    *I find it very hard to believe the "entire downtown" is private property when there are publicly installed and run traffic signals and other PUBLIC traffic control devices. The ARCGIS map for Pleasant Hill shows Crescent Drive and Crescent Plaza streets as public right-of-way and not private. The ROW is approximately 70 feet in width, asymmetrically centered on Crescent Dr. The theaters property begins approximately 14 feet from the face of the curb. The police did not have authority to trespass HWP from the ROW. Part of Trelany Road is private.

      @manwithumbrella 2 місяці тому +2

      LOL ... a limited public forum is just that, people who wield authority over it CAN makes rules, including those that prohibit "filming". But this is irrelevant to this situation because the sidewalk here is NOT a limited public forum, but though privately owned, is considered a TRADITIONAL public forum, as if it were a public sidewalk. This idea is laid out below from the federal district court case "Venetian Casino Resort, L.L.C. v. Local Joint Executive Board of Las Vegas".
      "The court found that the sidewalk located on private property
      is a public forum, thereby opening its use to individuals seeking to express their
      First Amendment rights of free speech.14 The reasoning employed by the court
      was sound in light of the various factors in this case, including the history of
      the sidewalk in question, the current public use of it, and the activities that the
      court was asked to enjoin. The Venetian Casino agreed to build the sidewalk,
      the only thoroughfare for pedestrians, and to allow access to all individuals." 5
      The holding of the court that the Venetian sidewalk is a public forum is clearly
      supported by ample Supreme Court decisions on First Amendment rights on
      property."

    For all the negative comments... the first 20 sec. Of the video explains that all of this is a private property. It's an outdoor shopping center. Just like a mall. It is open to the public but They can trespass for any reason. The whole shopping area if privately owned. Had he taken the trespass they would have cheered for their accomplishment. And he couldn't come back. Now he can come back latter, not get arrested for trespass, piss them off again. I think he did the right think! Again. Read the notice at the first of the video!

    Silent audits are great, but I would ask how do you know I’m not the owner of this property and then when they ask, are you the owner you say I don’t answer questions but they don’t have any evidence that you cannot be there or you aren’t the owner and the owner has to trespass you so some random jerk has authority over the whole property. I don’t think so and I think the owner of the property would be highly concerned that police and a security guard are conspiring to throw people off his property. They don’t know that you’re not shopping there or anything.

    I’ve enjoyed many of your videos and understand the silent approach. However, you’re not always consistent with it, and now it seems like you're scared of even keeping silent and will run away on the slightest whim of an officer. Decide what the focus of your channel is, as it’s becoming confusing for those of us who have stuck with you.
