Imagine being jealous someone else can speak Spanish especially. It's probably the most common second language in the US. I can get feeling a superiority complex that no one else you meet in person is fluent in Summerian like you are, but Spanish?
Out of The Hat as English being my second language I didn’t have to learn Spanish. However I regret that choice because so many of my coworkers speak Spanish. They mean absolutely no harm but they love to tease me in Spanish. But they are also teaching me a little every day and I love it

But it's the slang and pronunciation drift that can cause difficulty in understanding. If you want to have some fun, speak Castilian Spanish here in the USA. You will get some looks.

Steve didn't only steal product, he was stealing tips and changing hours on the time clock giving himself more hours than he worked. So yea, 6 years sounds about right.

I had a shockingly similar situation with a store manager when I worked at a pet shop. One day, my manager went on INCREDIBLY similar rant about how he had worked at the chain for 11 years, and how he was so essential to the company.
My shift lead, whom I loved dearly, decided he had enough of it. While leaning back in his chair, and in the most deadpan, monotone way spits back with words dripping with venom, "Congratulations boss, you've wasted 11 years of your life learning about dog food and all you have to show for it is a 2 bedroom apartment that you share with your mother."
My jaw hit the fucking floor and me and my other sales associate started laughing so hard we were crying. Our boss tried to write him up for it, and he just said "What if I just don't sign it? You really want to fire the only guy who does trash?" And got off with no consequences.
I miss that shift lead. Best kind of no bullshit.

Exactly. The theft might have gotten him a year, but the full-on wage embezzlement charge is like 5-10.

You forgot to add fraud to Steve’s charges, tampering with company property, six years is a lite sentence.
He did a plea deal I'm sure. As soon as his wife was facing charges and his kids would end up possibly in foster care, the guy probably confessed to everything as part of the deal. The other things he was doing such as stealing tips, would have only been brought to light if he admitted to it.

Yes, he definitely took a plea to save his wife from jail time. They were probably charged with fraud, embezzlement, theft, and other charges for operating an organized theft ring since it was them working together to steal company assets. So, 6 years is a light sentence considering they could have gone to prison long enough until they were grandparents.

Not to mention he was probably doing this for most of the 25 years he was there. At a certain point I'm sure it hits grand larceny.

what he did was a white collar crime , to be frank he got a easy sentencing because you can go to jail up to 30 years depending oh how much money you took and what not, and you would never be able get a good job because its a felony

It wasn't just theft, there was fraud and embezzlement on top of that, which are much harsher sentences

Fluff, if I had to guess the length of the prison sentence, has more to do with amount stolen(in value & volume) and how long he had been doing it.
Don't forget that his wife was also an accomplice. she might have, in exchange for a suspended sentence, testified as to how long they were stealing from the store.
Exactly. The Embezzling charge is a higher crime than small larceny. However, in this case the larceny probably wasn't all that small. They would have gone back and analyzed the stores numbers as far back as they could and prove a pattern. Once that pattern was established they can then estimate a range of stolen property. I'm guessing that wasn't a small amount if they could show he'd been doing this for a long time.
With both such charges 6 years is awfully lenient. But that's Seattle. We're that to happen in Texas Steve would be missing a lot more birthdays!
Didn't you say he was embezzling tips and stuff as well and stealing time from the employee's? That could count towards the sentence. Plus who knows how long the theft was going on for, the sentence probably depends on the total cost on how much was stolen.
Can you imagine the exposure to lawsuits from employees (from since he started working there) for lost/stolen wages? The company got off cheap with her "bonus" for finding the theft. They should have given her cash and not store credit.
Yes. Tampering with the time clocks like he did is technically fraud committed on his co-workers. That alone could have gotten him 10+ years.

Steve also was stealing from employees and the store by padding his hours and shorting theirs. He also stole tips. But yes, once he defrauded the company that way it went above and beyond and got him the longer sentence.

When I heard that Eliza wasn't at the store I thought the worst. I'm so glad she got the promotion, and hopefully this was a lesson for her to take into her new role at the company.
When a person has a lifestyle of mistreating others, the person probably respects the law as much as they respect basic ethics. A person who routinely mistreats multiple people is very likely to be committing crimes, and not trying very hard to hide that fact. They feel entitled and invulnerable, and may be easy to catch. So when a co-worker or supervisor is being an Adam-Henry to everyone, first look for what crimes they are committing.

He probably should have gotten MORE time. If he was stealing tips, changing other people's hours, and adding hours to his own check, that is theft of time and money, otherwise known as embezzlement!

The video exposes something that is rarely acknowledged: supervisors who do a poor job of supervising. I'll lay that fault on upper management. I've been involved in businesses from around 1960 to about 2001, as employee, assistant mgr., department manager, and business owner. I was a good employee and assistant but there was no real training or supervision of me after I was promoted to manager. I, and most of the managers I knew, didn't receive good training and supervision to be good at our jobs.
Companies tend to train the lowest level workers but most (in my experience) don't do a good job training and supervising their lower level managers. The best companies do a good job; it's how they become the best companies.
OP was brilliant, thinking of all eventualities and masterfully dodged every bullet. Can't feel bad for the rude and arrogant shift supervisor who was stealing and blaming the loss on the employees - real piece of work. I do feel bad for the baristas who were being cheated on their tips and pressured into sexual favors with their supervisor. Some people are just nasty. 5 stars for OP.
He was also stealing tips. If I remember correctly that is one count of theft from EVERY employee. That sort of thing adds up, even if there isn’t a mandatory sentence. If there is, wow. 6 years was probably a plea deal.
Personally, I'd keep him on while keeping a constant eye on him and garnishing his wages by 20-30% to pay for the stolen product. Make him do while literally every shit task I could.
I'm not a lawyer but my guess with the last story about the coffee theft is that it was two thing. A: The amount of the item taken probably totalled the amount that put it in grand larceny territory and B: Seeing that his wife had taken the stolen goods and resold them as "their own" bought/made items for profit. I can totally understand the six year sentence and what the wife got.
If the story is true, it wouldn't be surprising if corporate went back through any records they could find and charged him with more than just the three counts of theft. Obviously they did some sort of deeper investigation as they found he was stealing tips and time from other workers.

Embezzlement and messing with the time clocks were probably what got him in serious trouble. Imagine an employee having a legitimate work accident, but everything is all messed up because that guy made it look like that employee wasn't there on the clock. I also wouldn't be surprised if there was a long history of minor charges and probation prior to this case.
That last story yes he is actually lucky he didn't get longer. Embezzlement is no joke.
Incase you're interested: YES, you can go to jail for that long depending on the company. take a look at Wally mart you get caught stealing a $0.02 whatzit, it could cost you 6 months in jail and a $250k fine plus a lifetime ban
It doesn’t just matter what was stolen. The value of what was stolen also matters. Also, if the assistant to the manager was a repeat offender. Usually, a first time felony theft will land you 2-3 years, so it seems likely that he either stole a LOT (he had worked there 20 years), he was a repeat offender, or there were multiple charges.
Depends on the monetary value of the stolen goods. Under a certain amount its a misdameaner over said amount its a felony so six years seams reasonable if it was charged as a felony.
When it comes to sentencing (and I'm no judge, cop, lawyer, etc), you can get multiple charges for various aspects of the crime and sentences for each of those add up. Things like theft, attempted theft, conspiracy to (whatever), embezzlement, and so on.
I think that's a comparatively light sentence, since Steve was also taking other employees' tips and shorting their hours to give himself more on top of stealing supplies meant for the store.

He had been stealing from the company for a long time, so I think that's part of what added so many years. Plus, there's the embezzlement on top of stealing, and I think we can safely assume he's been doing that for a really long time as well. Especially if he's been at that place over 20 years.

1) how long was he doing this? If you total the number of crates for for even just the past few years it’s no longer petty theft.
2) I’m not sure if it’s Federal or not but not paying employees is up there in the illegal department , and again who knows how long he was doing it.

To answer your question about Steve: adding to the stealing are the charges of employee fraud. I managed 2 bookstores. Both state and feds have very serious laws concerning tampering with employee checks, time cards etc. This is actually thanks to the unions in the 20's and 30's. The history is pretty interesting.

Depending on HOW MUCH he embezzled along with the stealing of food, tampering with the time clock and getting more hours for himself....... he could have gotten a lot longer.
It is possible that there was evidence of tax evasion if they could prove how long they had the side business. The prosecutor would have probably looked into this to tack on related charges.

Steve could definitely go to jail for that long (6 yrs). Upon investigation, he probably admitted to what wasn't caught on video and totaled tens of thousands of dollars. Six years was probably a reduced sentence. Surely his crime was a felony.
Laws are somewhat draconian in the US. Six years for embezzlement, wage theft, and felony theft isn't unreasonable. In fact, it sounds like he took a plea. When he got out, I get he had a devil of a time getting a job.
it wasnt the stealing the coffee and the muffins that got Steve 6 years it was embezzling which can get you put away for even longer dependent on how much you steal.
Don't forget that "embezzlement" is a crime in itself so Steve is lucky that he didn't get more time than the six years.

They didn't just steal food items, they stole hours and tips from the employees. You NEVER EVER screw with someone's money.

Theft of product over $300 in value is a felony, embezzling is a felony, and altering the timecards is a felony. They probably had dozens, maybe hundreds of counts on Steve - which is why he'd be sent away for six years.
6 years is small for grand theft, if they can prove the property stolen was over about $400. in value.
So, I could understand the thought of "six years is a bit much", but, theft is theft whichever way you look at it, and this guy has obviously been doin it for years before he got caught.
Second, I'm not sure about Seattle's laws towards it, but it's definitely a way bigger deal than shoplifting where I'm from especially if you're takin away at least over $100 every day

OP’s a Genius! And Steve’s theft of store products seems minor compared to his embezzlement which holds the penalty of up to 10 years in prison and $15,000 minimum in fines for Embezzling $50,000 or less. Can’t believe his wife served no prison time for her part in store theft.
With the amount of product he stole, plus embezzling money and theft from fellow employees, he had to be looking at fraud and grand theft. You can get a LOT of prison time with that kind of thing.

Stealing something (or over time) worth over $1,000 is a class-D felony. So six years for all that product he stole and the stealing company time, etc. sounds perfectly normal.
Where I live you can get up to 20 years for embezzlement, depending on how much you actually stole and the circumstances behind it. Not only was he stealing product, but he was reselling it to make a personal profit. His company could've been sued for this because the product was being sold in a manner outside of their contact with the supplier. He got off pretty easy, probably because he didn't have a criminal history.
But he DIDN'T just steal the stock, he ALSO embezzled money from the stood and stole time and tips from the other employees, and had probably been doing so for YEARS. In fact his sentence was probably a lesser plea bargain from what he actually COULD have gotten.

I looked it up quickly and if the company figured that he had stolen $5000 or more from them, he could have gotten up to 10 years in jail. And that's JUST for the product. If anything, Steve got off lightly.

Remember Steve had been stealing for quite a while. The loss was a huge monetary one. Probably thousands.
I'm guessing what got him the extended jail time was not so much the theft of product, or tips, but the fraudulent reduction of hours worked by others and embezzlement. I am pretty sure that violates federal labor laws.
It wasn’t just granola bars, coffee and desserts. It said he was embezzling money from the company stealing tips and committing fraud by changing people hours to less to give himself more. He worked there for 20 years so the amount of money he stole from not only the company but from fellow coworkers was probably in the hundred thousand ball park.
It's not excessive because the stuff coffee shops pays for adds up. And he has been there so long- it probably amounted to a LOT of money. When I worked at Panera we had chocolate chip marshmallows that were like 1-2$ a marshmallow!
I can imagine the reason the prison sentence was so long was that they totaled up how much product went missing over the years when Steve was on duty & assumed it was stolen thus prosecuted him for that amount. If we assume every week he stole a $50.00 case of product that's $2600.00 a year, that's as much as a used car. It's not hard to pin the majority of missing product on him after being caught over the years he worked & then charge him with that.

I think that jail sentence is accurate, because it's multiple cases of fraud, and could be over the $5000 threshold that changes it from simple theft to "You're done for."
About the jail sentence on the last story, it was probably charged as Commercial Burglary, which carries a felony charge and a 6-10 year sentence, depending on the state.

He also stole time and money from employees. He committed Conspiracy and believed Fraud. The company would be obligated to reimburse ALL employees for the time they were not paid and possibly thier tips.

He got six years for stealing a combined hundred thousand or more dollars when you factor embezzling and hours and product, that's a generous sentence.
The 6 years for Steve wasn’t about stealing the food. It was for embezzling tips and tampering with time. Crimes directly related to money come with very stiff penalties.
Steve was lucky he only got 6 years. On top of all the theft, his biggest offence? Altering the time clock of himself and others, that's a MAJOR no-no.
