If someone is approved for disability retirement at age 40, and is fortunate enough to find a job in the private industry earning 80% of his federal income, would it be allowed for his private industry income to increase, with raises and promotions, etc? Or can it never exceed 80% of what his federal income was?
While working in the private sector, you cannot exceed 80% of your previous federal position's CURRENT salary. So if that position receives increases or raises the amount you can earn while working in the private sector will increase. The OPM will perform income reviews to ensure you do not exceed this cap.
Yes, you can apply but it is important to note that EEOC resolutions/ADRs should be reviewed to ensure they do not directly contradict the disability retirement application.
A valid reassignment must be within your commuting area. If your agency offers you a reassignment that does not fall within all of the OPM's qualifications, you do not have to accept it and your Federal Disability Retirement case will not be affected. If you are looking for a different job that you will be able to fully perform, then you will not qualify for Federal Disability Retirement.

If you are a federal law enforcement officer, does the reassignment salary have to match your salary with LEAP or just the basic salary?
LEAP pay should be considered in a reassignment search if that is included in your current pay level.
