Any attorney is allowed to petition the Supreme Court if they lose in the Appeals Court. Doesn’t mean the Supreme Court has to take up his case.

There is more to Constitution than the 2nd amendment. The fourteenth amendment section 2 says " No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws." Equal protection under the Law. One persons rights don't cancels everyone else rights.
In addition, in my opinion,it's time to draft a new amendment to enshrine public safety in the Constitution. They say that gun safety is not explicitly stated in the Constitution, okay, let's put it in the Constitution. 38 states required for ratification, not easy but not impossible. 🗽
The framers intended the Constitution would grow with the nation. A new public safety amendment would protect against an overreaching SCOTUS trying to tumble over as much gun safety legislation as possible. Remember that Breun was an attempt to toss a law that had been in place in NYS for 100+ years. The bump stock mess attempts to damage the 100+ year prohibition on machine guns. Enough. 🗽

In some ways, the ERA is an unfinished story. The problem with the ERA is that they placed an expiration date on the ratification. Don't know if that's a typical move. Enough states did ratify, but not within the time frame. A legal challenge to the time frame could resolve the problem. Given the current challenge to safe reproductive healthcare, in addition to contraception, marriage equality, etc an equal rights amendment seems more necessary than ever. Challenging the time frame, or reintroducing a similar amendment draft with the additional information for contraception, IVF, reproductive healthcare, marriage equality could be an excellent way to enshrine all of the rights covered by the right to privacy. Ratification might be accomplished more quickly this time, especially if they/we do our homework on checking in with the states that already ratified the ERA.
The reality is that it has been too long since we last amended the Constitution. Perhaps we were lulled into a false sense of security by SCOTUS that were responsible and respected precedent. Now we seem to be in a brave new world.
A new amendment to enshrine public safety in the Constitution is overdue. Guns cannot have more rights than innocent people, school children, or abused women. Enough. Ratification is not impossible, just difficult. Given that ten states already ban AR 15, given that many states already have strong gun safety legislation, we might be closer to 38 than we think. We are the USA. We do difficult things all the time. We are afraid of ratification? Really? Constant gun carnage is the problem. Time to solve it.

Nearly all those guns were bought and registered legally. One in eight people who try to legally purchase and register a firearm are turned down due to record of domestic violence. 1 in 8. Due to loopholes you can drive a truck through, the numbers may be much higher. And here is another fun data point people don't think.of...if a gun has been used to threaten a victim, those victims if not shot, incur more severe injuries from beatings .

I seriously do not believe that MAGA or the NRA or any of the right wing blowhards would want the Constitution taught in schools. Most of them have not read and understood the entire thing. And for those idiots that can't figure it out, gender studies curriculums which are university level courses- generally require some level of coursework regarding Constitutional studies
