You are correct, it is not illegal to seek asylum in America but it is illegal to cross the border illegally period. Apply for it like the law states.
My understanding is that by international law that we have accepted by treaty is that asylum seekers need only set foot on our territory and turn themselves over stating they are seekers... it's LEGAL.
