The Launch of Orebella by Bella Hadid

  • Orabella was launched Bella Hadid as her new scent brand and seemingly the anticipation has been quite high. From sources like Teen Vogue, Cosmopolitan and WWD all speculating on exactly what products will be available at launch, it has had such an interesting launch in regards to it's hype-building. I think in the future they may see the ordinary celebrity-line problems such as authenticity and price comparison if/when the hype dies down as well as potentially a backlash from using a similar name to Orebella, a skincare company in The Philippines - though that seems far off for now. In the end, the brand has had a fascinatingly successful launch strategy and I cant wait to see how it is received on launch.

    IP student here (but please get confirmation from a trade mark expert):
    While Bella's Orebella and the Filipino brand Orabella are not identical, they are phonetically similar and could potentially lead to confusion among consumers (especially if the brands operate in overlapping markets).
    BH's Orebella being stylised with a specific font and design is an important factor as trade marks are generally registered for the words themselves, but also the specific visual representation. As such, it is unlikely to have a conflict for similar trade mark "style".
    Now, it is common for companies to alter the brand name in other countries to avoid conflict, but also to comply with cultural or legal considerations. For example: TJ Maxx (US) vs TK Maxx (UK); (I am not 100% but) the skincare brand Clinique had/has a different name in Germany to comply with the local regulations and marketing strategies specific to the German Market.
    The alternative would be both brands engaging in negotiations to reach a mutually beneficial agreement to coexist.
    Hope this helps :)

      Thats a brilliant breakdown thank you so much. To me it was the similarity in phonetics, spelling and even sector that raised eyebrows. But youre right they could just market under a different name in the Philippines if they want, I didnt really think of that

    • @skatingmermaid
      @skatingmermaid Місяць тому +9

      Clinique was named Linique (groundbreaking 😂) in Germany, because the phonetic similar word “Klinik” means hospital or medical centre in German and apparently they didn’t want to prompt the association to medicine or illness with the german customers. I don’t know when they changed it, but today it’s Clinique in Germany, too.

    Completely agree especially on the last part. With the global boycotts going on, people feel the need to find brands that not only dissociates with Israel, but also with a founder that is vocal with their support with Palestine. Huda Beauty is one of those brands too. It also helps Bella's launch because the authenticity of her support goes beyond what happened in recent months. Since the rise of her career, she was always in protests and movements while simultaneously working with charity. Intentional or not, it will garner support from the public.

    I was waiting for this, like when you did the Khy ep, I love Bella shes my favourite model, but also the thing about this brand is I feel BH applies her practice kindness persona very well in the public eye and attaches it well to the launch of the brand, it's almost like she's so kind and nice that you can't help and support her fragrance line even though it possibly might not end up being a classic or staple in the long run or in one's daily frangrance rotation, but one just feels inclined to take interest and support her esp. because of who she is compared to other celeb cash grab projects

    In relation to the trademark aspect since you focused on it heavily, since Bella trademarked it in the US and it is mainly going to be sold in the US there's no infringement of any kind to a brand that has a similar name. Also, though both brands are in cosmetics, the specific type of cosmetics is also important to note, Bella's is in perfumery (for now) and the other is in skin. Branding and packaging for Bella's mentions Bella's name and even has her signature so it already separates itself and places an association with Bella Hadid whilst other brands can't do that. So at an international level too I doubt brands with the same name can contest but since it is a trademark she would have to register it in every country she plans on selling it in. So with these factors consumers would be able to differentiate the two Orebellas if they were placed side by side in a store which I doubt would happen. This is simply for more insight on the general intellectual property law in terms of trademark infringement.

    • @underskinYT
      @underskinYT  Місяць тому +1

      Great thank you, my concerns were because it was an international trademark and they were both in the same sector, but yeah I dont think many people would be confusing the two brands (as per the venn diagram)

    You forgot to mention how many Israel supporters are boycotting her, tbh she is harmed by this more than being supported as a brand, especially if she is thinking to get bigger. Even Dior dropped her and chose an Israeli supermodel instead of her, I never had an interest in any celebrity's brand because they always over charge for useless products that you can find dupes for in the market, they always give money grab feeling, while Bella's brand feels authentic and has same esthetic that she had for years now, also oil based perfume etc are mostly found in Middle Eastern brands like Abd el Samad Alqurashi which are so big there but not known in the west so she has a big market in the west becausee no one can have access to such perfumes that lasts all day long but also are unique and so different from the western perfumes, only who uses them knows how different scents are etc. the visuals, the name and everything she posted in her brands account shows that she is not just an it girl on TikToK but proves by her brand how everything she does is what would accept from a REAL It girl that did not just had her 10 mins of fame and turned out to be something completely different.

    • @VioletFem
      @VioletFem Місяць тому

      That is not true. These are blatant lies. Bella ended her relationship with Dior in 2022 long before the current conflict that’s happening right now. Her comments about the conflict were neutral. They were a call to end the suffering in Gaza and to protect its citizens.
      Also, there are a lot of countries outside of Israel and she has plenty of support internationally. She will be fine.

      Dior did not drop her and replaced her with an Israeli model. She left Dior in 2021. Also she did an LV sunglasses ad in 2022 and 2023 so if LVHM dropped her over Palestine I don't think she would have worked with them again.

    I was SO DEEPLY dissapointed in how she handled CyBella that I literally unfollowed everything she does. I was in that discord, and she had a literal groundbreaking, industry disrupting, GORGEOUS sci-fi idea that would've revolutionized all of fashion... and just gave up on it like immediately, because it was too much work and required wayyy too much tech knowledge that she wasn't willing to learn... So disheartening!! There is still real life artwork just sitting in ownership somewhere in a deadfile because of her. I so hope she doesn't approach this the same way.

      Didn’t it shut down because the two founders of the startup which did her NFTs were suing each other ? Also the project was not very well received by her fans which might be a reason why they didn’t go forward with it.

      @@Dorothy202 It was a whole lot of factors, including the one's you mentioned, yes.. but at the heart of it, had she truly cared for and played a direct part in the development and handling of the project itself and not brushed it off on some dudes for some unfathomable reason, it would have actually done amazingly I think. She had a lot of what I would call, silent or situational fans, that were really excited for the project, who had come to her for CyBella specifically. I could write out a whole entire paper on it, tbh. 😅

      From a customer perspective, I think it really hurt that they were vague about the product pre-launch. Like, with Orebella it makes sense, we all known how cosmetics work, but with things like NFTs or Meta-stuff, its confusing because it's new. Had they been very clear about its aim and use I think it would have gone down smoother from critics (this is of course, if the founders didn't start suing each other)

    i watched the interview on vogue. it feels so weird… like bella’s heart isnt there. i understand it being like a fragrance brand thats like “nature” smelling.something off was the colloidal silver spray, why include the homeopathy audience, if they only have sympathy from ur lyme disease????

      Thats the risk of aligning a celebrity brand with a celebrity. You get some people who agree with what they stand for and some who dont. Its why its risky
