@@A.J.Collins I personally advise against that, and here's why: Part of the investigation will be how many shots you fired in self-defense. And this is done for several reasons... but one reason may be because a greedy attorney says you fired 100 times. So one of the ways the cops tell how many times you fired your gun is by counting how many unspent rounds are left in the gun. So: if you have a 15 round mag... and you have 10 rounds left in your mag after the self-defense shooting... then that means that you fired your gun 5 times in self-defense. So that will help to keep a greedy civil attorney from trying to say that you shot at the bad guy 15 times or whatever. I hope I articulated that correctly; and I may actually make a video on this. :)

My ex wife tried to shoot me this past year. She ended up with a life threatening wound. I was immediately arrested for a number of gun charges. They were all dropped once I explained what took place. She was arrested on 7 felonies and has been jailed since. I was arrested and jailed, because I ask for a lawyer and I would take time to figure out what happened.
Its not always so black and white. For example, did you instigate or threaten someone with a gun. Or did the suspect cuss you out, so you then shoot him right away? Road rage shooting, etc.

I told the cops that... So they locked me in the back of a cop car for 6 hours in 106 degree weather. They then held me without medical attention and under 24 hour supervision for suicide even though I've never been suicidal for 2 weeks before dropping everything. It took over 30 officers and an entire swat team to arrest me. They shot my cat in self defense... I sit the guy twice in the chest, once through the heart, with hst jhp and the dude was on enough drugs to run away and drive himself to the hospital where he survived...

I can attest to the fact that the police are not your friends after defending myself from a violet attacker twice my size. The police still wanted to make me seem like the bad guy who attacked the person twice his size for no apparent reason. The police also lied and said the hollow tube I used to defend myself was a tire iron.
It's interesting you got that the very 1st part of the video explained very well why you were treated like that assuming you didn't just assault somebody with a weapon 1. You may not have been using reasonable force what was the other guy holding if he had nothing but his hands you didn't have right to bring a weapon that could kill someone you stuck him with a deadly weapon if hit in the head it would cause a blunt force trauma ending his life
it's pretty bad that defending yourself gets more aggravating than letting a criminal just blow your brains out and get away with it.. our justice system needs to be sat down, looked at and fixed.
I would say it's a worthwhile trade off. Regardless of the intentions of the opponent, you are still causing significant harm or death. The repercussions of which cause stress to not only yourself and the injured party, but also the families and friends of those involved. Defending ourselves and our loved ones is necessary sometimes and an inherent right of the citizen, but we all must be held accountable for our actions, regardless of intent or consequence.
I traded my clean record for defending my life last year may 22nd I’ll never forget luckily the judge noticed I was defending myself but even then they still opted to give me a misdemeanor reckless endangerment for a round that wasn’t even from my firearm it was from the guy shooting me I’m fortunate to be here and at least the judge gave me my guns and gun rights back and didn’t strip me of them our justice system must be fixed!

As a soldier we were issued with a post incident instruction card with 5 points 1. Explain: This person tried to kill me 2. Complaint: I am willing to make a complaint 3. Evidence: There is their weapon 4. Witness's: Those people saw the attack 5. SILENCE: Officer i will cooperate with your investigation, but first i need to speak with my legal representative. No 5 will allow you at a minimum 24hrs to decompress post incident.
1. Explain: Call 911 and say: “I was physically attacked and the attacker tried to kill me. I acted in self-defense. Please send the police and paramedics to this location at . . .” End the call and immediately turn off your phone. 2. Complaint: DO NOT tell the police that you’re willing to make a complaint. You can do that later, under the advice of your attorney. 3. Evidence: Let the police do their own investigation. DO NOT point out anything to them that you believe to be evidence. 4. Witnesses: Let the police do their own investigation. DO NOT point out anyone to them who you believe to be credible witnesses. 5. SILENCE: DO NOT tell the police that you will cooperate. You can do that later, if that’s what you and your attorney think you should do. 6. The only thing you should say to the police is, “I was attacked and I acted in self defense. I want to speak to my attorney.” It is crucial that you get on record with the responding officers that you acted in “self defense.” 7. “I want to speak to my attorney.” This statement should shutdown the questions coming from the police. If not, keep repeating it and/or demand to speak to a supervisor. 7.1. DO NOT invoke your constitutional right to remain silent, as this can, and most likely will, be brought up during your trial. 8. Expect to be arrested. Say nothing to nobody (except for name and DOB ) until you have spoken to your attorney. 9. DO NOT tell your story to fellow inmates. They are all snitches and even hearsay evidence will be used against you. KEEP YOUR MOUTH SHUT at all times about the incident until you have bonded out.

I teach self defense and am a retired LEO also. This video is excellent! One additional piece of advice I would offer is as soon as safe use your smartphone and quickly record a 360 degree video. Crime scenes get contaminated and altered especially when EMS arrives. Sadly improperly trained police sometimes screw up crime scenes. Get your on pics/video because it is your butt on the line! You might even capture witnesses or other suspects that leave the scene prior to LE arrival or capture witnesses LE fail to interview. You can literally capture a video in seconds that could save your butt. No one will look out for you as well as “you”! Just keep in mind if you get a woke police officer or prosecutor you will need all the defense you can gather.
That could mean also to have your phone recording during the incident, proving you had no choice but to use deadly force. Even the recording of voices can be the difference of a long jail and prison stay!!!!!
Agreed but also don't volunteer any recordings until your attorney has reviewed them. I wouldn't even volunteer at the scene that the recording existed to keep the device from being seized as evidence. It is naive to think that you don't have anything on your phone that could be used against you and that the cops would restrain from reviewing and recording anything but what you want them to see.

A court of law is real, youtube stories on shootings in gun forums mostly are not. The law is very real to those on the wrong end of it. Tell that crap line to a cop after killing someone and see if you don't end up in jail within the hour. 99.99% chance. Here it is straight form the Law of Homicide in case you're doubting - Some killings of one human being by another human being are authorized by law because of the peculiar circumstances of the killing. Suppose a person awakens in his own bedroom to discover a stranger present. The stranger is apparently armed with a deadly weapon and is offering to kill the homeowner in his bed. The homeowner reaches into his night stand, removes a pistol, and shoots the intruder dead. This is a homicide, because one human being has killed another human being, but it is a justifiable homicide because killings in self-defense when the killer "reasonably" fears for his life and has no "reasonable" alternative but to use deadly force are authorized by law. If the killer has no criminal intent, and the killing occurs under circumstances where killings of other human beings are either commanded or authorized by law, the killing is called a justifiable homicide. There it is folks - you best understand "reasonable" or you're up Mierda creek! It's all about "can you articulate" your reasons for acting and they must be reasonable to a jury, not in your own mind!
I am a firearms instructor and this was an excellent free video to all those who are thinking of becoming qualified to carry a firearm or have firearms in your homes to defend yourself and your families lives. It it highly imperative that you practice your shooting skills at a certified firearms range with instructors that are willing to help you to become better prepared for a situation such as to protect your home or property as well as a self defense shoot that you are involved in. A Certified Range does offer classes either as a group or individual training that will make you a proficient shooter at the range and will instill the confidence and the know how on what to do in case of a self defense shoot. Man, it's really hard to watch this, because in my coutry (Brasil) it's illegal to defend oneself or one's family in ANY situation. As a retired LEO myself, the first thing I tell people to do is if you are going to get a gun for personal defense, go through and read the self defense laws in your state and then when you get done reading them, read them again. One thing we were taught in academy and I will tell everyone else, if the responding officer asks what happened and you reply with "I shot and wanted to kill him" you have shown intent and that can be used against you. You say you shot to STOP the bad guy from doing what he was doing.
So do the law enforcement officers read laws and then read then again? Maybe law enforcement should be required to know the laws they are supposed to be upholding. After all, how can you enforce law if you aren’t required to know the laws?

Being an law enforcer doesn't give them the right to charge joe schmo with breaking laws that actually have no authority over him but they do. They aren't supposed to be allowed to fine and imprison us for breaking a law when we don't follow ordinances but they do. The whole reason they made that little law saying "ignorance of the law is no excuse" is because they know everybody is ignorant of the law unless they went to law school, learned how to read the laws, and look up definitions in blacks or Bouvier's law dictionary then tell the judge that maritime, and commerce law does not pertain to private citizens and get away with it. It's a lot more simple than you're trying to make it out to be. In the same way that you need to know what to do in the event of a car crash if you plan on driving, you need to know what to do in the event of a self defense shooting if you plan to carry. If you own a controlled tool, you need to know the laws for using it.
Killing in self-defense is still legally considered homicide or murder. It is simply an exception to murder laws, saying "yes, I killed someone, but I had a really good and reasonable reason for doing so." i.e., someone is trying to kill you or somebody else (depending on where you live).
He is so right about staying at the scene. however if an angry crowd assembles and it begins to appear they are friends of the one you shot maybe you should leave, call 911 and tell the person you are driving to the police station. Make it clear you are attempting to surrender.

@@dorianedwards8522 I'm a FF paramedic and we train with law enforcement for active shooter drills. Usually the scenario is there's a shooting, and the bad guy is still around when PD arrives. They use Simunition guns, basically fancy paintball you can fire from your service gun. The instructors decided to mix it up for one scenario and had an "off duty" officer present at the time of the shooting "neutralize" the threat prior to PD arrival. The bad guy was on the ground, handcuffed, with the _off duty officer's gun trained on him with one hand_ and his _badge raised in the other._ The arriving officers weren't told this prior to arrival, and promptly lit him up. *Moral of the story: if there's an active shooter event, you don't want to be holding a gun and **_not_** in a uniform when the cops arrive.*

Why would you say anything at all? Why would you make a statement as to your state of mind? That will be used against you! Don't answer any questions at all about the incident itself and definitely do not admit to any actions you took or what you were thinking about. Any statement about what you did or did not do or were thinking about or feeling at the time of the incident is evidence they will use against you. Just state that that other person tried to rob me or attack me and leave it at that
I think that is very situationally dependent. It's always a good idea of letting the cops be able to identify you immediately as the good guy too. And typically the dispatchers will ask the caller to describe themselves anyways.

Maybe I'm wrong but I suspect most folks have absolutely no interest in being involved with ever having to shoot another human,but some statement I have read by some folks make them sound abit eager. I was involved in a self defense shooting at my home. Best advice I could give is be respectful, don’t give specifics without an attorney consult, and remember if you do what was said in this video you will hopefully go home the same night. It was a traumatic experience for me and my family but the training saved our lives. Train with your fire arms and know your egress and strong points in your home and on your property

Training with a firearms instructor that provides an tactical training in an environment where you are enriched with the knowledge of how to conduct yourself is priceless. They actually have plenty of them around here in CA where I live, and I plan on doing it in the near future for me and my fiancé so she could protect herself if (God forbid) something were ever to happen when I am not home and able to protect her.

I agree with you. The main reason I have legal protection is not for criminal court, but for civil court and some greedy civil attorney wanting to sue.

I along with a few good friends had to investigate and hunt down evidence and previous victims to give to my lawyer on a platter after she informed me that they didn't think there was a strong enough case...because they hadn't done an investigation. The bastard would have gotten away with it again if we hadn't done their jobs for them, and even after he pled guilty they only gave him 18months, and of course he got out early. He had been raping girls since he was in high school but none of them came forward to press charges so he kept doing it ,and it progressed with time. I guess in a way Im glad that piece of shit picked the wrong woman when he went after me , because there was so way in hell I was going to let him get away with that shit, if it couldn't be done legally he would've been in a much worse situation.

I can confirm everything said in this video. I've been in a situation where I had to defend myself and my family with a side arm. I was also seriously injured; requiring medical treatment. I was on heavy medications. Here's what I can add: 1-If you're prescribed ANY type of opioids; you need to get a medical Doctor's note to give a statement for that statement to be legally admissable for any reason. 2-Take a class on safety/self defense that explains the laws in your area so as to be compliant with them. 3- Seek counseling from a Professional mental health provider. You may not think you need it at the time, but trust me when I say you do. Be safe and stay free!🇺🇸

Good advice. I do prefer the statement to the responding officer to be, “I was attacked. I was in fear for my life and I’d like to speak to my attorney. Please get me to the hospital for treatment.”

WE live in such a litigious society that you really can't prevent yourself from being in legal difficulties. You can sue for anything in this country, regardless of validity.
But the litigiousness of our society works both ways. If you find yourself on the defensive (and justified) side of a shooting incident and get arrested, you can sue back for wrongful imprisonment, malicious prosecution, etc. You can due the aggressors family in court for emotional trauma, for all the negative press you will receive, in case they try to sue you in civil court and lose resulting in countersuit, etc. because their relative forced you into that situation by their nefarious actions. Lawsuits can (and do) work both ways - the most unfortunate part is that it seems heavier credence is lent to the side that files suit first.

I half-expected this to all revolve around dodging corrupt people trying to turn you into a felon for defending yourself. Was pleasantly surprised to find that most of it made perfect sense from the perspective of both the victim and the justice system. Glad that, for the most part, the defender is still viewed favorably as long as they don’t muddle up the court’s perspective on what actually happened.
When I took my License to carry class there was a lawyer that came in from Texas law guns or something like that and essentially explained to us everything you explained about the repercussions of shooting in self defense. That man made me more trigger disciplined and in some ways afraid to ever have to use my gun than anything else ever has because I know now that if I ever have to do so I'll be subject to weeks or months of stress and legal problems that will both financially and mentally drain me. Some days it makes me almost regret buying guns and enjoying my 2nd amendment rights in the first place. Hopefully this system changes.

Although I find insurance of any kind to be a scam, I do recommend having self defense insurance. I disagree that "most cops" are 2A supporters, if they truly were, they wouldn't be enforcing ridiculous gun laws. You have to worry about a civil suit also. I hope I never have to use my insurance.
Years. Not months or weeks. Even once the police are done harassing you and the prosecutor is done trying to ruin your life for defending yourself, you will will then be victimized by the family of the person who first tried to victimize you when they sue you.
Dude, just buy gun owner insurance. Its cheap, like 20 bucks a month and you have a personal lawyer on call at all times should you need to defend yourself. They pay ALL your court costs and fees, provide an expert witness and a full team for court and even go on the offensive to prevent the criminal from suing you later in civil court. Its worth it for the financial peace of mind alone.
On not talking to the police, aside from identifying yourself and stating you were attacked, it should be remembered many a prosecutor is anti-gun and desirous of climbing the ladder to a better positions. Though they should be going after the truth, rather than convictions, they know each conviction is a run on the ladder.

@@peterv1318 By calling the police, you are also calling for EMT (paramedics). This is a STRONG indication that you were not into murder mode, but effectively into (percieved) self defense. That would eventually made a HUGE difference in front of a grandjury, or a judge. 'There are no definitive prooves, only chain of evidences'. That's the first link.

My thanks to this gentleman for looking out for all of us good guys just wanting to survive in a violent world. Sadly, the courts are full of corrupt professionals who only care about their own gains and not justice for all. I think the hardest part of the suggestions provided herein is getting two nights sleep. I would have to take a sedative if I had to use lethal force to defend myself and it wouldn't be from guilt but from the general anxiety of the incident.
I took a concealed carry class a long time ago and in the discussion about when it's appropriate to use deadly force the instructor gave the following advice. Take the phrase "So I pulled out my gun and shot him in the face", if what happened before makes this phrase sound reasonable to a jury you're in good shape. If it sounds excessive you're probably going to go to prison.

This is one reason I like living in small towns or communities where people can get to know one another and can get to know the local law enforcement. That can help in situations like these.

Perfect, only would add 1 thing. On your 911 call use/leave speaker on. Ideally your first call for help should not be disconnected/broken up. Just my opinion from my experience. God bless, stay preped
One thing we are taught as Paramedics is that if we are involved in an off-duty incident the downed assailant is not our patient. It is far easier to defend yourself for avoiding contaminating the scene by omitting aid than to defend yourself for tampering with evidence because you attempted to save your attacker. Opinions and protocols may vary. See attorney for details.
Always remember, that in a legal shooting, the attacker was trying to KILL YOU. While you are obligated to call for an ambulance, you DO NOT NEED to assist in keeping him alive. Doing so may expose you to criminal or civil action.; Let the EMTs do their jobs, and do not either assist or interfere.
Absolutely invaluable advice. The only other thing I would do, if possible, is take pictures of the scene from multiple perspectives before it is disturbed. I would then keep that fact to myself until speaking with an attorney.

Great info. In all the training sessions I’ve taken, I have been told never to report to a dispatcher or police that YOU’VE SHOT SOMEONE IN SELF DEFENSE. Instead, report that YOU’VE BEEN INVOLVED IN A SELF DEFENSE INCIDENT... you never want to say - in any way - that you’ve shot someone. Thoughts?

One thing I never hear mentioned is the effects of the NOISE of the shot(s). Your hearing is totally compromised and even hearing a question from a cop is often not totally understood. I was in an accident and the airbag deployment stunned and deafened me to the point the cops thought I was intoxicated, and treated me as such.
That's crazy - the cops should know better after getting smacked in the face and also slightly burned by an airbag. I had the same thing happen to me and my adrenaline was pumping so badly and they knew it and I was also upset and the person who cause the accident was lying and provided 2 different versions of the encounter within 5 mins telling the cops I ran a red light, and then telling them 2 mins that they never even saw me.. but you have to see me in order to claim I ran a red light which I did not. I brought that up to the cop and he nodded without saying anything and I knew he believed me. Sometimes in situations like that, you let the other person (especially if they are at fault) dig their own hole. Any cop will know after the accident that you are amped with adrenaline and potentially hurt and not thinking straight, and should be taking that into consideration. It sounds like the cops you dealt with were either dipshits, or they were trying to stage you.
That's the same effect as their "flash-bangs", but I wouldn't count on them to be all sympathetic toward you for it. The fact that you feel warm and fuzzy toward the police (blessed be the Police in all their ways and works) does not negate the FACT that they will be looking first for SOMEbody to arrest and jail for the shooting, to get the credit for it, and AFTERwards for making sure a guilty person is the one arrested. Being arrested means you are already on your way toward conviction, incarceration, and even execution for the death of a human. Yes, it does happen that way. They may be as sweet and agreeable as sugar pie, but they are NOT anybody's friend. I've worked in Corrections. They are as full of thieves and crooks as the general population.
Mine just paid out over $50K and I won my trial on the 20th last week! I was charged with three felonies because the local assistant police chief just believed what the so called victims told him and didn't even investigate! The law enforcement in my town is as corrupt as Joe Biden.

Many years ago one of my cousins went through a course where they were told if you shoot someone coming in through the window, and fall outside after you shoot them, pull them inside. If they're outside, it isn't self defense.
We are allowed to use appropriate force in Canada. Youll be charged with failure to properly secure a firearm though. They always get people with this one. The judge will say why was your firearm so accessible that you could defend yourself? Must not have been in a safe with a trigger lock on it.
@@DaDaDo661 Yes. There was the incident in a rural setting where the victim was at home when some local bad guy and his family had tried to intimidate him and failed. Later, while drunk they came to his house at night and proceeded to terrorize him. Name calling, making threats to kill him and quickly working themselves up. They set one corner of his house on fire and while looking like they were breaking in on the other side. He shot one of them dead and then that ended the incident. He had video and audio of everything that happened. He had called the police at the beginning of the incident. They arrived a half hour after it was over. (rural setting in Canada). He felt calm by then and told the police everything that happened. He was charged with unsafe gun storage. That doesn't sound like too much when written. But someone died as a result of that. His possession of the weapon at the time he used it to kill someone was illegal. Why he shot someone is irrelevant and matters only in a separate use of force charge. The only issue for the storage charge was whether someone died as a result of illegal ready access. He was convicted and given serious jail time. If I recall correctly, his jail time was overturned on appeal. Local prosecutor, local judge, jail time some of which was served....who knows what was really going on there. Anyway, follow the advice in this video. What seems like some irrelevant detail given what happened can come back to ruin your life. ...I kept shooting until I could see he was dead.....sounds a lot different to a third party than ..... I kept shooting until he stopped pointing his weapon at me..... This, despite the fact that in the moment it might be exactly the same thing.
@@DaDaDo661 Yeah, but it depends on the weapon. A gun, yes, it needs proper storage and it's strict, but anything short of that, nope. An unrestricted weapon, does not have to abide by those laws, like a crossbow/bow, knife, machete, sword, airgun, spear etc. The safe storages laws like trigger locks etc. don't apply there. And the only law even for transport of them, is they must not be loaded, if a loadable weapon, that's it. Doesn't even require a trigger lock. And crossbows just got a whole lot faster with the airbows like the AirJavelin and AirSabre. No strings and more like a gun, yet fall under the same rules as crossbows and airguns, no trigger lock required or safe storage.

Just say it, "dispatchers are idiots." Last time I called 911 because of hit & run, told them my location, my vehicle description, other vehicle description, its tag #, name of company on vehicle, vehicle #, trailer #, description of driver & tons of other information. All she wrote down was tag # & it was wrong. Plus, took them 2 hours to find me because she didn't write down my location right either. Don't count on these idiots for anything.
Anytime...Anytime you give vital information, have them repeat it back to you at that time. And once again, just before you are thru w/911 or investigating officer, have them give your reported info back to you. It's not what i said that's important, it's what you heard ! Trust. But verify ...

Do NOT talk about your feelings or describe what you were doing and why you did what you did until you've spoken to a lawyer and had time to come down from your adrenaline rush. Politely inform the officer that you need to speak to a lawyer before answering any further questions. Remember your Miranda rights... "everything you say, can and will be used AGAINST you" and most definitely not FOR you.

It can be easy to get excited after surviving a life-and-death situation. Don't jump around and rejoice that you are still alive. Don't say, "TAKE THAT MOTHER F...." Etc. If someone sees that or records that, it will look really bad in court.
@@hyperbannana9262 No, not really- the jury isn't even allowed to "see" a mugshot- and it's something where proper voir dire cures the issue. Potential Jurors can be disqualified for things like watching the news, using Facebook or Twitter, etc. Rather, it's also where passing laws against the public release of mugshots need to happen. (and yes, laws like these constitutional under the first amendment, because federal agencies will not release mugshots or anything from the case file to the media- the feds are already doing it.)

When you call 911, tell the dispatcher that if the bad guy survives, you want to press charges. This 911 call will be used in court, and saying that will reinforce that you are the victim and he is the criminal.

It is exactly what happened to the guy that shot and killed the active shooter that killed my middle school SRO. Old Town Arvada, Colorado. He still had the gun in his hand and the cops got there. The police thought he was the active shooter and shot him.

Great advise. I think it's important that when we go to the hospital we don't incriminate ourselves talking to hospital staff. They are mandated reporters. What you say can and will be held against you.
Mandated reporters are required to report abuse or neglect of vulnerable people like children or the elderly to social services. They are neither required to nor take the time to make reports to police about crime. In fact they are actively discouraged from doing so because it could prevent people from seeking treatment, and you have legal confidentiality protections in healthcare.
Years ago when I did my CCW class, the lawyer hired by the range to go through shoot/no-shoot scenarios asked what would we do if we found ourselves between two rival gangs at a stoplight and they were flashing guns at each other through the car windows. We went through the possibilities and the eventual consensus was to get away from those cars, as quickly and safely as possible, and call 911 from a safe parking lot--give a description of the vehicles but do not follow. However, during lunch I overheard one of the students say that if he had found himself in that situation he would "start shooting and let 5-0 sort it out". Yes, he actually said that. I made sure to steer clear of that guy for the remainder of the class and range time.

I know this guy will say this, but not only do you wait 72 hours, when an officer is involved in a shooting, but you also don't hear from them for a while. They're usually suspended with pay pending an investigation. So if an officer is not making statements, it only makes sense that you don't. Another thing that I keep in a non-descript place is the mention of the OODA loop. Police have to decide in milliseconds whether to shoot. Chris Sajnog did a video on that and you'd (or I was) shocked at how fast you have to decide. Exactly, the cop is not the judge, that sort of situation is not at the officers discretion to write a ticket or let you off with a warning....there is no warning once youve dialed 911 and the police show up.
If probable cause is determined by the officer then you can be arrested. The prosecutor or the district attorney will then review the facts of the case and determine if the state will prosecute.
I got the guard card in California that just expired , in the hand gun class we used simulators at Nanpor in Oceanside and the range. It might be good to have people who do simulation training of self defense to have a mock investigation and trial. And for the other students to watch the different trials and how they play out
So does Tennessee, but I don't know about my current state. I think it says something to the effect, that hasn't been tested in court, which is hard to believe.

Part of the investigation will be how many shots you fired in self-defense.
And this is done for several reasons... but one reason may be because a greedy attorney says you fired 100 times.
So one of the ways the cops tell how many times you fired your gun is by counting how many unspent rounds are left in the gun.
So: if you have a 15 round mag... and you have 10 rounds left in your mag after the self-defense shooting... then that means that you fired your gun 5 times in self-defense.
So that will help to keep a greedy civil attorney from trying to say that you shot at the bad guy 15 times or whatever.
I hope I articulated that correctly; and I may actually make a video on this. :)

They were all dropped once I explained what took place. She was arrested on 7 felonies and has been jailed since. I was arrested and jailed, because I ask for a lawyer and I would take time to figure out what happened.

I told the cops that... So they locked me in the back of a cop car for 6 hours in 106 degree weather. They then held me without medical attention and under 24 hour supervision for suicide even though I've never been suicidal for 2 weeks before dropping everything. It took over 30 officers and an entire swat team to arrest me. They shot my cat in self defense... I sit the guy twice in the chest, once through the heart, with hst jhp and the dude was on enough drugs to run away and drive himself to the hospital where he survived...

I can attest to the fact that the police are not your friends after defending myself from a violet attacker twice my size. The police still wanted to make me seem like the bad guy who attacked the person twice his size for no apparent reason. The police also lied and said the hollow tube I used to defend myself was a tire iron.
It's interesting you got that the very 1st part of the video explained very well why you were treated like that assuming you didn't just assault somebody with a weapon 1. You may not have been using reasonable force what was the other guy holding if he had nothing but his hands you didn't have right to bring a weapon that could kill someone you stuck him with a deadly weapon if hit in the head it would cause a blunt force trauma ending his life

it's pretty bad that defending yourself gets more aggravating than letting a criminal just blow your brains out and get away with it.. our justice system needs to be sat down, looked at and fixed.
I would say it's a worthwhile trade off. Regardless of the intentions of the opponent, you are still causing significant harm or death. The repercussions of which cause stress to not only yourself and the injured party, but also the families and friends of those involved.
Defending ourselves and our loved ones is necessary sometimes and an inherent right of the citizen, but we all must be held accountable for our actions, regardless of intent or consequence.
I traded my clean record for defending my life last year may 22nd I’ll never forget luckily the judge noticed I was defending myself but even then they still opted to give me a misdemeanor reckless endangerment for a round that wasn’t even from my firearm it was from the guy shooting me I’m fortunate to be here and at least the judge gave me my guns and gun rights back and didn’t strip me of them our justice system must be fixed!

As a soldier we were issued with a post incident instruction card with 5 points
1. Explain: This person tried to kill me
2. Complaint: I am willing to make a complaint
3. Evidence: There is their weapon
4. Witness's: Those people saw the attack
5. SILENCE: Officer i will cooperate with your investigation, but first i need to speak with my legal representative.
No 5 will allow you at a minimum 24hrs to decompress post incident.
1. Explain: Call 911 and say: “I was physically attacked and the attacker tried to kill me. I acted in self-defense. Please send the police and paramedics to this location at . . .” End the call and immediately turn off your phone.
2. Complaint: DO NOT tell the police that you’re willing to make a complaint. You can do that later, under the advice of your attorney.
3. Evidence: Let the police do their own investigation. DO NOT point out anything to them that you believe to be evidence.
4. Witnesses: Let the police do their own investigation. DO NOT point out anyone to them who you believe to be credible witnesses.
5. SILENCE: DO NOT tell the police that you will cooperate. You can do that later, if that’s what you and your attorney think you should do.
6. The only thing you should say to the police is, “I was attacked and I acted in self defense. I want to speak to my attorney.” It is crucial that you get on record with the responding officers that you acted in “self defense.”
7. “I want to speak to my attorney.” This statement should shutdown the questions coming from the police. If not, keep repeating it and/or demand to speak to a supervisor.
7.1. DO NOT invoke your constitutional right to remain silent, as this can, and most likely will, be brought up during your trial.
8. Expect to be arrested. Say nothing to nobody (except for name and DOB ) until you have spoken to your attorney.
9. DO NOT tell your story to fellow inmates. They are all snitches and even hearsay evidence will be used against you. KEEP YOUR MOUTH SHUT at all times about the incident until you have bonded out.

I teach self defense and am a retired LEO also. This video is excellent! One additional piece of advice I would offer is as soon as safe use your smartphone and quickly record a 360 degree video. Crime scenes get contaminated and altered especially when EMS arrives. Sadly improperly trained police sometimes screw up crime scenes. Get your on pics/video because it is your butt on the line! You might even capture witnesses or other suspects that leave the scene prior to LE arrival or capture witnesses LE fail to interview. You can literally capture a video in seconds that could save your butt. No one will look out for you as well as “you”! Just keep in mind if you get a woke police officer or prosecutor you will need all the defense you can gather.

Suppose a person awakens in his own bedroom to discover a stranger present. The stranger is apparently armed with a deadly weapon and is offering to kill the homeowner in his bed. The homeowner reaches into his night stand, removes a pistol, and shoots the intruder dead. This is a homicide, because one human being has killed another human being, but it is a justifiable homicide because killings in self-defense when the killer "reasonably" fears for his life and has no "reasonable" alternative but to use deadly force are authorized by law. If the killer has no criminal intent, and the killing occurs under circumstances where killings of other human beings are either commanded or authorized by law, the killing is called a justifiable homicide. There it is folks - you best understand "reasonable" or you're up Mierda creek! It's all about "can you articulate" your reasons for acting and they must be reasonable to a jury, not in your own mind!

It it highly imperative that you practice your shooting skills at a certified firearms range with instructors that are willing to help you to become better prepared for a situation such as to protect your home or property as well as a self defense shoot that you are involved in. A Certified Range does offer classes either as a group or individual training that will make you a proficient shooter at the range and will instill the confidence and the know how on what to do in case of a self defense shoot. As a retired LEO myself, the first thing I tell people to do is if you are going to get a gun for personal defense, go through and read the self defense laws in your state and then when you get done reading them, read them again. One thing we were taught in academy and I will tell everyone else, if the responding officer asks what happened and you reply with "I shot and wanted to kill him" you have shown intent and that can be used against you. You say you shot to STOP the bad guy from doing what he was doing.
So do the law enforcement officers read laws and then read then again? Maybe law enforcement should be required to know the laws they are supposed to be upholding. After all, how can you enforce law if you aren’t required to know the laws?

Killing in self-defense is still legally considered homicide or murder. It is simply an exception to murder laws, saying "yes, I killed someone, but I had a really good and reasonable reason for doing so." i.e., someone is trying to kill you or somebody else (depending on where you live).

@@dorianedwards8522 I'm a FF paramedic and we train with law enforcement for active shooter drills. Usually the scenario is there's a shooting, and the bad guy is still around when PD arrives. They use Simunition guns, basically fancy paintball you can fire from your service gun. The instructors decided to mix it up for one scenario and had an "off duty" officer present at the time of the shooting "neutralize" the threat prior to PD arrival. The bad guy was on the ground, handcuffed, with the _off duty officer's gun trained on him with one hand_ and his _badge raised in the other._ The arriving officers weren't told this prior to arrival, and promptly lit him up. *Moral of the story: if there's an active shooter event, you don't want to be holding a gun and **_not_** in a uniform when the cops arrive.*

It's always a good idea of letting the cops be able to identify you immediately as the good guy too.

I was involved in a self defense shooting at my home. Best advice I could give is be respectful, don’t give specifics without an attorney consult, and remember if you do what was said in this video you will hopefully go home the same night. It was a traumatic experience for me and my family but the training saved our lives. Train with your fire arms and know your egress and strong points in your home and on your property

Training with a firearms instructor that provides an tactical training in an environment where you are enriched with the knowledge of how to conduct yourself is priceless. What the issue is the police don't know who's the bad guy. and everybody's going to say they're to good guys and the other people are the bad guys. It's the police job to determine which is which. Until they do you need to make sure you're presenting information that does not incriminate you.

"You could run into that one cop that doesn't like (you, a citizen having) guns (Even though it's your constitutional right), and could see (interpret) you as a vigilante." - That worries me. The police are law enforcement, not dictators. Their feelings and opinions shouldn't mean a god damn thing unless a law was broken or under suspicion of a law being broken, period.
It wouldn't matter though. You still have the courts to deal with the aftermath.

He had been raping girls since he was in high school but none of them came forward to press charges so he kept doing it ,and it progressed with time. I can confirm everything said in this video. I've been in a situation where I had to defend myself and my family with a side arm. I was also seriously injured; requiring medical treatment. I was on heavy medications. Here's what I can add:
1-If you're prescribed ANY type of opioids; you need to get a medical Doctor's note to give a statement for that statement to be legally admissable for any reason.
2-Take a class on safety/self defense that explains the laws in your area so as to be compliant with them.
3- Seek counseling from a Professional mental health provider. You may not think you need it at the time, but trust me when I say you do.

WE live in such a litigious society that you really can't prevent yourself from being in legal difficulties. You can sue for anything in this country, regardless of validity.
But the litigiousness of our society works both ways. If you find yourself on the defensive (and justified) side of a shooting incident and get arrested, you can sue back for wrongful imprisonment, malicious prosecution, etc. You can due the aggressors family in court for emotional trauma, for all the negative press you will receive, in case they try to sue you in civil court and lose resulting in countersuit, etc. because their relative forced you into that situation by their nefarious actions. Lawsuits can (and do) work both ways - the most unfortunate part is that it seems heavier credence is lent to the side that files suit first.

I half-expected this to all revolve around dodging corrupt people trying to turn you into a felon for defending yourself. Was pleasantly surprised to find that most of it made perfect sense from the perspective of both the victim and the justice system.
Glad that, for the most part, the defender is still viewed favorably as long as they don’t muddle up the court’s perspective on what actually happened.
When I took my License to carry class there was a lawyer that came in from Texas law guns or something like that and essentially explained to us everything you explained about the repercussions of shooting in self defense. That man made me more trigger disciplined and in some ways afraid to ever have to use my gun than anything else ever has because I know now that if I ever have to do so I'll be subject to weeks or months of stress and legal problems that will both financially and mentally drain me. Some days it makes me almost regret buying guns and enjoying my 2nd amendment rights in the first place. Hopefully this system changes.

Although I find insurance of any kind to be a scam, I do recommend having self defense insurance. I disagree that "most cops" are 2A supporters, if they truly were, they wouldn't be enforcing ridiculous gun laws. You have to worry about a civil suit also. I hope I never have to use my insurance.

Years. Not months or weeks. Even once the police are done harassing you and the prosecutor is done trying to ruin your life for defending yourself, you will will then be victimized by the family of the person who first tried to victimize you when they sue you.
Dude, just buy gun owner insurance. Its cheap, like 20 bucks a month and you have a personal lawyer on call at all times should you need to defend yourself. They pay ALL your court costs and fees, provide an expert witness and a full team for court and even go on the offensive to prevent the criminal from suing you later in civil court. Its worth it for the financial peace of mind alone.
On not talking to the police, aside from identifying yourself and stating you were attacked, it should be remembered many a prosecutor is anti-gun and desirous of climbing the ladder to a better positions. That would eventually made a HUGE difference in front of a grandjury, or a judge. 'There are no definitive prooves, only chain of evidences'. That's the first link.

My thanks to this gentleman for looking out for all of us good guys just wanting to survive in a violent world. Sadly, the courts are full of corrupt professionals who only care about their own gains and not justice for all. I think the hardest part of the suggestions provided herein is getting two nights sleep. I would have to take a sedative if I had to use lethal force to defend myself and it wouldn't be from guilt but from the general anxiety of the incident.
I took a concealed carry class a long time ago and in the discussion about when it's appropriate to use deadly force the instructor gave the following advice. Take the phrase "So I pulled out my gun and shot him in the face", if what happened before makes this phrase sound reasonable to a jury you're in good shape. If it sounds excessive you're probably going to go to prison.

One thing we are taught as Paramedics is that if we are involved in an off-duty incident the downed assailant is not our patient. It is far easier to defend yourself for avoiding contaminating the scene by omitting aid than to defend yourself for tampering with evidence because you attempted to save your attacker.

Always remember, that in a legal shooting, the attacker was trying to KILL YOU. While you are obligated to call for an ambulance, you DO NOT NEED to assist in keeping him alive. Doing so may expose you to criminal or civil action.; Let the EMTs do their jobs, and do not either assist or interfere.

Absolutely invaluable advice. The only other thing I would do, if possible, is take pictures of the scene from multiple perspectives before it is disturbed. I would then keep that fact to myself until speaking with an attorney.

Great info. In all the training sessions I’ve taken, I have been told never to report to a dispatcher or police that YOU’VE SHOT SOMEONE IN SELF DEFENSE. Instead, report that YOU’VE BEEN INVOLVED IN A SELF DEFENSE INCIDENT... you never want to say - in any way - that you’ve shot someone. Thoughts?

One thing I never hear mentioned is the effects of the NOISE of the shot(s). Your hearing is totally compromised and even hearing a question from a cop is often not totally understood. I was in an accident and the airbag deployment stunned and deafened me to the point the cops thought I was intoxicated, and treated me as such.
That's crazy - the cops should know better after getting smacked in the face and also slightly burned by an airbag. I had the same thing happen to me and my adrenaline was pumping so badly and they knew it and I was also upset and the person who cause the accident was lying and provided 2 different versions of the encounter within 5 mins telling the cops I ran a red light, and then telling them 2 mins that they never even saw me.. but you have to see me in order to claim I ran a red light which I did not. I brought that up to the cop and he nodded without saying anything and I knew he believed me. Sometimes in situations like that, you let the other person (especially if they are at fault) dig their own hole.
Any cop will know after the accident that you are amped with adrenaline and potentially hurt and not thinking straight, and should be taking that into consideration. It sounds like the cops you dealt with were either dipshits, or they were trying to stage you.

The fact that you feel warm and fuzzy toward the police (blessed be the Police in all their ways and works) does not negate the FACT that they will be looking first for SOMEbody to arrest and jail for the shooting, to get the credit for it, and AFTERwards for making sure a guilty person is the one arrested. Being arrested means you are already on your way toward conviction, incarceration, and even execution for the death of a human. Yes, it does happen that way. They may be as sweet and agreeable as sugar pie, but they are NOT anybody's friend.

Many years ago one of my cousins went through a course where they were told if you shoot someone coming in through the window, and fall outside after you shoot them, pull them inside. If they're outside, it isn't self defense.

We are allowed to use appropriate force in Canada. Youll be charged with failure to properly secure a firearm though. They always get people with this one. The judge will say why was your firearm so accessible that you could defend yourself? Must not have been in a safe with a trigger lock on it.
@@DaDaDo661 Yes. There was the incident in a rural setting where the victim was at home when some local bad guy and his family had tried to intimidate him and failed. Later, while drunk they came to his house at night and proceeded to terrorize him. Name calling, making threats to kill him and quickly working themselves up. They set one corner of his house on fire and while looking like they were breaking in on the other side. He shot one of them dead and then that ended the incident. He had video and audio of everything that happened.
He had called the police at the beginning of the incident. They arrived a half hour after it was over. (rural setting in Canada). He felt calm by then and told the police everything that happened. He was charged with unsafe gun storage.
That doesn't sound like too much when written. But someone died as a result of that. His possession of the weapon at the time he used it to kill someone was illegal. Why he shot someone is irrelevant and matters only in a separate use of force charge. The only issue for the storage charge was whether someone died as a result of illegal ready access.
He was convicted and given serious jail time. If I recall correctly, his jail time was overturned on appeal. Local prosecutor, local judge, jail time some of which was served....who knows what was really going on there. Anyway, follow the advice in this video. What seems like some irrelevant detail given what happened can come back to ruin your life. ...I kept shooting until I could see he was dead.....sounds a lot different to a third party than ..... I kept shooting until he stopped pointing his weapon at me..... This, despite the fact that in the moment it might be exactly the same thing.

@@DaDaDo661 Yeah, but it depends on the weapon. A gun, yes, it needs proper storage and it's strict, but anything short of that, nope. An unrestricted weapon, does not have to abide by those laws, like a crossbow/bow, knife, machete, sword, airgun, spear etc. The safe storages laws like trigger locks etc. don't apply there. And the only law even for transport of them, is they must not be loaded, if a loadable weapon, that's it. Doesn't even require a trigger lock. And crossbows just got a whole lot faster with the airbows like the AirJavelin and AirSabre. No strings and more like a gun, yet fall under the same rules as crossbows and airguns, no trigger lock required or safe storage.

Last time I called 911 because of hit & run, told them my location, my vehicle description, other vehicle description, its tag #, name of company on vehicle, vehicle #, trailer #, description of driver & tons of other information. All she wrote down was tag # & it was wrong. Plus, took them 2 hours to find me because she didn't write down my location right either. Don't count on these idiots for anything.

If you have any security video give them a copy of that too. Not THE copy but A copy. Help them catch the bad guys if they're not laying dead or detained on your floor. Do NOT talk about your feelings or describe what you were doing and why you did what you did until you've spoken to a lawyer and had time to come down from your adrenaline rush. Politely inform the officer that you need to speak to a lawyer before answering any further questions. Remember your Miranda rights... "everything you say, can and will be used AGAINST you" and most definitely not FOR you.
Just talk to your attorney and let them guide you. The two nights of sleep rule is not going to help you. JUST INVOKE THE FIFTH AND TELL THEM YOU NEED YOUR ATTORNEY.

It can be easy to get excited after surviving a life-and-death situation. Don't jump around and rejoice that you are still alive. Don't say, "TAKE THAT MOTHER F...." Etc. If someone sees that or records that, it will look really bad in court.

@@hyperbannana9262 No, not really- the jury isn't even allowed to "see" a mugshot- and it's something where proper voir dire cures the issue. Potential Jurors can be disqualified for things like watching the news, using Facebook or Twitter, etc. Rather, it's also where passing laws against the public release of mugshots need to happen. (and yes, laws like these constitutional under the first amendment, because federal agencies will not release mugshots or anything from the case file to the media- the feds are already doing it.)

When you call 911, tell the dispatcher that if the bad guy survives, you want to press charges. This 911 call will be used in court, and saying that will reinforce that you are the victim and he is the criminal.

Great advise. I think it's important that when we go to the hospital we don't incriminate ourselves talking to hospital staff. They are mandated reporters. What you say can and will be held against you.
Mandated reporters are required to report abuse or neglect of vulnerable people like children or the elderly to social services.
They are neither required to nor take the time to make reports to police about crime. In fact they are actively discouraged from doing so because it could prevent people from seeking treatment, and you have legal confidentiality protections in healthcare.
Years ago when I did my CCW class, the lawyer hired by the range to go through shoot/no-shoot scenarios asked what would we do if we found ourselves between two rival gangs at a stoplight and they were flashing guns at each other through the car windows. We went through the possibilities and the eventual consensus was to get away from those cars, as quickly and safely as possible, and call 911 from a safe parking lot--give a description of the vehicles but do not follow. However, during lunch I overheard one of the students say that if he had found himself in that situation he would "start shooting and let 5-0 sort it out". Yes, he actually said that. I made sure to steer clear of that guy for the remainder of the class and range time.

You are 100% right. Right after a shooting is the absolute worse time to do any real amount of talking.
I know this guy will say this, but not only do you wait 72 hours, when an officer is involved in a shooting, but you also don't hear from them for a while. They're usually suspended with pay pending an investigation. So if an officer is not making statements, it only makes sense that you don't. Another thing that I keep in a non-descript place is the mention of the OODA loop. Police have to decide in milliseconds whether to shoot. Chris Sajnog did a video on that and you'd (or I was) shocked at how fast you have to decide. Exactly, the cop is not the judge, that sort of situation is not at the officers discretion to write a ticket or let you off with a warning....there is no warning once youve dialed 911 and the police show up.

If probable cause is determined by the officer then you can be arrested. The prosecutor or the district attorney will then review the facts of the case and determine if the state will prosecute.
I got the guard card in California that just expired , in the hand gun class we used simulators at Nanpor in Oceanside and the range. It might be good to have people who do simulation training of self defense to have a mock investigation and trial. And for the other students to watch the different trials and how they play out
