    Lying to the bank is called bank fraud.

    • @Tim_Russert
      @Tim_Russert 2 дні тому +4

      While banks are expected to perform due diligence, and estimates are likely to be off by a little, the offenses were so egregious, as in inflation of square footage and the like by a factor of 2 or 3, and so numerous that intent of fraud was obvious.
      As for victims, I'd like to meet one person who works for a bank, gave Trump a loan, and didn't lose his or her job as a result.

      They don't want to trigger a windfall of campaign donations, which would make prosecution and sentencing in other cases significantly harder. If he loses on Nov. 5, no court need worry of the stigma of being the first to put him away. The kid gloves will come off. But if we voters want to see it, we have to earn it.

    The law represents societies interest in not having private parties playing, what amounts to, "insider ball." Banks, get to borrow money from the Fed at eye-watering low rates, not to mention the concept of fractional reserves. By taking part in that larger system, the banks aren't just loaning out their own money. But the "systems" money. That means, the harms and impact extend beyond the four walls of the bank. Just because these two parties got to take the rest of us for a ride by not performing their due diligence and obligations to be truthful, doesn't mean we should have to simply stand by and say, well one of the corrupt parties didn't complain about this, so no harm here! Businesses have been allowed to run the common man into the ground while looking the other way when their buddies pull this crap. If the bank isn't acting responsibly, maybe they should have their ability to borrow revoked. Or lend out up to 12 times more than they have on the books (this is how fractional reserve works).

    Not very desperate as some justices hearing the appeal stated that Trump’s no victim argument was persuasive. The DA’s position that the people of NY are the victims is not getting much traction. Harry said the penalty fine was commonly reduced on appeal (prob to the $175 million he posted) but Trump is also winning by having judges embrace his worldview that rules/laws can be broken if the banks are fine with it. This is not the “Rule of Law” but a wink to insiders that all’s fair if you have favorable judges.

  • @joannacurran8475

    Banks facility to lend money is not infinite. So if Trump would have received lower loans or had to pay higher interest in both cases funds would be available to other businesses who could have developed faster and now be paying taxes, so other people lost indirectly.

  • @SuprousOxide
    @SuprousOxide 2 дні тому +2

    If you take a bad bet, and manage to win, it's still a bad bet.
    The same applies to a loan. Without proper collateral, a bank would charge higher interest to hedge against a default. Even if there was no default, they should have collected more revenue to compensate for the increased chance of not being able to collect payment.

  • @derdin8
    @derdin8 2 дні тому +2

  • @ef2b
    @ef2b 2 дні тому +2

    The banks _were_ harmed. Banks are paid for taking risks. More risk, more earnings. Because of the lying about valuations, the banks underestimated the risks and undercharged on the loans. Even if they were paid back, they were cheated out of what they out to have earned, or so it seems to me. I look forward to the banks bringing a separate suit for losses once the ink dries on this one.

    I’m a little confused here...guy basically makes a profit by defrauding banks and the IRS and the courts say sure, no problem since the banks didn’t mind you ripping them off. The disgorgement should equal the amount of money made with reduced loan rates plus a penalty. Do the court genuinely want to signal other criminals to defraud in this manner?? We’re learning a lot from Trump, though...and what it’s like to be rich in this country. Meanwhile, what about the IRS?

    • @Tim_Russert
      @Tim_Russert 2 дні тому +3

      SOP
      Businesses weigh the fines against the profit gained.
      Trump was fined $500k for money laundering back in the '90s. Did he make less than $500k from the money laundering?
      If you get fined one time out of five, and the penalty is no more than the profit made, it's tacit permission to break the law.
      It's like doping in sports: tacit permission to dope up to the level stated as a trigger in the rule book.

    The bank testified that Trump did not receive a better rate than he would have with a lower valuation. What you don’t seem to grasp is that after a certain benchmark, you will not get a better rate. There is no difference if you have 100 million in assets or 300 million, the bank views your ability to pay back the loan and bases any rate reduction on that in addition to a track record of previous loan transactions.
