  • Is Florida State about to receive the documents that will contain the smoking gun that will help them break the ACC’s Grant of Rights? A court order in Florida has asked Leon County Judge John C. Cooper to compel the ACC to hand over an unredacted copy of their TV agreements with ESPN. It’s worth noting that this order was jointly agreed by FSU and the ACC. If Cooper signs it, Florida State will get their copy. For FSU’s lawyers, the hope would be to find language in the agreements to back up their argument that the ACC cannot hold on to FSU’s TV rights (until 2036) after they’ve left the conference. Can FSU find their smoking gun?
    Hosts Alex Donno and Kenton Gibbs discuss the significance of this next step. It’s worth noting that Clemson’s lawyers have already obtained an unredacted copy and we are unaware of them finding any loopholes in the language.     Just the fact the ACC doesn’t want it’s member schools to see this document is reason enough to suspect shenanigans. I have zero confidence in the leadership of the ACC. And I’m not an FSU fan or a Clemson fan.

    you haven't heard anything from clemson because they signed strict confidentiality agreements to get those media docs from espn and the acc. clemson isn't going to risk their negotiating position so close to the end game.

    Paying the withdrawal fee to leave the acc releases the school of all obligations. This is from the acc own statements. The gor specifically says members. And the espn agreement. All espn contracts have a gor with the conference. The acc gor was not granting all rights to the acc but instead granted all rights necessary to fulfill the espn contract and is exclusive to the espn contract. Basicly espn owns the gor and media rights the acc does not. So if your no longer a member your not tied to the conference with the espn contract. If the contract is exclusive to the espn contract and that contract does not specifically identify thw member school and instead only list the conference then espn nor the acc maintain your media rights.

      @@tlobrill1 Summary judgment is not filed Willy Nilly. The Clemson lawyers have appeared to be sharp thus far. I mentioned this because obtaining the unredacted version of the contract should not just be dismissed is all. Nothing earth shattering just more “let’s pump the brakes a little bit”. Mostly directed at Kenton. Lol

    MIAMI needs to begin back channel 3rd party talks with ND & the B1G. Opening a door to find a better opportunity for MIAMI is what the school needs to do. Keep in mind, in 2030 the B1G will be approaching $150 M per school where the ACC school will stil be at $50 M maximum.

    What do people expect CU to say. They already said the GOR is rendered toothless once a school.leaves the ACC because the GOR is only for the rights the ACC needs to fulfill the ESPN deal.
    They said the ESPN deal is worded to apply only for teams in the conference not teams that leave.
    We don't know who is right

    If Fsu and Clemson were to leave. The there are multiple Acc teams the P2 would want. No one in the Big 12 is wanted, except maybe KU and Utah..So how would the Acc without those 2 be worse off then the Big 12? They wouldn't, they would still be looking down on the Big 12.

    ESPN has yet to extend the GOR beyond 2027. I don’t see them extending with FSU and Clemson out.

      I don't think he necessarily wants FSU stuck. He just doesn't want the ACC to be destabilized and implode since that'd cause a massive disruption for NCST. Right now NCST football has a chance to be competitive in the ACC. It'll have no chance in the B1G or SEC. And if they stay in a watered down ACC, there probably won't be an automatic bid for the conference and the SOS won't allow them to earn a playoff berth most years.
      To your point, I think his ego is making him take shots at FSU since the school and their fans are loud about their intent. I think he's overlooking that between the two cases, FSU would create a large price tag for any other program if they won. If Clemson wins, then basically the door is wide open for any program who can pay the exit fee.

      @@heartbreak25 you make a good point. I’m ultimately confused by Kenton’s position. On the one hand he says that (1) FSU/Clemson leaving will not destroy the conference bc other schools either cant afford the exit price or do not have a P2 landing spot. Then, he also says that (2) ESPN is unlikely to cancel the ACC contract. But, then says ACC is fighting for its life? I’m confused by this stance. How is ACC fighting for its life if Kenton believes point 1 and 2. Im thoroughly confused by the ACC endgame here. You could have probably gotten $300M from each school if you settle early. Per Kenton, most remaining schools would not be able to pay that. My proposal takes care of all sides.

    If the ACC GOR is broken, the Big 12 GOR can be broken. We already know some teams in the Big 12 want to move.

      The difference is that there's not really many teams in the Big 12 that either the SEC or B1G would want. There's really not many teams in the ACC that they would want either.

    I am a Navy veteran and Roger Staubach played for the Naval Academy and served in the Navy in Vietnam before going to the Dallas Cowboys. Also all three service academies at one time were highly respected and regarded as potential autonomy power schools back in the day and as recently as at the turn of the century into the 2000’s before major changes and not talking about the last five years either. With that said here are the three schools that the ACC should consider:
    1.) USF
    2.) Tulane
    3.) Memphis
    Plus the two last schools of the PAC to complete the western wing of ACC as Donno mentioned.
    Three other schools that could be considered are 1) App State, 2) CCU, and 3) UTSA or Rice.
    The three service academies would be primarily for viewership ratings and attendance increases for road trips. But the service academies would have to morph into a more modern option or spread option offense but getting those type of recruits to commit for 6-8 years after graduation with bachelor degrees from the academies.

    USF has been 55-66 since 2014 in the AAC. The first year the conference was complete. Memphis is 89-41. The best team in the AAC with 10 straight bowl games. Only 8 other teams in the NCAA. Alabama, Ohio State, Clemson, Georgia, Oklahoma, Iowa, Wisconsin, OK State. Memphis is also going to have a new stadium (renovated Liberty Bowl).
    Don't get me started on Memphis vs USF in basketball. Don't get caught up in recency bias with USF and Tulane for that matter.

      MEMPHIS has 89 losses since 2009 , that's Arizona State territory , Northwestern territory, except those teams were playing much tougher teams on a weekly basis....66 Losses vs G5 since 2014 is terrible....here's some teams with 60-70 losses since 2009; FSU 60 losses, Washington 67 losses, USC 66 losses, Utah 65 losses, Iowa 66 losses, Stanford 67 losses, Tcu 63 losses...TEXAS 75 losses, Clemson 40 losses

      You also have to think of the Tampa market as being one of the biggest markets in the country. Thats what makes it attractive to P-Conferences. USF has also acquired AAU status and has added multiple different sports to its resume besides football and basketball.

      @@MichaelSmith-xb5cp I'm talking AAC...try to keep up. USF has done nothing. in BB, Memphis has averaged 21.3 wins a year and USF averages 12.7...lol Memphis actually plays the top tier teams in the country OOC. Ask SMU, Cincinnati, UCF, and Houston what they think Between the two schools.
      Memphis vs USF all time. Football: Mem 12, USF 8. BB: Memphis 31, USF 8

      @chitowntiger1 I know it's AAC, and you were talking FB records, not BB, correct? 66 losses in a decade is not good for USF, and neither is 89 in 15 years for Memphis. Memphis has a scheduled road rate (SRR) of zero, they haven't scheduled a single road game against one of the .700 programs in over 20 seasons. They played a depleted Boise State last season and won by 3 points in Memphis. USF (SRR) is 1.5, scheduling 3 road games against Bama and ND

      I would take USF for football and Memphis for basketball. In basketball , Memphis is almost blue blood. In football, USF is probably ACC top half and their bowl game showing against an injured Syracuse was strong (and with that large a win I don't think one could argue it was only bc Syracuse didn't have Shrader - SU still allowed 45 points). The market footprint in Florida is still important for ACC. Memphis would be nice for Louisville and SMU to have nearby games. Memphis overall has the stronger name recognition across all sports.

    So now the FSU argument is FSU is entitled to be payed for overages in revenue they allegedly produced for the ACC after repeatedly signing a document that says otherwise?
    In what other conferences does this even happen? None. Ohio State isn't suing purdue. Alabama isn't upset with Vanderbilt. Maybe that's because those teams have been relevant Flagships for their conferences for the last decade unlike some schools we know....

    For a change, Kenton is correct. FSU and the employed counsel have had access to the documents, which is why they traveled to Charlotte on several occasions. What we have to hope for is they provided the legal team fighting the GOR with accurate information. So basically there isn't a smoking gun to be found

    But if they settle and that amount gets out there. How can the ACC stop UNC, Miami, and probably UVA following then right out the door, then the ACC is in trouble. This has always been about UNC, FSU and Clemsons argument was the ACC was too NC basketball focused and the ACC knows they lost those schools…..how do they keep their prized UNC in place? That’s the question.

      Won't be enough to save the ACC at all in reality. Your two most viewed, most lucrative schools leave. It may not crumble but the conference certainly won't have a fraction of the status it currently has and it doesn't have that much clout as it is in football.

    FSU and Clemson will settle with the ACC for a 100M buyout and UConn and South Florida are the replacements. I know some might not want to hear this but I am told this by a very good source that this is true. The ACC will stay intact because 100M settlement will keep the rest in place for now.

    I mean I think I get why Florida State and Clemson want to go they want to make a lot more money so they can be competitive for a long period of time. That being said if I was the ACC I would say screw FSU and Clemson we are not renegotiating anything we're not settling anything you're going to stay the remainder of your contract or you're going to pay us a boatload of money. That's what you agreed to and then when the ACC gets that boatload of money from both those teams I did it up between all of the teams that stayed with the exception of the three new ones. And then I watch my NC State continue to Pittsburgh Clemson and Florida State off.

      That is so baffling to me. I guarantee you that if any team in the ACC wanted to leave, FSU would have no problem with it and would do nothing to stop them. Why on earth are you people so seething with rage about FSU leaving the ACC? Seriously! What difference does it make to you if one team in a conference of soon to be 17 teams wants to go to another conference? Georgia Tech left the SEC to go to the ACC, Boston College, Miami and Syracuse were in the Big East and left for the ACC. Maryland left the ACC for the B1G. South Carolina left the ACC for the SEC. Schools are always moving around. What makes this move any different?

    Big 12 fans seam to think the espn review coming up will release fs and clemson and destroy the ACC. Espn could also pay more money. May be a amount to attract 4 midwest teams is what im hoping. I can't see them letting the acc go, and letting that beautiful network, the accn go. Be sides they made lots of money and with the Texas and California markets even more money. My opinion is 55-60 pay out oer team would be nice.
