Have a little patience. This is typical pre-trial prep in any criminal case, and both sides believe firmly in their positions, which means a Judge's rulings are necessary. The trial will start on the set date. But you are right. The legal wrangling till the end of the final sentencing will no doubt be quite a substantial time frame. Proceedings will begin on that date thou.
Have you been paying attention to any of the hearings? There is so much evidence to parse through, 51TB of data was given to the defense to go through and the state dragging their feet handing over discovery has shown in the last hearing that being completely finished by September 1st and 15th was just not possible for either side.
Speedy trial is double edge sword. Force the prosecutors to get on with case and witnesses etc but defense must also be ready to defend client just as rigourously. Too bad i was really waiting for this one in October.

I haven't been following the case much lately. So, I'm not sure if these questions were answered. But I was wondering, did investigators ever search to see if his phone had been in the vicinity of the victims' apartment any time after the day of the crime? I know he went back to the area a couple of hours after the crime. But if he didn't go back anymore, that would be very telling. I also wonder if investigators asked residents in the area if they knew Kohberger. If no one knew him, then he wouldn't have a reason to be there. But it was definitely something there that kept bringing him back.
The PCA states his phone stopped pinging over there after the murders. No one over there knew him. He was totally new in WA, the murders happened in ID. He moved there last week of June. Officers say his phone started pinging over there in August.
It was wise for the defence to take as much time as they could to prepare their defence of Bryan, given the irritating reluctance of the prosecution to turn over everything the defence needed, the off-hand dismissal of the investigation into the DNA of the three males found at the crime scene, and the importance of this as a capital punishment case. I felt pleased, though, that my years of trying to figure out what Bob Dylan was singing has helped me considerably in understanding what people inside the courtroom were saying in spite of the disruptive typing.

In view of the fact that he was an insomniac, I thought he was either awake in his apartment on his own, or he was driving around, as many insomniacs do, especially in a country that is not often pedestrian-friendly, such as the US. That was why his lawyer said she would try to establish that he was not at the crime scene during the trial, by means of cross-examination of witnesses and experts.

No he waived his own right to a speedy trial. The Judge asked him repeatedly if he was sure this was what he wanted to do and he kept saying yes. Then he signed the waiver agreeing to the delay of his speedy trial rights.
Yes I know that the attorneys coached him to do it. I believe it's 60 or 100 days for speedy trial. You never waive time . Time starts on charge date which was I. Jan sometime. They the prosecution could not get it done in 60 days. But now after all this time they are doing this. The witness changed her mind on what she signed off on the Affadavit. FBI needed to clarify to keep the record accurate and was requested to do so by the State .

They didn't bully him. His attorney was doing something illegal which was trying to put stays on a speedy trial. The Prosecution called this out, because putting a stay on a speedy trial means he's automatically acquitted if the stay runs past 6 months.

This is the fault of prosecutors/cops that they did not supply defense team with all requered materials , with Grand Jury transcripts , with all autopsies reports, and with other 3 males DNA test results (found at the crime scene) which Idaho lab is hiding during 7 months..

October 2nd is too soon to have a quadruple trial for a homicide case that dingles the death penalty over one’s head-a wise move for the defense and the defendant. You want to be as prepared as possible in a case like this because, if you are found guilty, you’re on death row for years in a single-man cell and locked down for 20 to 23 hours a day. Appeals take years. Also, the clicking sounds were distracting, I could understand the proceedings.

The question is why Vargas would have told other geneticists this? There are electronic communications between her and others admitting this. It was the first time she ever has ever testified in court and probably felt pressured to make the defense happy. Why did Ms. Larkin provide an affidavit but Vargas only a declaration? I don’t think she was forced to sign the declaration but considering the defense only filed her declaration at the very last minute only one day before the hearing she probably felt pressured to sign it so that the defense could get the filing in so her testimony would be allowed at the hearing. There is also no need or benefit for anyone to intimidate a witness AFTER the fact. She will not be testifying at trial because the IGG isn’t even admissible as evidence at trial. The prosecution really gains nothing by getting her to recant testimony. You can’t just submit misleading documents and testimony to a judge in a capital murder case without repercussions.
If at first you don't succeed, try another diversion. Well, the defense is yet again to get their way with a delay of trial. The victims' families will have to endure the open wounds for a while longer. ALL the diversion in the world won't delay JUSTICE! BK WILL be called to face the JUST verdicts and the JUST punishment, and eventually Eternal Justice by the HIGHEST power! Eventually justice will win out the victims and their families will receive closure. God Bless the victims' families and BK's family (because they too are victims)

@@mimi7914Gabriella Vargas was the Investigative Genetic Genealogy, IGG, expert that the defense brought in as a witness to prove that the DNA information they requested from the prosecution is both relevant and needed in order to adequately defend BK. The defense is now complaining that after testifying in court, two FBI agents turned up at GV’s house to interrogate/intimidate her.
Prosecution gets only one chance with doing a complete investigation there's no room for screw ups. If they don't the consequences are severe..

I haven't been following the case much lately. So, I'm not sure if these questions were answered. But I was wondering, did investigators ever search to see if his phone had been in the vicinity of the victims' apartment any time after the day of the crime? I know he went back to the area a couple of hours after the crime. But if he didn't go back anymore, that would be very telling. I also wonder if investigators asked residents in the area if they knew Kohberger. If no one knew him, then he wouldn't have a reason to be there. But it was definitely something there that kept bringing him back.

The PCA states his phone stopped pinging over there after the murders. No one over there knew him. He was totally new in WA, the murders happened in ID. He moved there last week of June. Officers say his phone started pinging over there in August.
It was wise for the defence to take as much time as they could to prepare their defence of Bryan, given the irritating reluctance of the prosecution to turn over everything the defence needed, the off-hand dismissal of the investigation into the DNA of the three males found at the crime scene, and the importance of this as a capital punishment case. I felt pleased, though, that my years of trying to figure out what Bob Dylan was singing has helped me considerably in understanding what people inside the courtroom were saying in spite of the disruptive typing.
HAHAHAHAHAHAHA. Right?!?! Well the DNA that they didn't investigate now stands as very solid reasonable doubt for the defense...I think it was a bad move but it's their "funeral".

I knew from the start that Bryan did not have a solid alibi, otherwise he would've been released a long time ago, or he maybe would not have been arrested at all. I thought expecting an alibi at 4 a.m. from anyone would be a tall order, let alone from someone who was a loner and was living on his own. In view of the fact that he was an insomniac, I thought he was either awake in his apartment on his own, or he was driving around, as many insomniacs do, especially in a country that is not often pedestrian-friendly, such as the US. That was why his lawyer said she would try to establish that he was not at the crime scene during the trial, by means of cross-examination of witnesses and experts.

No he waived his own right to a speedy trial. The Judge asked him repeatedly if he was sure this was what he wanted to do and he kept saying yes. Then he signed the waiver agreeing to the delay of his speedy trial rights.
Yes I know that the attorneys coached him to do it. I believe it's 60 or 100 days for speedy trial. You never waive time . Time starts on charge date which was I. Jan sometime. They the prosecution could not get it done in 60 days. But now after all this time they are doing this. And I'm not siding with him btw.but if they don't protect his rights then they won't protect yours. Something doesn't add up

@@janinedevilliers510That's what depositions are for. It's very rare that FBI or any law enforcement contact a witness in a trial after they have given a deposition. That's bordering on witness tampering or intimidation. They are giving this guy the best chance anyone had at an appeal

The witness changed her mind on what she signed off on the Affadavit. FBI needed to clarify to keep the record accurate and was requested to do so by the State .

They didn't bully him. His attorney was doing something illegal which was trying to put stays on a speedy trial. The Prosecution called this out, because putting a stay on a speedy trial means he's automatically acquitted if the stay runs past 6 months.

This is the fault of prosecutors/cops that they did not supply defense team with all requered materials , with Grand Jury transcripts , with all autopsies reports, and with other 3 males DNA test results (found at the crime scene) which Idaho lab is hiding during 7 months..

October 2nd is too soon to have a quadruple trial for a homicide case that dingles the death penalty over one’s head-a wise move for the defense and the defendant. You want to be as prepared as possible in a case like this because, if you are found guilty, you’re on death row for years in a single-man cell and locked down for 20 to 23 hours a day. Appeals take years. Also, the clicking sounds were distracting, I could understand the proceedings.
I agree, I was shocked when they announced the trial would start October 2nd. I honestly thought it wouldn't start until late 2024 at the earliest, maybe even later than that.
It doesn't matter. If the evidence is overwhelming, he will be found guilty no matter if it's speedy or not. He's still locked up, so life won't be much different.

The question is why Vargas would have told other geneticists this? There are electronic communications between her and others admitting this. It was the first time she ever has ever testified in court and probably felt pressured to make the defense happy. Why did Ms. Larkin provide an affidavit but Vargas only a declaration? I don’t think she was forced to sign the declaration but considering the defense only filed her declaration at the very last minute only one day before the hearing she probably felt pressured to sign it so that the defense could get the filing in so her testimony would be allowed at the hearing. There is also no need or benefit for anyone to intimidate a witness AFTER the fact. She will not be testifying at trial because the IGG isn’t even admissible as evidence at trial. The prosecution really gains nothing by getting her to recant testimony. You can’t just submit misleading documents and testimony to a judge in a capital murder case without repercussions.

The victims' families will have to endure the open wounds for a while longer. ALL the diversion in the world won't delay JUSTICE! BK WILL be called to face the JUST verdicts and the JUST punishment, and eventually Eternal Justice by the HIGHEST power!
