I'm from the Philippines. Is there a way of acquiring Spanish citizenship thru Golden Visa BUT avoid becoming a Spanish Tax Resident? For example, I learned that for Spanish citizenship-by-descent, the residency requirement is that you cannot be outside Spain for more than 3 months. So I can stay in the Philippines for 3 months, go back to Spain and stay for a few days then go back to the Philippines again and stay for 3 months, then go back to Spain again, and so forth. This will not trigger tax residency since I am not staying in Spain for most of the year. Is this also doable for Spain Golden Visa?
Hi. As a Filipino, you can pursue Spanish citizenship through the Golden Visa, but avoiding tax residency while meeting residency requirements for citizenship is challenging. The Golden Visa allows you to reside in Spain without a minimum stay, avoiding tax residency (triggered by staying over 183 days/year). However, citizenship via the two-year rule requires "effective residency," meaning you must spend most of the year in Spain, with absences not exceeding three months. Your proposed strategy of staying under 183 days/year won't meet the effective residency requirement for citizenship. If avoiding tax residency is your priority, you can maintain the Golden Visa without pursuing citizenship. Enquire with us for more personalised advice: holbornpass.com/country-programme/spain/
@@HolbornPass Thank you for your reply. I was interested in getting the Spanish passport, just the passport, not interested in living outside the Philippines. I also absolutely do not want to become a tax resident of any european country.
