order and to empower the individual - how would you critically discuss it ?
Thanks for this video, can you please make a brief video on the acte Clair doctrine.

+Allan Camara IP RIGHTS HAVE A QUALIFIED PRIORITY I.E. THEY SHOULD NOT ACT AS A DELIBERATE BARRIER TO TRADE.
Hi there Marcus,
Thank you for your videos, they are brilliant and interesting, keep them coming.

+marcuscleaver Thank you and double thanks for the quick reply, much appreciated!
Hi, was wondering what the case of 'Foglia v Novello' establishes in respect of Article 267?
Also Factortame?
+The Man Foglia says that there has to be a genuine dispute between the parties in order to ask a question. Factortame allows a national court to grant interim relief (eg injunctions).
Big help, Thanks... Can you explain Foto-Frost in regards to references on validity?
Your videos are very helpful :) is there any chance you could do a video on freedom to provide and receive services and freedom of establishment please?
I do hope to at some point!
I thought the requirements set out in Broekmulen derived from Dorsch Consult Ingenieurgesellschaft????
agreed
Me too!
But Broekmeulen was decided in 1980?? Dorsch Consult was not decided until 1996?
Hi Marcus, any chance you could do an Art 157 TFEU video?
+Lu Lu Equal pay? Yeah I can definitely have a look at that soon :)

Thank you for your anwer. Do you know any good source of information about the subject and the austrian example?
