With the Gov online form there is a box to tick if one of the parties wishes to apply to the court to make a Financial Order. Is it important that at least one of the parties ticks this so they can eventually, as part of the whole process apply for a Financial Settlement Order/clean break as part of the Consent Order?
We have a Joint Application going through and are at the Application to apply for a Conditional Order stage (having waited the 20 weeks) and we have the option to remove that one of the Applicants (myself) will be applying to the court for a Financial Order.
Should I not have ticked this box at the start and just include within the Consent Order the application (from us both) for a clean break Financial settlement order, because we both agree that all the finances have been sorted between us both and will be saying this in the Consent Order. I’m just concerned about the online form to be able to move on. Do I remove the application for a Financial order? Thank you
