    Thank you Rabbi. The terrace is the boundary wall defining the extents the upper and lower gardens. The upper and lower gardens' ownership are on either side of the terrace. The fruit and vegetables growing on the lower garden's side of the boundary belongs to the lower garden. The soil retained by the terrace is owned by the upper garden. For the upper garden owner to reach over and pluck the produce on the lower garden's side of the terrace wall, is theft, as their arm is entering over the boundary wall/terrace into the lower garden's property. The vine is nourished from the lower garden's soil so this too favours the ownership of the lower owner. But, if the vine grows over the terrace wall, into the space of the upper garden, the upper owner has rights to pick the fruits and trim the vine, as the lower owner does not have permission to enter the upper garden. Is this not more correct? This is accepted property boundary law.
