- There's been mixed reaction to the nomination of MK Party Chief Whip John Hlophe, to sit on the Judicial Service Commission.
The impeached former Western Cape Judge president is accused of trying to influence Constitutional Court justices, in a matter pertaining to former president Jacob Zuma.
Judges Matter researcher Mbekezeli Benjamin and African Legal Practitioners Association chairperson S'the Mbhele discuss this further.

The Constitution in Section 178 is silent(moot)in this regard.The impeachment of Dr Hlophe was political and unfortunately and unfortunately the MKParty used a legal loophole in the Constitution to push a political matter.
His impeachment made him not a judge anymore and section 47(1)of the Constitution provides that every citizen who is qualified to vote for the National Assembly is eligible to be a member of the National Assembly and if his party feels that he is the person to serve their interests in the JSC,why not?
It is a matter of morality and unfortunately in Law,there's that thin line,as values,morality and religion are not necessarily embraces by Law.

Someone had a case to answer that this was established, but an independent panel, that person was elected, and he has also appointed other people. Why is that Benjamin so skew?

The Judicial Service Commission must prioritize maintaining the highest ethical standards and protecting the integrity of the judiciary above all else.
