Who Makes Money From Bail?

  • When someone finds themselves in jail, they can often gain their freedom while they await trial by posting bail. But even small bails amounting to just $500 or $1,000 can prove unaffordable for many. In fact, 40% of Americans say they could not afford an unexpected $400 expense, according to the Federal Reserve. Bail bonds offer a way out. Bond companies will post bail for defendants in exchange for a fee of about 10-15% of the total bail amount.

      Wait, so what do you want? You want people to stay in jail? In Japan, you stay in jail for upwards of a month. I find it so funny that the same people are accuse the police of wrongly arresting people also fight to end the same system that gives them the right to get out of jail by a cash payment which can be paid off with a payment plan.
      The issue isn’t the bail system. Stupid arguments.

    I find it odd that, even if you are found innocent your life still can be ruined. Either by paying the bails bondsman money you can't afford to pay or rotten in jail to eventually lose your job.

      hotu While I agree with bail in principle, I disagree with profiting from bail (or more specifically, fees for bail bonds; I find it morally objectionable that one should permanently lose any amount of money, no matter how small, due to an indictment in itself).
      The state could do the exact thing bond agencies do - mitigate risk through ankle monitors, regular checkups, etc. less risk = less bail; and mitigate cash bail by accepting collateral (collateral is only a problem for a person who *intends* to skip bail). Then you could have bail as low as $300 (which would, of course, be returned to the defendant upon verdict, guilty or not - instead of a $300 bond fee which isn’t returned) while also maintaining the integrity of the system, with a powerful deterrent against bail slipping - losing a house/car. The only problem is the state would need to absorb the costs of monitoring, foreclosing on collateral, auctioning, wages for officers who would conduct regular checkups, etc., presumably using taxpayer money.

And in some cases you may have to put up $2000 or $20000 that you don't get back for bail. Both could ruin the average non rich person. @DAndyLord 4 роки тому +10

      @Anonymous Panacea What is a surety?
      A surety is a person who comes to court and promises to a judge or a justice of the peace to supervise an accused person while they are out on bail.
      A surety also pledges or promises an amount of money to the court by signing a type of bond called a recognizance. By doing this, the surety risks losing some or all of the money they have promised to the court if the accused doesn’t follow one or more of the bail conditions or fails to show up to court when required.

    The CORE problem is when authorities (police, district attorney, etc) arrest and acuse people without having proof of their alleged crimes, and judiciary system agreeing to keep them locked up for no reason for any amount of time while technically being not guilty. If State would have to pay their own "bail" to people proven to be found not guilty (equivalent to their job income for the time they were in jail, attorney fees, etc) for rhe time they were wrongly acused and arrested, they would be a lot more careful and try not to put randow people in jail damaging their personal reputation and overall consequences explained in the video. For a country that claims to be "the best in the world" learning more and more about how it actually is and how it actually works and not how it sells itself is really disappointing.

Given the ridiculously high numbers of wrongful, illegal, or "insufficient evidence to prosecute" arrests that occur in the US, the number of persons released that are actual criminals should be minimal. The study has been taken out of context and exploited by the media and politicians trying to lie to Americans to gain support. It's sad that both parties are so willing to make up statistics instead of telling the truth. This article explains it though if you haven't looked it up already.

    In LA county you sit in jail for two days (longer if it’s a weekend or holiday) before you go to arraignment. Once you’re arraigned the majority of the time you are released on your own recognizance (OR) by a judge and given another court date, unless the crime you are accused of is a real violent crime, there is reasonable suspicion that someone will get hurt, not show up for court, or the crime will continue. You can also get released on OR prior to going to arraignment court if the arresting officer or their supervisor approves it unless one of the prior reasons are present. There is also a bail review service provided by the court that can override the police supervisor’s decision not to release someone on OR or they can lower that persons bail.

    My bail was set to $30,000 for failure to apear on a old tinted window ticket in California. I awaited for arraignment a whole week because I couldn't afford the $3,000 they needed to get me out. Finally when i see the judge he tells me it was past the SOL and let me go. So I'm definitely against bail bonds

    • @Addlibs
      @Addlibs 4 роки тому

      You don’t need to attend court for a ticket unless you’re contesting it (ie refusing to pay it), or unable to pay. The 8th amendment forbids excessive bail - I’m sure your bail would’ve been lower if you showed up and inform the judge of your salary.

    My brother was caught selling drugs, and he was mailed and bail set to 20,000$ and even that short time in jail ruined his life. We eventually got it down to 2000$ and got him out. But in the 2 and a half weeks in jail he lost his job and his apartment and the car he had was towed for being an abandoned vehicle.. he hasn't even had his trial yet and it's been 6 months since his arrest. And that short period in jail when he's technically innocent ruined his life. And to only imagine if he would still be in jail waiting ? It's a ridiculous for profit system that ruins people's lives

  • @davenyx9249
    @davenyx9249 4 роки тому +3

    You're kind of forced to post bail because they can set your arraignment date 6 weeks from the time you get booked. So because you can't get a public defender until that date, you end up opting for bail. Such a great system!!!

    11:30 he said if they had grounds Id think they would be suing us right now. That’s a bunch of bs! If a defendant has to go to a bail bonds to begin with, it’s usually because they can’t afford to just bond out on their own and if that’s the case you can also assume they can’t afford a lawyer to take a bail bonds company to court to sue and do that while juggling their current case. It’s the perfect industry to get over and justify why the rip off goes on if they even admit to that, but it’s in their contracts in fine fine print way at the back or deep in the middle of all the paperwork work one signs with these people. This shouldn’t be legal. It leaves so much room for abuse with your freedom at stake. 300$ extra because you didn’t have enough for just that expense but covered the bond and looking at Jail when it wasn’t even a condition required by the courts then ripping off the person that comes to pay it just because you can, that is discussing! Are we in Ukrainian???? Or some 3rd world where citizens are fired to pay up or else. The only difference here is full blown business and contracts are made up around such scams but to me don’t make them any more damn legitimate!!! They just happen to be in a business that’s sue proof and they know their clients can’t afford to sue them or they wouldn’t need their services to begin with.

  • @owen-nd7om
    @owen-nd7om 4 роки тому +1

    If you pay your bond yourself you will get all of your money back after you attend all of your required court dates and if you go through a bail bondsmen you will have to put like 10% down or use some sort of collateral for the bail bondsmen to pay your bail. Same thing again if you show up to all of your court dates you get most of your money back after the bail bondsmen takes his fee.

      the bond industry profits vulgarly while their powerful lobbies fight against any laws that prohibit "cite in lieu of continued custody" and other reasonable checks and balances for establishing fair bail or determining flight risk by an unbiased member of the judiciary and other related issues. So the local BAR associations profit as does our judicial branches.
      The shorter answer is, the accused DOES NOT PROFIT ONE BIT and none of the hot-shot defense attorneys will initiate and advance torts for any outrageous violations of any defendant's civil rights unless somebody is dead or in a coma, or, enough political pressure is offered by an outraged public.
      There must be a high probability for sensational media coverage and exposure that props up any such advocate.
