It was used. It was also missing thermal paste, and the bottom plate had some holes in it. But the seller was a 3rd party on Amazon, so it's not Thermalright's fault.
That's right, I got a used one. The cooler also had 2 small holes on the cold plate which I have never seen. I have to point out though this came from a 3rd party seller.

no way, those few scratches will cause your CPU to overheat. Its more important that the surface is not warped / bent.
