  • Proximate cause is an essential element to every tort. Someone who is the actual cause of an injury might escape liability if they are not the proximate cause of the injury.

    Today I want to discuss proximate cause, which is sometimes called legal cause. In every tort, a plaintiff must prove that the defendant was not only the actual cause of the injury, but also the proximate cause.
    Proximate cause requires the plaintiff’s harm to be a reasonably foreseeable consequence of the defendant’s wrongful act.

    Great video. This topic can definitely be somewhat tricky when talking about causation in criminal law ie actual & proximate cause.

    This was very helpful and concise. The flaming rat case was really useful and memorable, I won't forget it!
    It would be great to get a video just on superseding events (criminal, foreseeable criminal, act of nature, etc.), also some other requests would be rescue doctrine, and shifting responsibility.

      The flaming rat is from a published opinion-I can’t make this kind of stuff up. I know it is weird. But it shows that the manner of harm isn’t relevant, as long as the type of harm occurred.
