Simple accounting means we pay a service provider (ie. Agents) a fee irrespective of taxes hence if you represent the player they are responsible or club if they hire the agent. Agents are nothing more that spin doctors and should not be allowed to give legal/financial advice without being accredited. For example, I cannot be a financial broker and give financial advice without passing my fiduciary assessments which makes Sky's argument invalid on "expert" advice then.
This discussion needs to start from the identification of what is/are the problem(s) that need to be solved. My suggestion is that the problem is the capacity of agents to manipulate the clubs and players to their financial gain, has gone out of control, This lack of regulation is taking huge amounts of money from the game, dictating to a large extent which players go where, creating hyperinflation of transfer fees and player salaries, diminishing player loyalty, taking away the obligation to perform, and destroying some clubs. Of course the clubs themselves need to question their modus operandi. But right now they are at the mercy of agents and the power that they have, and the obsession/financial neccessity to succeed.

If the club pay 110 mio to the player and the player pay 10 mio to their agent, it's taxated more than if the club pay 100 to the player and 10 to the agent because the 10 mio to the agent only gets taxated once when it's directly from the club. It's all about tax evation. The club doesn't realy care for them it's 110 mio out either way.
Restraint of trade clauses do exist though and can be perfectly legal (dependant on how they are shaped and what their purpose is, including the clause being necessary for the good of the industry)

If Sky had told Simon that Christmas is on 25th December Simon would have agued that it’s not and Sky doesn’t know what he’s talking about.
There are a lot of unscrupulous agents who act only for themselves and cause division (which is a point a wholeheartedly agree with Simon on) but Sky is not one of them, for him to be treated with such disdain by Simon is completely out of order.
