As President Yoon Suk Yeol’s impeachment trial nears its conclusion, tensions continue to rise over key testimonies and legal battles.
The sixth hearing, held on Thursday, brought intense debate over allegations that President Yoon had directly ordered military forces to remove lawmakers from the National Assembly on December 3rd, a claim that seems to be at the center of the impeachment case.
With only two more hearings scheduled, the impeachment trial has entered its final stretch.
However, uncertainties remain regarding the possibility of additional witnesses, potential delays, and the broader political implications of the proceedings.
To break down the key developments we invite Lee Hee-eun, Dean and Professor of Law at Handong International Law School. Welcome, Professor.
Also joining us is Cho Hee-kyung, Professor of law at Hongik University. Great to have you with us.
(CHO) 1. Let's begin with Professor Cho, so six out of the eight hearings designated by the Constitutional Court have now been completed, and President Yoon Suk Yeol’s impeachment trial has now entered its latter phase. Professor Cho, how do you assess the progress of the impeachment trial so far?
(LEE) 2. Now to Professor Lee, the sixth hearing, held yesterday (6th), was conducted from 10 AM and lasted all day, unlike previous hearings.
This move is interpreted as an effort to expedite the impeachment proceedings. However, some critics argue that the Constitutional Court is rushing only the president’s case, raising concerns over a hasty review. What are your thoughts on this, Professor Lee?
(LEE) 3. During the sixth hearing, key witnesses, including former Special Warfare Command Commander Kwak Jong-geun, testified regarding the military deployment during the December 3rd Emergency Martial Law. What aspects do you think the justices focused on as key points of contention?
4. (CHO) 4. One of the most contentious issues was whether President Yoon had ordered to drag out "lawmakers" from the National Assembly.
There is an ongoing row about the subject of whom Yoon ordered to bring out with Yoon's side saying it was "agents" while Special Warfare Command Commander Kwak Jong-geun, says he heard it to be "number of people."
All of these three words have a similar pronunciation in Korean. Professor Cho, Given these conflicting testimonies, what criteria will the Constitutional Court use to establish the facts?
(CHO) 5. With only two more hearings remaining, President Yoon’s legal team has requested that the Constitutional Court hold weekly hearings, emphasizing the need to fully guarantee his right to defense. What is the likelihood that the Constitutional Court will grant this request?
(LEE) 6. The eighth hearing, scheduled for the 13th, is currently the last designated hearing. However, the Constitutional Court has yet to decide on President Yoon’s request to summon Lee Kyung-min, Chief of Staff of the Defense Counterintelligence Command, and Prime Minister Han Duck-soo as witnesses.
Professor Lee, do you think additional hearings or witnesses will be granted?
(LEE) 7. Meanwhile, President Yoon’s legal team has filed a motion with the Seoul District Court requesting the cancellation of his detention rather than bail. What is the reasoning behind requesting a cancellation instead of bail? The court must decide within seven days-do you think the request will be approved?
(CHO) 8. Previously, the Constitutional Court postponed its ruling on whether Acting President Choi Sang-mok’s decision not to appoint Ma Eun-hyuk as a constitutional judge was unconstitutional. The ruling is now scheduled for the 10th. Professor Cho, do you think a final decision be made this time? How might it impact President Yoon’s impeachment trial?
(LEE) 9. Meanwhile, Prime Minister Han Duck-soo’s impeachment trial is set to begin in earnest, with the first hearing scheduled for the 19th. The National Assembly has also requested the withdrawal of insurrection charges in Han Duck-soo’s impeachment trial. Professor Lee, What key aspects should we focus on in this trial?
