Regulations are laws and all laws must be passed by Congress. Unelected bureaucrats should not be able to make laws. There are three branches of government in our system not four.

Congress can and does have absolute power to delegate it’s authority to civil servants in the executive. Civil servants can use their statutory authority to make regulations reasonably related to the law. Bureaucracies are not a fourth branch, they are part of the Article II branch and they enforce Article 1 authority.

There is a difference between interpretation of law and interpretation of policy, so long as policy conforms to the law then there is no problem, if the policy does not explain it's content or requirements then it needs to ruled on by what the laws are, that's the job of a judge.
If a statue or law isn’t clear the court should send it back to congress. The executive power is to enforce laws that are clear and concise passed by Congress.
