No charges for US Marshal who killed man during Charlotte arrest

  • The Mecklenburg County District Attorney's Office says they will not be seeking charges against the U.S. Marshal who fatally shot a man during an attempted arrest at a Charlotte gas station in March 2021.
    In a letter sent to Charlotte-Mecklenburg police chief Johnny Jennings on Tuesday, District Attorney Spencer B. Merriweather III said his office would decline to bring charges against Ofc. Eric Tillman as part of their investigation into the death of Frankie Jennings (no apparent relation to Chief Jennings). Tillman was a member of the US Marshals' Carolinas Regional Fugitive Task Force (CRFTF) who, on March 23, 2021 was a member of the force that went to a gas station along The Plaza in Charlotte to arrest Frankie Jennings. Jennings was wanted on several active warrants, including assault with a deadly weapon against a law enforcement officer, discharging a firearm, within city limits, and two counts of possession of a firearm by a convicted felon.

      The USMS are not concerned with your innocence or guilt. You have a warrant, that means you get arrested and brought in. Whether you are proven guilty beyond a reasonable doubt in a court of law is for another day.

    He was wanted by police, let alone the US Marshals. If he thought running was going to help, let alone reaching for a firearm would inspire change for law enforcement, I doubt it.

      He’s black though, so they’re allowed to do anything they want. They’re not required to be law abiding citizens. We need to start having a serious conversation about bringing back segregation. We should give them 3 states, Mississippi, Alabama, Georgia, and wish them all the best of luck as we build a huge fence around it. Let them live how they want to live, but stop letting them endanger and victimize the humans.

      He did not deserve to die. Come after him? His children not seeing him the next day or whatever the case may be that may potentially be a nonviolent warrant, the trauma of his children not seeing their father over somebody else perceived threat, is not justified. You all are out of your minds and to see other men give away their power like you don't have the ability to conduct your own governance is insane. When Marshals pulled up, why would he immediately proceed to the driver's seat of the vehicle and take off? Even more so there was a firearm in a cup holder next to the driver's seat. The men that killed him did what was necessary. It cost a suspect his life but saved thousands of other innocent lives, that's a no brainer.

    My rebuttal for the suspect's attorney is. He was pumping gas and his vehicle was stopped, which means his vehicle was put in "park" mode. The gear shift is located in the center console. For him to move his vehicle forward while his left hand is being held by the US Marshals, he would of had to use the gear shift with his right hand located in the center console. Therefore, putting his right hand in very close or even in possession of the firearm located in the cup holder in the center console. The attorney states that his right hand was on the steering wheel at the 12 O clock position. It would be impossible for his right hand to be in that position and operate the gear shifter at the same time. In conclusion, at some point during the struggle the suspect put his hand on or near the center console. Which would justify shooting the suspect if the marshals believed that he was reaching for the firearm located to in the center console cup holder.

    So resisting arrest and trying to drive away and start a high speed chase wasnt a factor that he was going to be an imminent danger to public drivers on the road possibly hitting other vehicles I believe this was justified and that Marshal saved more than just himself and his fellow marshals.

    The change might need to start in how you raise your kids. How about doing an honest days work? If we have people beating down our doors to get in and people hear will not work, doing crime there might be a GOOD place to start.     He was no stranger to the law, many prior convictions, he was trying to flee and when he was blocked he would have killed those Deputy US Marshals had he been allowed. It gets me how the families of criminals turn a blind eye to the bad things/crimes their offspring's do and when they are brought to justice or killed when trying to injure or kill law enforcement officers, they cry fowl and believe they are entitled to being paid damages. Who is at fault in such matters? Attorneys who push these frivolous lawsuits should be disbarred permanently.

    This gentleman was a model citizen. Although the cameras don't show the moment he was unnecessarily killed, he did text his family's wrongful death attorney to inform him that he had his left hand up to surrender, and his right hand on the steering as he tried to escape and assured the lawyer he was not reaching for his loaded gun at any time. He will be remembered by the fellow philanthropists, aspiring anthropologists, rank and file Archbishops in training, the poverty alleviation officer appointed to help him as well as his Mercedes service adviser.

      You don't need a permit for a gun in NC unless you want to conceal carry. The gun was in plain view so not illegal. Loaded or not is irrelevant. Now, resisting arrest and then going for said gun will get you shot. The mother could not be charged with anything in this case either.

    "Inspire Change" - The one good change is that you have a gun totting thug off the street. All he had to do was to put his hands up and surrender, what is so difficult about that. Was the handgun that he had legally purchased and was he allowed to have it with him. If he had been previously convicted of any felonies, the answer is no.

      It seems like they spent quite a bit of time to find out when and how to arrest him and just look at the amount of officers they had to do this. Seems like they could have caught him a lot easier than spending all of these resources to put a lot of people in danger.
