- The disgraced Hollywood mogul Harvey Weinstein's 2020 rape conviction has been overturned by New York's top court, on the basis that he did not receive a fair trial.
The New York Court of Appeals found that prosecutors were allowed to call witnesses whose accusations were not part of the trial.
The ruling said that meant he was tried on past behaviour and not solely on the crimes he was charged with.
Weinstein, who is now 72, will remain in prison for a separate conviction for rape. He
denies the allegations from Ashley Judd.
The New York court reached its decision on Thursday.

Lazy prosecutors should have presented a solid case. They had to have know this could have been overturned. Hopefully there are enough good cases to keep him locked away.

You're negating that he was also convicted of raping another Woman and that conviction was not vacated, he's still in prison for that conviction... the only reason he's getting another trial on this one is because he supposedly had an inept defense attorney for this 1 case.

The guy is still in jail. The successful appeal in NY doesn’t mean to say he was innocent of the crimes there. The conviction was rightly overturned based on the issue of probity and to ensure due legal process, which apparently the original prosecution did not follow. Judge and prosecutors from the original trial should pay for the costs of any retrial. Either way the defendant will stay in jail and likely die there.
