Then you could have bail as low as $300 (which would, of course, be returned to the defendant upon verdict, guilty or not - instead of a $300 bond fee which isn’t returned) while also maintaining the integrity of the system, with a powerful deterrent against bail slipping - losing a house/car. The only problem is the state would need to absorb the costs of monitoring, foreclosing on collateral, auctioning, wages for officers who would conduct regular checkups, etc., presumably using taxpayer money.

And in some cases you may have to put up $2000 or $20000 that you don't get back for bail. Both could ruin the average non rich person. Because both system of a state defense (public defender and bar lottery) either don't care or can't afford to pay for a proper defense.

Where I live, if the Police wants to keep a suspect in custody during trial, they've to prove to a judge that the person is a risk to society or might tamper with evidence or witnesses. If the Police can't prove their case, they've to let the suspect go.

There was one bailbondsman l remember that called me. He stated he was right across the street, had a talking plant, had an obsession with walnuts, stated he was an ex felon(he should be fired??) very racist, and rude. I personally think he was drunk at the time but very unprofessional!
The CORE problem is when authorities (police, district attorney, etc) arrest and acuse people without having proof of their alleged crimes, and judiciary system agreeing to keep them locked up for no reason for any amount of time while technically being not guilty. If State would have to pay their own "bail" to people proven to be found not guilty (equivalent to their job income for the time they were in jail, attorney fees, etc) for rhe time they were wrongly acused and arrested, they would be a lot more careful and try not to put randow people in jail damaging their personal reputation and overall consequences explained in the video. Just for One, to be Crystal clear, again, these people are not in jail for Absolutely no reason. At the Very least they have been suspected of something that warrants, no pun intended, their incarceration for the safety of the community and/or a serious enough infraction to warrant incarceration. Whether someone is a flight risk number one, or number two, a danger to the community are the two main considerations that judges in magistrates take into consideration when determining bond amounts and whether that person is safe enough to allow back into the community anyway, or, dangerous enough to lock up and throw away the key until they're sentenced. Happened to me in Texas. They came to my house for smelling "marijuana" which was actually legal hemp.So they used probable cause to search my apartment then charged me with possession of marijuana and a controlled substance (that was actually drywall) I stayed in jail for 5 1/2 months before seeing a lawyer or going to court. When I got to court they said if I just plea guilty I'll be released. The court appointed lawyer basically coherced me into doing it. I lost my social, birth certificate, highschool diploma and anything of value. They really know how to break you down.

What's even crazier is that you can't post your own bail even if you have you have actual cash (and/or a CC or debit card) on your person. They confiscate your personal belongings when you're arrested leaving you no option other than being bonded out. And bail for misdemeanor charges are more like $1000-$5000

In LA county you sit in jail for two days (longer if it’s a weekend or holiday) before you go to arraignment. Once you’re arraigned the majority of the time you are released on your own recognizance (OR) by a judge and given another court date, unless the crime you are accused of is a real violent crime, there is reasonable suspicion that someone will get hurt, not show up for court, or the crime will continue. You can also get released on OR prior to going to arraignment court if the arresting officer or their supervisor approves it unless one of the prior reasons are present. There is also a bail review service provided by the court that can override the police supervisor’s decision not to release someone on OR or they can lower that persons bail.
My brother was caught selling drugs, and he was mailed and bail set to 20,000$ and even that short time in jail ruined his life. We eventually got it down to 2000$ and got him out. But in the 2 and a half weeks in jail he lost his job and his apartment and the car he had was towed for being an abandoned vehicle.. he hasn't even had his trial yet and it's been 6 months since his arrest. And that short period in jail when he's technically innocent ruined his life. And to only imagine if he would still be in jail waiting ? It's a ridiculous for profit system that ruins people's lives
Best reason to plead guilty is because we all know you got caught and you want a reduced sentence or like myself got have loads of charges just knocked away so you only get 1 charge.

My bail was set to $30,000 for failure to apear on a old tinted window ticket in California. I awaited for arraignment a whole week because I couldn't afford the $3,000 they needed to get me out. Finally when i see the judge he tells me it was past the SOL and let me go. So I'm definitely against bail bonds
You don’t need to attend court for a ticket unless you’re contesting it (ie refusing to pay it), or unable to pay. The 8th amendment forbids excessive bail - I’m sure your bail would’ve been lower if you showed up and inform the judge of your salary.
If you pay your bond yourself you will get all of your money back after you attend all of your required court dates and if you go through a bail bondsmen you will have to put like 10% down or use some sort of collateral for the bail bondsmen to pay your bail. Same thing again if you show up to all of your court dates you get most of your money back after the bail bondsmen takes his fee. The US is a messed up state. They should at least repay the bail if found innocent. It may not be a very thorough alternative, but it's heck better than the status quo.
You're kind of forced to post bail because they can set your arraignment date 6 weeks from the time you get booked. So because you can't get a public defender until that date, you end up opting for bail. Such a great system!!!

I think some of you are either missing the point or overlooking one little point. How did you get in the position to even need a bond in the first place. Chances are you were arrested. If you were arrested you probably did something really dumb (you broke the law). If you break the law you forfeit a certain amount of liberty, you go to jail. You blew it, you pay the consequence/s. Bail provides you the option to pay for freedom (temporarily). You still have your day in court. So for me, don't break the law. I have _never_ been concerned about bail because I strive to learn and obey the law. That is your duty. So all this other stuff about being poor or making money on bonds is just noise. If you obey the law bail doesn't matter. Now, if you skip bail, all bets are off. They will find you. If a bail service abuses its trust, then shame on them. It will catch up with them.
And still today officers are not held accountable for locking people up wrongfully. It gets dismissed and they move on to the next one who can't pay and settles for a guilty plea. When are we finally going to make police officers insure themselves for liability? Then the insurance company could get rid of the bad cops by not covering them. No insurance, no operating, just like my driver's license.

The bail industry is a horrible and shady. For normal people there should be zero bail. If a defendant has not appeared in a previous case in the last 10 years then I think bail is fine because they are a risk. Most people not showing is NO real risk so there is absolutely NO reason there should be bail. If they do not show at court then a warrant can be issued and they can be picked up. Charging bail is just a way for the state to coerce the defendant to plea. The state can drag their feet and if you do not plea eventually they can just drop the case otherwise they make you be in jail. It is not even close to a fair system. You have not been convicted at all. Judges are at least partly to blame because they set bail. They have the power to not set bail. They are actually making you pay a fine before you are convicted and if you can't pay the fine you go to jail.

There was one bailbondsman l remember that called me. He stated he was right across the street, had a talking plant, had an obsession with walnuts, stated he was an ex felon(he should be fired??) very racist, and rude. I personally think he was drunk at the time but very unprofessional!
The CORE problem is when authorities (police, district attorney, etc) arrest and acuse people without having proof of their alleged crimes, and judiciary system agreeing to keep them locked up for no reason for any amount of time while technically being not guilty. If State would have to pay their own "bail" to people proven to be found not guilty (equivalent to their job income for the time they were in jail, attorney fees, etc) for rhe time they were wrongly acused and arrested, they would be a lot more careful and try not to put randow people in jail damaging their personal reputation and overall consequences explained in the video. For a country that claims to be "the best in the world" learning more and more about how it actually is and how it actually works and not how it sells itself is really disappointing.

Just for One, to be Crystal clear, again, these people are not in jail for Absolutely no reason. At the Very least they have been suspected of something that warrants, no pun intended, their incarceration for the safety of the community and/or a serious enough infraction to warrant incarceration. Whether someone is a flight risk number one, or number two, a danger to the community are the two main considerations that judges in magistrates take into consideration when determining bond amounts and whether that person is safe enough to allow back into the community anyway, or, dangerous enough to lock up and throw away the key until they're sentenced. Let's not let the media get it twisted. What is some more potential truth? I'm assuming that Most people that get arrested are being arrested for a good reason. Am I right? I'm not saying the government doesn't ever hem people up and betray people and stuff, but, there is very often good reasons when people call the police. So No, people aren't "incarcerated simply because they can't afford bail," they're incarcerated because they were being ghetto or arguing with their girlfriend or they shot somebody or got caught with dangerous drugs or something. To be more clear, they're incarcerated because they're getting ready to potentially be charged with a serious crime. (This news station doesnt seem to understand that this isn't a game. Crime is not a game and neither is the blessing of getting 90% of your bond taken care of by a bail bondsman.)Not to over generalize, of course. Happened to me in Texas. They came to my house for smelling "marijuana" which was actually legal hemp.So they used probable cause to search my apartment then charged me with possession of marijuana and a controlled substance (that was actually drywall) I stayed in jail for 5 1/2 months before seeing a lawyer or going to court. When I got to court they said if I just plea guilty I'll be released. The court appointed lawyer basically coherced me into doing it. I lost my social, birth certificate, highschool diploma and anything of value. They really know how to break you down.
It's sad that America preys on the weak. I learned a few things from this, one definitely keep an account for the "unknown"

What's even crazier is that you can't post your own bail even if you have you have actual cash (and/or a CC or debit card) on your person. They confiscate your personal belongings when you're arrested leaving you no option other than being bonded out. And bail for misdemeanor charges are more like $1000-$5000

If a defendant has to go to a bail bonds to begin with, it’s usually because they can’t afford to just bond out on their own and if that’s the case you can also assume they can’t afford a lawyer to take a bail bonds company to court to sue and do that while juggling their current case. The only difference here is full blown business and contracts are made up around such scams but to me don’t make them any more damn legitimate!!! In LA county you sit in jail for two days (longer if it’s a weekend or holiday) before you go to arraignment. Once you’re arraigned the majority of the time you are released on your own recognizance (OR) by a judge and given another court date, unless the crime you are accused of is a real violent crime, there is reasonable suspicion that someone will get hurt, not show up for court, or the crime will continue. You can also get released on OR prior to going to arraignment court if the arresting officer or their supervisor approves it unless one of the prior reasons are present. There is also a bail review service provided by the court that can override the police supervisor’s decision not to release someone on OR or they can lower that persons bail.

My brother was caught selling drugs, and he was mailed and bail set to 20,000$ and even that short time in jail ruined his life. We eventually got it down to 2000$ and got him out. But in the 2 and a half weeks in jail he lost his job and his apartment and the car he had was towed for being an abandoned vehicle.. he hasn't even had his trial yet and it's been 6 months since his arrest. And that short period in jail when he's technically innocent ruined his life. And to only imagine if he would still be in jail waiting ? It's a ridiculous for profit system that ruins people's lives

He really just said the equivalent of "Well everyone else is doing it!" Also, sis' concerns about a rise in crime by the doing away with cash bail, is unfounded; The people in question have merely been ACCUSED of committing a crime. Given the ridiculously high numbers of wrongful, illegal, or "insufficient evidence to prosecute" arrests that occur in the US, the number of persons released that are actual criminals should be minimal. She also seems to be forgetting that there still is going to be a trial and those that are actually guilty will (hopefully) be so found and THEN placed in prison.

My bail was set to $30,000 for failure to apear on a old tinted window ticket in California. I awaited for arraignment a whole week because I couldn't afford the $3,000 they needed to get me out. Finally when i see the judge he tells me it was past the SOL and let me go. So I'm definitely against bail bonds
You don’t need to attend court for a ticket unless you’re contesting it (ie refusing to pay it), or unable to pay. The 8th amendment forbids excessive bail - I’m sure your bail would’ve been lower if you showed up and inform the judge of your salary.
If you pay your bond yourself you will get all of your money back after you attend all of your required court dates and if you go through a bail bondsmen you will have to put like 10% down or use some sort of collateral for the bail bondsmen to pay your bail. Same thing again if you show up to all of your court dates you get most of your money back after the bail bondsmen takes his fee.

The US is a messed up state. They should at least repay the bail if found innocent. It may not be a very thorough alternative, but it's heck better than the status quo.
You're kind of forced to post bail because they can set your arraignment date 6 weeks from the time you get booked. So because you can't get a public defender until that date, you end up opting for bail. Such a great system!!!

I think some of you are either missing the point or overlooking one little point. How did you get in the position to even need a bond in the first place. Chances are you were arrested. If you were arrested you probably did something really dumb (you broke the law). If you break the law you forfeit a certain amount of liberty, you go to jail. You blew it, you pay the consequence/s. Bail provides you the option to pay for freedom (temporarily). You still have your day in court.
So for me, don't break the law. I have _never_ been concerned about bail because I strive to learn and obey the law. That is your duty. So all this other stuff about being poor or making money on bonds is just noise. If you obey the law bail doesn't matter.
Now, if you skip bail, all bets are off. They will find you.
If a bail service abuses its trust, then shame on them. It will catch up with them.

And still today officers are not held accountable for locking people up wrongfully. It gets dismissed and they move on to the next one who can't pay and settles for a guilty plea. The bail industry is a horrible and shady. For normal people there should be zero bail. If a defendant has not appeared in a previous case in the last 10 years then I think bail is fine because they are a risk. Most people not showing is NO real risk so there is absolutely NO reason there should be bail. If they do not show at court then a warrant can be issued and they can be picked up. Charging bail is just a way for the state to coerce the defendant to plea. The state can drag their feet and if you do not plea eventually they can just drop the case otherwise they make you be in jail. It is not even close to a fair system. You have not been convicted at all.
Judges are at least partly to blame because they set bail. They have the power to not set bail. They are actually making you pay a fine before you are convicted and if you can't pay the fine you go to jail.
If the interest rate is down to negative, the rich will invest more on the bail bonds.
