i’m with the plaintiff. i was a contractor for years. if said i was going yo be there, i was there. most contractors have multiple jobs going on at the same time, too bad for you, then don’t make promises you can’t keep. AT THE VERY LEAST, COMMUNICATE with the customers. they are your boss. they are paying you. have some pride and do a very good job. have some respect for the people that hire you. i met lots and lots of nice people. don’t tell the customer they are out of line or they are hard to please when you don’t show up when YOU say you’re going to be there. you chooch.

My husband installed a new, and larger window in our house. He had to cut into the house to make the opening bigger, plus our home is 3-4 feet off the ground so he had to lift the heavy window by himself! No problems, and a beautiful job done in two days!
JM wasn't listening to all the testimony it seems. How many times did the guy say that he was coming on a certain day and didn't show up or call? How could she possibly be sure that they would show up on the Tues after Jul 4th?

Should not have fired him. Just wait and see if he showed up. As it stood at the time of this case (2 months later) the job was still not complete. Had he not shown up on that Tuesday after July 4th, it would have helped her case and put a nail in his coffin.

Ive worked for some window companies.they all do things to cut corners,and they play the not delivered yet game.ive had many easy days at work because of windows that don't fit and the homeowner wont let them try to make it work.ive seen the wrong window painted and altered to where it looks completely different,and installed and the customer noticed and it got ripped out.they even charge for service on Windows they installed wrong if you are dumb enough to pay them twice.and you never know if something was done wrong when the house was built or if wood is rotted or many other things are messed up.poor work is extremely common in the window business.the owners just tell you the installers are subcontractors who dont actually work directly for them and installed windows can take years for a bad installation to be noticed.usually most complaints are bad caulk jobs and cheap caulk which is an expensive material and easily installed wrong.

You don't have a legal right to demand it be done by a certain date unless specified in the contract, even if he simply said he'd come on a date. It's not binding. And he had phone records of him requesting to come back the day after she threatened to call the cops on him for not finishing the job when it was raining and the sealant wouldn't dry, and paint would wash away.... He completed half the job, and was paid for half. Sorry if you disagree but laws don't bend to make anyone happy.
I totally disagree with the Judge on this one. Not returning calls and saying you will be then, then you’re a no show. I understand things happen, but the defendant was just terrible

He could have called her and she didn't answer, or she picked up and he cussed her out... we don't know. And her point was they didn't return to complete the job which they didn't so him calling doesn't mean anything really.

From two weeks to over a month. They wouldn't call to say they're not coming. I had a contractor like that, it was horrible. Took over a month to finish my project because he was too busy and his guys were too busy with other jobs. Sucks that they can do that legally.

I agree...did the bs the plaintiff said earlier about the defendant just fly over her head or what? They kept saying they'd be there at so and so, never showed up, never called (SHE had to call them back), and then couldn't even drop personal plans to help her out after making her wait all that time. There's no way in hell I'd trust that they'd come back in a timely fashion or without me having to blow up their phone every day...not worth the trouble

And she let them come to install the window after she was complaining about them not showing up, so she was complicit and still had them come to start the work, instead of asking for a refund and finding someone else (if she had even paid yet).

They really should've been there when they agreed the 1st time instead of blowing her off AND not even giving enough respect to call her and let her know they couldn't make it yet...when they finally did get around to finally bringing the window, they did it on 4th of July weekend when they knew they'd likely either be busy or have plans to be with family or something early on and throughout the weekend. They didn't seem to think at all about her, it seems to me they put her on the back burner, forgetting all about her until she called them and reminded them they still had a *job* to do~ I would've gotten mad and likely blew up on them as well.

I don’t think anyone should bring a contracting case to this judge. She’s partial to contractors just because of her family. She excuses contractors who reschedule constantly, arrive late, no show, etc. It’s ridiculous. I have medical professionals in my family but I don’t excuse malpractice. Professionalism is important in any field of business, period.
Bro the customer literally fired them. Of course you don't win if you give a deposit then fire the contractor mid job, it was also $200 of a $980 job.... He completed at least 20%

But she allowed them to come later w/o firing them previous, they did maybe 30-40% of the job then when it started raining they had to halt, they eventually after arguing said they'd come over that weekend to finish the rest then fired them that day. The contractor was definitely shady with putting it off that many times. If she had let him come back I would expect him to keep putting her off for another month-->thats the consistent behavior they have had; theres no reason to think they would come back soon . She definitely made the matters much much worse by blowing up at them

The contractor needs to learn about his business, it is not about Asian women, women in general will yell if there is anything wrong in the install of window, painting the walls, repaving a drive, remodel of a kitchen, anything.

sorry, being a 'licensed contractor' is simply meaningless. anyone can run down to the county offices and take the test to become one. having a license is NO guarantee that good work will be done. you have just as much of a chance with a friend helping you.....i have hired out to both, and not one of them did a decent job. they accept jobs, even if they have NO IDEA what they are doing. they may think they do, but then, in the middle of the job, oops! i gotta go, and they are gone forever. the one thing i HAVE learned however, is: DONT PAY UP FRONT!!!! PAY WHEN THE JOB IS DONE AND INSPECTED!! asking to see any permits they purchase is a great idea too, and you can look up codes and permit requirements online for yourself. always good to be educated! have fun everybody, and good luck!

Everyone complaining about the contractor have not experienced hiring them. Talk to someone that has, and you’ll hear all the issues they have with contractors. When they say they will do something at a particular time , that only means they will try and if they’re not doing other contracts at that time. Most of the time the times are not kept. Paid in advance - consider yourself fortunate they didn’t take off with all the money, and that you ever able to contact them again. All windows have gaps in them - you have to fill the space between, and put molding around. It’s not going to be an exact fit like a glove , unless it’s the same window from the same manufacturer that your replacing.

I get the plaintiff was suspicious about the people she hired with the un returned phone calls and no shows, and then has the perception that it's the wrong size. But, there are always surprises in construction, and if the frame was rotten, it was going to take more time than originally thought - she should have given them at least one more visit to fix it, even if it wasn't the next day.
i mean yeah but saying you’re going to be somewhere then not following up when you can’t come is unprofessional. i think she’s a bit high strung & jumped the gun but i also don’t blame her for blowing up after all the times she thought they were coming and never did. ultimately she didn’t sign anything with a specific time frame and ended up firing them so that’s on her. but not showing up or showing up late or not communicating is not a way to run a business even if construction can have a lot of roadblocks. i work in the lawn equipment industry & there are a lot of times that things fall through or take longer than they originally were going to. but all i know is that, if i told someone i would be somewhere and no call no showed them or didn’t reach out to them, i would be fired.
Okay what is your point though? No one said there aren't surprises... but you don't ignore the customer. You let them know, apologize, reschedule on the phone etc. You keep in contact. No one cares if legitimate issues arise that cause him to miss the appointment, its the issue of him not communicating.

But in most of the other People's Court episodes, JM usually says the company should have one chance to fix it before you sue, and if they don't, then you sue for the amount it would cost someone else to fix it.

It might be that the industry doesn’t work like clockwork, but people know how to pick up the phone and talk to their clients and say oh it’s not gonna be two weeks we won’t get the window for another two weeks meeting a month just communicate and let people know what’s going on. I think it’s a mistake to ghost your client and I keep them in the loop and to leave your client chasing you to find out what’s going on. A lot of people do it but it’s unprofessional and it’s inconsiderate. So I might’ve reacted just like that lady did especially when he started getting personal with the racist remarks.

I feel the judge would've given the contractors more grief than the plaintiff if she was the plaintiff, using her excuse of 'coming from a contractor family.' I think she's biased on a lot of things, eg. her obvious dislike for prostitutes and imposing her very warped idea that family is everything.
I worked as a production manager. There is nothing wrong with things taking long, particularly with windows. It is not always the contractors fault. Also, rain makes things complicated. Some customers will have a fit if we work in the rain bc they think we are letting water into the house, other are like this lady. The rub is, you have to communicate with the customer. Yes, contractors are notoriously bad at this, so I made it my mission to be that middle person. Also, some customers can be super impatient and not understanding. There is a process. It is not as simple as buying a piece from the local store if the company has a contract with their supply company. Would you buy a product from ur competitor? Often time places like home depot does have jobs going on. Also, your home is not the only home we are working on and your house is not priority sometimes. Particularly, if it is one window, it is just what it is. You are lucky if a window company takes you on let alone give you grade A service for that. It is not something I would say to you but it is what it is. You aint the first job of the day. You get what you pay for. Everyone should get good service but it isn't going to happen. Also the Asian thing, since I am Asian I can say this. Stereotypes are not rules but sometimes they come from some level of truth. I will say that a much higher percentage of Asian customers tend to exhibit problems about cost, wanting things a certain way, etc. This could be a good thing bc they are just paying attention to the details. However, it can also manifest as unreasonable, thinking they know more than they do, and acting like they had more contractual leverage than they did. Just an observation. Holding 10k check for s 5 dollar vent is unreasonable. U don't want the contractor to put a lien on ur house. Also, if u think u know better than a guy who has been doing this for 20 years, don't hire them and do it yourself. All of us are just trying to feed our families and not out to scam people.

The defendant's son says something racist and the plaintiff got upset, so the judge has a go at the plaintiff saying 'if she hadn't got upset she would have had her window finished by now', but forgetting that the defendants were rude and had already stood her up so many times before, so surely that is a breach of contract, so whether they said they were coming back the next day or in 4 days, why was she supposed to believe them. And that is one tiny window, 12:20 why was is going to take a whole day to install? Why couldn't they just finish it then and there? Very wrong 😞 judge got it wrong. There is no way it should have taken that long. I have been a window installer, the only time I've had issues with the Windows,is when someone else ordered them...not just the customers can screw up, I had a full house to put all new windows,the customer said that the sales guy from the widow factory went and measured it all up and put in the order, when the Windows were delivered I went there first thing before I even took the old ones out ,I measured and made sure they would fit. Well they were all wrong. Not the correct depth the walls were 2+4 and the guy ordered 2+6 also he had orders brick mold for around the windows either. It was an old farmhouse,I don't know what the guy was thinking the old windows weren't gonna come out without the brick mold,and I wasn't gonna reuse the wooden ones. Anyway ,did this guy say the widow cell was all rotten? I guess that would be a set back...but he should have allowed for something like that and gotten there earlier and had lumber and tools on his truck. Oh brother.

So I work for a blind installation company. I always have to explain that every order is custom order and could take 2 to 4 weeks to get the blinds from the manufacturer. This can ALWAYS change if they are backlogged or have fabric out. Some demand their blinds in 1 or 2 weeks and I always laugh and say if you want that then go to Home Depot. People need to realize things like this are not like fast food. You don’t always get what you want when you want it. If you want it by a certain time then have better planing on when to start the job.
You have poor customer service dude. No wonder you never get jobs with your attitude as you are always right and the customer is always wrong. You are poor for that very reasoning.
Disappointing decision. He was not able to install the window by the agreed date because he did not have the window from the manufacturer. That is not her fault. He did not keep in contact with the customer to say there is a delay. I don't know what is right. I don't trust contractors. This is why.. They agree to complete the job maybe knowing full well the manufacturer is behind in production. That is on him to get an agreement on when the window can be delivered. Not her. Currently window manufactures are 3 months backordered. That is fine. Don't smooth talk the customer and tell them we can have it installed in 8 weeks to "get the job" Like I said, I don't know what is the right decision here. Contractors are like politician's, if their lips are moving, they are probably lying. I am told a window replacement should be 2 - 3 hours labor. That is not worth $700 labor In my opinion.

He could have called her and she didn't answer, or she picked up and he cussed her out... we don't know. And her point was they didn't return to complete the job which they didn't so him calling doesn't mean anything really.

From two weeks to over a month. They wouldn't call to say they're not coming. I had a contractor like that, it was horrible. Took over a month to finish my project because he was too busy and his guys were too busy with other jobs. Sucks that they can do that legally.

They kept saying they'd be there at so and so, never showed up, never called (SHE had to call them back), and then couldn't even drop personal plans to help her out after making her wait all that time. And she let them come to install the window after she was complaining about them not showing up, so she was complicit and still had them come to start the work, instead of asking for a refund and finding someone else (if she had even paid yet).

They really should've been there when they agreed the 1st time instead of blowing her off AND not even giving enough respect to call her and let her know they couldn't make it yet...when they finally did get around to finally bringing the window, they did it on 4th of July weekend when they knew they'd likely either be busy or have plans to be with family or something early on and throughout the weekend.
They didn't seem to think at all about her, it seems to me they put her on the back burner, forgetting all about her until she called them and reminded them they still had a *job* to do~
I would've gotten mad and likely blew up on them as well.

And legally unless a contract has a specific timeframe you don't have a right to demand it be done by a certain date. Beyond a reasonable timeframe. Can't be a year later etc.

I don’t think anyone should bring a contracting case to this judge. She’s partial to contractors just because of her family. She excuses contractors who reschedule constantly, arrive late, no show, etc. It’s ridiculous. I have medical professionals in my family but I don’t excuse malpractice. Professionalism is important in any field of business, period.

But she allowed them to come later w/o firing them previous, they did maybe 30-40% of the job then when it started raining they had to halt, they eventually after arguing said they'd come over that weekend to finish the rest then fired them that day. And was only paid $200 of the $980 job as a deposit. It was about her timing on firing them.
The contractor was definitely shady with putting it off that many times. If she had let him come back I would expect him to keep putting her off for another month-->thats the consistent behavior they have had; theres no reason to think they would come back soon . She definitely made the matters much much worse by blowing up at them

sorry, being a 'licensed contractor' is simply meaningless. anyone can run down to the county offices and take the test to become one. having a license is NO guarantee that good work will be done. you have just as much of a chance with a friend helping you.....i have hired out to both, and not one of them did a decent job. they accept jobs, even if they have NO IDEA what they are doing. they may think they do, but then, in the middle of the job, oops! i gotta go, and they are gone forever. the one thing i HAVE learned however, is: DONT PAY UP FRONT!!!! PAY WHEN THE JOB IS DONE AND INSPECTED!! asking to see any permits they purchase is a great idea too, and you can look up codes and permit requirements online for yourself. always good to be educated! have fun everybody, and good luck!

Everyone complaining about the contractor have not experienced hiring them. Talk to someone that has, and you’ll hear all the issues they have with contractors.
When they say they will do something at a particular time , that only means they will try and if they’re not doing other contracts at that time. Most of the time the times are not kept.
Paid in advance - consider yourself fortunate they didn’t take off with all the money, and that you ever able to contact them again.
All windows have gaps in them - you have to fill the space between, and put molding around. It’s not going to be an exact fit like a glove , unless it’s the same window from the same manufacturer that your replacing.

I get the plaintiff was suspicious about the people she hired with the un returned phone calls and no shows, and then has the perception that it's the wrong size. But, there are always surprises in construction, and if the frame was rotten, it was going to take more time than originally thought - she should have given them at least one more visit to fix it, even if it wasn't the next day.

i work in the lawn equipment industry & there are a lot of times that things fall through or take longer than they originally were going to. but all i know is that, if i told someone i would be somewhere and no call no showed them or didn’t reach out to them, i would be fired.

But in most of the other People's Court episodes, JM usually says the company should have one chance to fix it before you sue, and if they don't, then you sue for the amount it would cost someone else to fix it.
the frame has to be done before the window is placed in,that is in the total price,they did not do that ,the boyfriend is a typical electrician ,he was no help and doesnt care,you dont put a frame in after you set the window,,my husband has set several windows thru the years,too bad she was taken

It might be that the industry doesn’t work like clockwork, but people know how to pick up the phone and talk to their clients and say oh it’s not gonna be two weeks we won’t get the window for another two weeks meeting a month just communicate and let people know what’s going on. I think it’s a mistake to ghost your client and I keep them in the loop and to leave your client chasing you to find out what’s going on. A lot of people do it but it’s unprofessional and it’s inconsiderate. So I might’ve reacted just like that lady did especially when he started getting personal with the racist remarks.

I feel the judge would've given the contractors more grief than the plaintiff if she was the plaintiff, using her excuse of 'coming from a contractor family.' I think she's biased on a lot of things, eg. her obvious dislike for prostitutes and imposing her very warped idea that family is everything.

I worked as a production manager. There is nothing wrong with things taking long, particularly with windows. It is not always the contractors fault. Also, rain makes things complicated. Some customers will have a fit if we work in the rain bc they think we are letting water into the house, other are like this lady. The rub is, you have to communicate with the customer. Yes, contractors are notoriously bad at this, so I made it my mission to be that middle person.
Also, some customers can be super impatient and not understanding. There is a process. It is not as simple as buying a piece from the local store if the company has a contract with their supply company. Would you buy a product from ur competitor? Often time places like home depot does have jobs going on. Also, your home is not the only home we are working on and your house is not priority sometimes. Particularly, if it is one window, it is just what it is. You are lucky if a window company takes you on let alone give you grade A service for that. It is not something I would say to you but it is what it is. You aint the first job of the day. You get what you pay for. Everyone should get good service but it isn't going to happen.
Also the Asian thing, since I am Asian I can say this. Stereotypes are not rules but sometimes they come from some level of truth. I will say that a much higher percentage of Asian customers tend to exhibit problems about cost, wanting things a certain way, etc. This could be a good thing bc they are just paying attention to the details. However, it can also manifest as unreasonable, thinking they know more than they do, and acting like they had more contractual leverage than they did. Just an observation. Holding 10k check for s 5 dollar vent is unreasonable. U don't want the contractor to put a lien on ur house. Also, if u think u know better than a guy who has been doing this for 20 years, don't hire them and do it yourself. All of us are just trying to feed our families and not out to scam people.

The defendant's son says something racist and the plaintiff got upset, so the judge has a go at the plaintiff saying 'if she hadn't got upset she would have had her window finished by now', but forgetting that the defendants were rude and had already stood her up so many times before, so surely that is a breach of contract, so whether they said they were coming back the next day or in 4 days, why was she supposed to believe them. And that is one tiny window, 12:20 why was is going to take a whole day to install? Why couldn't they just finish it then and there? AND, just because the judge's father is a 'contractor' does NOT mean she 'knows the business'...

Very wrong 😞 judge got it wrong. There is no way it should have taken that long. I have been a window installer, the only time I've had issues with the Windows,is when someone else ordered them...not just the customers can screw up, I had a full house to put all new windows,the customer said that the sales guy from the widow factory went and measured it all up and put in the order, when the Windows were delivered I went there first thing before I even took the old ones out ,I measured and made sure they would fit. Well they were all wrong. Not the correct depth the walls were 2+4 and the guy ordered 2+6 also he had orders brick mold for around the windows either. It was an old farmhouse,I don't know what the guy was thinking the old windows weren't gonna come out without the brick mold,and I wasn't gonna reuse the wooden ones.
Anyway ,did this guy say the widow cell was all rotten? I guess that would be a set back...but he should have allowed for something like that and gotten there earlier and had lumber and tools on his truck. Oh brother.
It might have in my house it took 3 visits including wrong parts 2 times missing part they had to leave and come back and two more weeks for them to install 6 windows they came and broke the woood frame they never frame the new windows and they missed a window

So I work for a blind installation company. I always have to explain that every order is custom order and could take 2 to 4 weeks to get the blinds from the manufacturer. This can ALWAYS change if they are backlogged or have fabric out. Some demand their blinds in 1 or 2 weeks and I always laugh and say if you want that then go to Home Depot. People need to realize things like this are not like fast food. You don’t always get what you want when you want it. If you want it by a certain time then have better planing on when to start the job.
You have poor customer service dude. No wonder you never get jobs with your attitude as you are always right and the customer is always wrong. You are poor for that very reasoning.
Plaintiff was 100% in the wrong. Treated defendant poorly - even her bf knows she's unreasonable.
Disappointing decision. He was not able to install the window by the agreed date because he did not have the window from the manufacturer. That is not her fault. He did not keep in contact with the customer to say there is a delay. I don't know what is right. I don't trust contractors. This is why.. They agree to complete the job maybe knowing full well the manufacturer is behind in production. That is on him to get an agreement on when the window can be delivered. Not her. Currently window manufactures are 3 months backordered. That is fine. Don't smooth talk the customer and tell them we can have it installed in 8 weeks to "get the job" Like I said, I don't know what is the right decision here. Contractors are like politician's, if their lips are moving, they are probably lying. I am told a window replacement should be 2 - 3 hours labor. That is not worth $700 labor In my opinion.
