in light of the extremely contentious politicization of the judicial selection process, there is absolutely no doubt that my irreparably shattered faith in this country's political institutions will never be rectified. As a matter of fact, i would truly like to punch a one-way ticket to Canada.

Being a Supreme court Justice is certainly not for me at all. Can anyone imagine if the US President Democrat or Republican selected and nominated me to become the next supreme court justice? Well even if that did happen, I would sincerely hope and pray that during the confirmation hearings that every US Senator on both sides would be kind, understanding and respectful and not verbally attack me and not question me and my personal beliefs.

Best part was Joe Biden asking- literally just after Bork explained why the 4th Ammendment made the Connecticut statute in Griswold, absurd- "what if they had (a warrant) from a wiretap?"
You know....to search for contraceptives/ overhearing use of contraceptives. But what if they were drug dealers?
"Well we didn't find any cocaine, but we did find these, JIMMIES!"
    Thank you Joe Biden.

If you’re arguing that Bork marked the first time politics influenced SCOTUS nominations, let me invite you to take a tour of the Johnson-Nixon years.
LBJ's nomination to replace Earl Warren was filibustered by a bipartisan coalition of conservatives. Two of Nixon's nominees were rejected as well.
1968-70 was *much* more contentious than 1986-87.
But yes, Bork something something changed everything something something.

It's amazing how people still defend Reagan's choice, Bork, considering that Bork executed the Saturday Night Massacre.

Officially, Gerald Ford excluded Bork as a replacement for William O. Douglas in 1975 for his role in the Saturday Night Massacre. Ford did admit though that Bork would have been rejected by the Senate.

I can't help but think the supreme court is the least inspired part of our speration or powers. Nominating judges becomes so insanely political because of the outrageous "serve for life" rule. I understand the intent, but the same objective could be accomplished by granting them long terms, say 12 years so they will have to serve at least two presidents. That is still quite long but not so long that a court could be completely out of step with the prevailing views of the country. It's not inconceivable that could get a block of like minded judges appointed within 10-12 years of each other who, if relatively young, could serve for 30+ years. I mean, imagine if during the civil rights era 5 judges all strongly in favor of segregation were elected and stayed on into the 1980s-90s and refused to budge on that issue. There would be no recourse.
And also, Mitch McConnell not even willing to hear Obama's nominee with year left in office, literally 25% of that term, was perhaps the best (or worst) example of how disgustingly obstructive the republicans have become. I have no doubt that, had Clinton won, they would not hear her nominee for her entire term. There were republicans who said as much.
This all underscores the necessity for a limited term.

Blame liberals they started stacking the 240 year court in the 1960's.

    • @guodade2239
      @guodade2239 4 роки тому

@@MattBiden Actually, Republicans started attacking the Court because they saw its decisions as activism AND because opinion polls showed many major Warren Court decisions as exceedingly unpopular. ‘Engel v. Vitale’, outlawing prayer in public schools, was opposed six-to-one in one opinion poll. To be fair, FDR attacked the Court in the 1930s, and election results suggest its decisions striking down the New Deal were as unpopular as ‘Engel v. Vitale’, but no opinion polls were ever taken back then. Nor were opinion polls taken even on ‘Brown v. Board of Education’, although it was resisted as ‘Engel’ and the New Deal cases were not.

@@guodade2239 That's because it was activism. Nothing the in the constitution says you have the right to gay marriage, take guns away or have an abortion.

Mockingbirds are a group of New World passerine birds from the family Mimidae.
They are best known for the habit of some species mimicking the songs of other birds and the sounds of insects and amphibians, often loudly and in rapid succession and for being extremely territorial when raising hatchlings. Studies have shown the ability of some species to identify individual humans and treat them differently based on learned threat assessments.
