Were they in such a hurry to nab BK that under pressure they threw together the warrant and cited an inapplicable statute? It never made any sense to me that they had to literally break into his parents house in the middle of the night using flash bangs and breaking the front door and windows. good points, all.
If BK had plans to flee the country the state may have reasonably hurried up the investigation to make an arrest before he fled the country at the beginning of the new year...even failing to cross all the T's and dotting all the I's, and still be within the law of probable cause.

I had a FOJ warrant for my arrest out of PA for something I truly didn’t do. I went through hell with that and had to be extradited to PA from NJ. Thankfully I was able to prove myself innocent and my charges were dismissed, but PA is notorious for making wild charges and accusations against people. They are a common wealth state and a detective in NJ outright told me that they make their own rules in that state. I even had a second warrant issued because their e-pay system showed that I didn’t finish paying court fees. I had $111 in court fees to pay and the taxes didn’t reflect on the portal and because of that I was rearrested and extradited to PA a whole year later. I was immediately released once I got in front of a judge who profusely apologized to me for the whole situation, but it still destroyed my life, twice! All b/c I was scammed by a guy who claimed to work for Comcast cable! This happened in Bucks County PA and then they released my mugshot and I sued them as part of a class action lawsuit for releasing people’s mugshots without being convicted of a crime. My life is still not 100% back to normal yet, but I still fight and I won’t give up! I will regain what I lost. It’s just a shame that they didn’t have to pay more or be held to a higher standard of accountability and I unfortunately don’t have the money, resources, or time to fight them for everything they have done to me.
Great video, Kohberger was arrested in PA under false pretentions, Moscow PD got rid of Kohberger's interview where Kohberger announces to Moscow PD his trip back home while school break! 1) Make Idaho warrants with such of language that PA won't question. 2) While in PA look for needed DNA due to Moscow PD didn't have no DNA on the sheath 3) After getting the needed DNA with out waiting for the lab results the cops said that was a match to Kohberger after 3 days turn around & there's Kohberger on his way back to Idaho. btw DNA IGG results takes months to come back, it took 3 to 4 days for a match to Kohberger's Dad not Bryan's, is it me or this is a terrible sloppy frame job? I'm not a lawyer but I have faced the courts several times & from my experience/knowledge I agree w/ u 100%. How could he have been a fugitive since he was not on the run/fleeing from prosecution. He had not been charged yet nor did he have any knowledge of commiting a crime to flee from!!!

I had been made aware that Brian's arrest & extradition bact to Idaho was unlawful and should never have taken place. They had no probable cause to obtain the DNA from his family's waste. I also believe they arrested him before any DNA results were finalised, thus making his arrest & extradition unlawful. Why his defence has not raised this is beyond me. What do you think? @@Pllm30 They had 30% of usable DNA from a knife sheath which did not give a match to anyone, so they illegally collected his dad's DNA from trash and used 70% of his dad's DNA to create a profile, this is a lab generated Frankenstein STR DNA profile, that is obviously going to give 20 match points with Brian's unique DNA which he inherited from his father. If this isn't fitting someone up for a crime then I don't know what is. This whole process is illegal and he should be set free and LE should concentrate on apprehending the real culprits of this atrocitie.

LE needed any DNA from the trash because being family members they would all link anyway, doesn't need to be just dad. The DNA on the sheath did not give match to anyone in CODIS, all that meant was the DNA belonged to someone who did not have a criminal record as CODIS is a criminal database. Your assessments of the lab results are false because unless you have a scientific degree, you cannot tell how those complicated testings are done, only people who work in that field know how it's done because labs do not allow non-employees inside to figure out how they test.
He isn't a fugitive, already been said in court. And his parents have said it was a planned trip him going to visit for the holidays ... He isn't a fugitive

When I originally heard of how Bryan was arrested it made me wonder if law-enforcement in this case didn't want to have a scenario play out like in the Gabby Petito case. Police knew right where Brian Laundrie was and he was able to get out of the house and slip away to that park without police seing him leave.
That is just PA's way of wording things. PA did not have him arrested, ID and FBI did. He's being tried in ID not PA, so that document carries probably little weight.
To me the number one question is when did they first get Bryan Kohberger’s name? If the FBI got Bryan’s name before doing the IgG family tree, that seems pretty sketchy. If that’s the case it sounds like they got his dad’s DNA first and then worked backwards making the tree because they already had the end result they wanted, which was Bryan. I’m talking out of my ass right now but why would you go clear across the country to get his dad’s DNA when you could’ve just got Bryan’s before he left Moscow. To me it sounds like they had to get his dad‘s DNA to make it fit. For whatever reason Bryan’s DNA wouldn’t have matched up with the DNA on the knife sheath. I mean, why would you let somebody that you think could be a serial killer or just a killer in general drive all the way across the United States. Maybe the FBI did do the family tree first and that’s how they found Bryans name around December 20th. But if that’s the case then why is WSU police in the PCA saying they found Bryan’s name and car in late November. And if they did find Bryan’s name and car in late November then how the hell did MPD not know it, that doesn’t even make any sense. I was shocked when Officer Payne said on the stand that he didn’t know Bryan’s name until December 20th. If you read the PCA he made it sound like he was told by WSU police later on that morning. I’m not even saying be was framed. At some point maybe they thought he was 100% the guy and by the time they realized he wasn’t they had already went too far down the road to turn around. But when people say there’s no way the FBI or any police force would just make somebody fit, they obviously have no clue who Richard Jewell was. They tried to get him to confess by taking what he said out of context on purpose just so they could have their guy. And even when they knew he wasn’t the guy they still wouldn’t leave him alone. It took his mother going on national TV and asking the president to clear her son‘s name while crying. BTW where is the FBI. Anyway sorry about the long rant.
Studied paralegal here. They got Bryan's name thru tips and leads. IGG was one of numerous tips they used. He was not arrested off of IGG alone. IGG was a piece to a large puzzle. All family members share DNA, and DNA is invisible to the naked eye, so it doesn't matter whose DNA was found whether dad, mom, sister etc it will all trace back to whomever was near the area the time of the killings. Bryan is 50% his mom in DNA and 50% his dad in DNA. Bryan shares the same DNA 50% to each parent. Cops are not allowed to obtain DNA from a person's residence, office or car w/out a signed search warrant. There was no search warrant for Bryan in WA. In order to get a search warrant, probable cause has to be established. The only way for LE to get probable cause is to have Bryan's DNA matched to the DNA at the crime scene. Going through Bryan's trash is legal to get DNA, but entering his apt/office for DNA is illegal minus search/arrest warrants as citizens have rights to privacy. Obviously, WSU cops were not in line with FBI because it was a different State, and they had no clue who the killer was or where he lived at that time. If a crime happens in Los Angeles, why would someone in Phoenix be concerned or hurrying up calling the FBI, to answer your questions. Obviously, WSU like most people in America thought the killer lived in Moscow since the murders happened there. You don't expect some killer to be living a full State over from where the murders occurred.
How could he have fled from justice if he was back in PA around 16 December, and the MPD never heard of BK until 20 December? Not to mention, phone records weren't obtained until 23 December.
If BK made evidence of a plan to flee the country it may answer both of your questions: Why the SWAT action; Why the Fugitive From Justice charge, IMO.

He would be considered a fugitive from Idaho. He had an arrest warrant in Idaho. So he was arrested in Pennsylvania for that warrant. You should be reading the Idaho warrant. This is how all fugitive warrants go. It doesn't matter if you flee or not if a state issues a warrant for your arrest. The state you go to will arrest you and hold you for extradition. They were assisting another state who did have an arrest warrant for kohberger. This is how all states work.
