I am a Fil-Am living here in TX but my heart is still in the Phil and I am so proud of PBBM. There has been no other Phil presidents that has opened the eyes of the world leaders about the strategic importance of the Phil in Southeast Asia in the maintenance of the free maritime travels until now. PBBM is the only ASEAN country President that has advocated the joint efforts of the different countries to see to it that China does not dominate the South China Sea.

Why the Phillippines failed to follow it? United Nations Convention on the Law of the Sea (UNCLOS). ANNEX VII. ARBITRATION. Article 5. Procedure. *Unless the parties to the dispute otherwise agree,* the arbitral tribunal shall determine its own procedure, assuring to each party a full opportunity to be heard and to present its case. China's position is not unique and is in line with some Western countries. China *declared that it does not accept any of the compulsory dispute settlement procedures for all categories of disputes listed in Article 298(1)(a-c).* This means China has opted out of using ITLOS, ICJ, and arbitration for these types of disputes with other UNCLOS parties. However, their declaration does not preclude them from agreeing to other non-compulsory methods of dispute settlement on a case-by-case basis.

Did the US arrange and pay for the Tribunal? Did the US source for the arbiters that had to be mutually acceptable to both parties? You can see that it's a US initiative to weaponise the Tribunal to prevent bilateral negotiation between the two contending nations.
Remember that these territorial disputes in the SCS are not just with China but between Asean members too, e.g. between Philippines and Malaysia over Sabah.

Hague Tribunal-UNCLOS, already settled it by a ruling in 2016.
- Whether China likes it or not, the ruling is final and legally binding.
Not legal binding as China didn't participate. It was U.S. that persuaded and sponsored the Philippines.
One thing about this Hague Tribunal-UNCLOS was it was filled by anti-Chinese arbitrators like Japanese and Westerner judges. The man in charge didn't recuse himself when exposed as a close friend of Shinzo Abe. Most importantly China had already informed them it will not accept the outcome.
So no case at all whether Philippines likse it or not.
