- The ATF's Final Rule on "engaged in the business of" was just struck down by a Federal Judge in the Northern District of Texas. The court found that the rule violates the APA and the Constitution and said the plaintiffs have a likelihood of success on the merits and enjoined enforcement on plaintiffs.

Given the way we’re getting worked in California. It’s encouraging to see something being done against the ATF at the federal level.
The good news is California has such a horrible budget deficit, they're going to go even more in debt paying out all the lawyer fees for their unconstitutional gun laws. California owes around $50 million because they improperly billed Medicare for 'Migrants.'

at the bottom of the file , it says district judge , so this will stick just long enough for a different judge to come forward and change it back.
i had joined the GOA... you will notice the NRA did not participate in the lawsuits against the atf.
NRA still isn't helping much even after changing their President.
Ever heard of CRPA, NYSRPA, etc. all these rifle and pistol association in each state of the country are NRA state chapters. They have been very active and NYRPA is why we have Bruen in the first place. They deserve some criticism yes, but lets not throw around false info that they are doing nothing.

I was thinking about this last night what happens if they get this rule passed and start charging and annual fee for every weapon you own. I would have to liquidate a majority of my guns! then do I get arrested for selling more than one gun in a specific period as a Retailer with no FFL?

Does it really matter? We've seen what the status quo is in cases like this, with ATF running to SCOTUS for an emergency appeal, and SCOTUS staying the injunction so the rule can go into effect while the case is heard out in courts for years to come.

An injunction is a "time out", not a "win". That won't happen until the scotus gets around to it. "Rights" for a few and not the whole are privileges.
We the people have rights.

So tell the BSCA terminology to the attorneys for the family of Brian Malinowski, and have them get the ATF and Little Rock P.D. to disclose the names of every single agent and police officer who either engaged in the raid itself, or the planning and execution thereof, so that even though some of them may have limited immunity they can be sued civilly, and charged criminally for their specific actions in the situation.

Good for the named plaintiffs, but you think this will happen nationwide? ...just wait until the 9th Circuit hears arguments for a similar case, and applies their tactics of delay, appeals, send it a 3 judge panel, then to the en banc, back down & around, and then, even more delays.
We are gaining ground. Just need to get it covered for the rest of the country.

Why is it that District Court judges can all get Bruen and the law correct, even in California, BUT all of the Federal Circuit Courts that are fillled with far left Democrat appointees CANNOT rule according to the law and Bruen on ANY case? Why is that? DEMOCRAT.

I'm a member of GOA and 4 more 2nd Amendment Associations. Every gun owner should be a member in at least 1. They need the $25 membership fee to fight for 2nd Amendments.
Those organizations have no reason to "win" anything. No fight means no donations.

Even if you are a Fed you are welcome. You are entitled to disagree, but here you will find the truth, the whole truth and nothing but the truth instead of (as bumblingjoe says) the thing.
On another note, every gun law imposed on Americans after the ratification of the Second Amendment to the Constitution is therefore unconstitutional and should be overturned. "Shall not be infringed" is very specific.

Only good in the 5th. District, Texas, Mississippi and Louisiana and for members of the Plaintiffs that sued. Not a real win. The ATF can still break down my door in South Carolina.

This is all good and well for the plaintiffs, but for the love of God could you put in the title something like oh I don't know "for the parties suing or for the state of Texas?" Far too many channels running with blanket titles for states that have nothing to do with this. I live in Michigan. Would like to see all the regulations thrown out as well. But when coming across titles like this I get my hopes up only to watch the video being Texas. Again glad to see it start somewhere be alittle bit more descriptive with title.
