What if a police officer is threatening a person in a simple traffic stop for a traffic infraction (tail light lens broken)? Example, "Get out of the vehicle OR you WILL be arrested!" When we asked them what their RAS or probable cause was, they said, "I'm not going to argue on the side of the road and it's because I said so. I gave you a lawful order that you MUST follow. Get out now OR I will forcibly remove you from the vehicle." This was said to my disabled husband who gave his license willfully to the cop when asked for it. I, as a passenger, was threatened by forcibly being removed and arrested, to give my identity.

I was just shunted by a large rental agency who mailed me their lease and bank details at the 11th hour... The following 96hrs became my living nightmare. I was trying to find out if I could VOID the lease citing Duress - seasoned with bad faith & predujice. The whole slow-motion train wreck truly had me questioning reality - I still am I guess, its still so fresh. It has me up @ 2am typing comments trying to figure out why this 'pro' would act with such demonstirable malice ... So a situation where a shop owner catches a person on camera stealing $100 worth of merchandise. The shop owner contacts the kid and says "Pay me $150 for the merchandise plus my time, or I'll send this to the police." That sounds like it would be extortion and any agreement to pay could be seen as duress, right? Is there a way where the matter could be settled civilly without breaking the law? For example, the shop owner sees the thief is a kid who made a stupid mistake, and so long as he is made whole, doesn't want to burden the kid with a criminal record?
I would say reduce it down to the 100 in order to cover the actual cost of merchandise. The fact of matter is that if you reduce it below that, he can use that with others and there is no detterant. Or better yet return the merchanise.
Why would the shop owner expect the thief to keep his agreement and the thief should jump on that agreement and get a signature releasing him immediately as he may have hit the jackpot !
The best way to make sure a prenup is enforceable is to 1) Make sure it is signed months before the wedding so no party can argue duress; and 2) Make sure both parties are represented by attorneys when they sign, and lawyers on both sides have reviewed the contract.
What if your own lawyer advises you to sign stipulated parenting agreement stating “if you don’t agree the judge will make it way worse for you”? What are the options?
