I covered California’s “protect freelancer” law four years ago.
California politicians and the media claimed freelancers were being abused.
Their solution: a new law, AB5, that reclassified millions of them as staff employees-whether they liked it or not.
Politicians claimed businesses would now be forced to pay them, “wages and benefits that they deserve.”
“In reality, what's actually happening is they’re just letting them all go,” said freelance musician Ari Herstand.

So many careers were ruined that California exempted more than a hundred industries, but freelancers STILL lost their jobs.
Yet now the Labor Department is forcing the rest of the country to be more like California?

As an ex owner operator truck driver, i was forced to sell my business because of the new rules and regulations California came up with. These things are never intended to help the little guy, is completely opposite of that, actually.
This bill helped the lease operators that were getting scammed by companies though.

@@ALeAnn365 I am from WA-E. The problems WA and OR have, as such, come out of Seattle and Portland, which is part of "The Left Coast". You could say Interstate 5 forms its backbone. You may have heard of the state of Jackson, or the Greater Idaho proposal, or even the idea to divide California into smaller states, but unless there's a counter move of migration of culture from Texas, I doubt Califorication will be checked. They've already got Austin, after all.
I hired contractors because of the type of work required. Once I had to W2 them, I had to cut their hourly pay in half to pay the state and feds. They hated it. I finally closed up, left California, and did better in a free state.
As a one-time free-lancer, let me say I had the choice get hired to work W-2 jobs or my contracting 1099 gigs. I preferred the independence. I was an employee of my own business, not of the companies that contracted me.

When the government gets involved in people's lives like this, 2 things are always true:
1. There WILL be unintended consequences.
2. There is a special interest group behind it that stands to gain (in this case, unions).

If people lose their jobs they become dependent on the Government and thus Democrats beleive they get more voters, Unions want it because they beleive more people will unionize and thus the big bosses get more money in their pockets.

I am not sure they actually want to sort out the $600 of everyone each year. I think they want the $600+ transactions tracked and available so if they ever need "dirt" on a particular person, the info will be ready. Then if you can't prove the source of the money, they will claim it was taxable and prosecute/fine you for tax evasion.
Old saying, "California is the land of fruits and nuts. Everything leftover is flakes." Still true. Seeing as how that state is grossly mismanaged. The rest of the country doesn't need that lunacy.

The Party does not care how they actually affect people. The Party cares only about control, and freelancers aren’t as controlled as employees.
I agree with you on that one. Freelance and contract individuals can engage with companies without the same type of oversight and requirements that the government asks.. or may ask in the future. Just look at how absurd it got with the Covid vaccines. People lost their jobs over it, because the government empowered companies to do so.

Was a union steamfitter for 13 years up until 2011. The worst 13 years of my adult, working life. Started my own business in 2011 after getting screwed the umpteenth time by that union. Now, I'm close to retirement and a hell of a lot happier.

I never understood the appeal of freelancing until I started working for myself freelancing three years back and despite having 3 or 4 different gigs I balance, its the most freedom and financial independence I've had in my entire 15 year working career.
Choose clients that you like, pick your own hours, get paid in cash, all while doing something you don't hate because you aren't forced to do it day in and day out for some idiot in middle management who doesn't even appreciate your efforts. Now the government is trying, successfully I might add, to be those middle management idiots.
It always had an unofficial aspect. Now, if this succeeds it will likely be greater as well as reducing work for some. But I am sure that many savi freelancers will continue at low risk, but with fewer taxes and somewhat less legal paperwork and some added legal risk. But yeah, less or no work for some who now depend on it...

it makes sense because "we want you working 1 job, not 4" and now because it costs companies more they will hire that person for what used to be gig work but as an employee who only gets 10 hours and who works for less ultimately

The problem is that if a majority want something that the minority doesn’t, it is seen as bad. With that said, politicians , both dems and republicans, also don’t talk to people on both sides often enough to see where they should make adjustments to accommodate both sides. The law that California made should have had some experts weighing in on what jobs should have been included and excluded from it. Ride shares do screw over employees more than any other gig jobs. They went to broadly with it, that’s what the issue really is.
I became a freelancer, because actually GETTING a regular job is next to impossible! I am honestly doing very well as a freelancer while being a single mother, and am able to fully support my young daughter on my own. Freelance has given me so much freedom. I am absolutely TERRIFIED of this law! This law has the potential to make it next to impossible for many Americans to even have a job! We, the People, should have the right to CHOOSE! No one is twisting our arms and forcing us to do freelance work! Many of us actively CHOOSE this line of work, because it offers FREEDOM! What is wrong with these stupid politicians? 😑

Reminds of how healthcare reform was really about preserving heath insurance companies' market power.
This law screwed hair stylists in CA. Now salons pay hourly instead of commission and stylists make way less and rarely make commissions…actually benefits owners and no…they don’t get benefits cuz they don’t get scheduled 30+ hours. It’s a terrible law.

They typically only listen to a large group and ignore the minority group. It lacked common sense. Anyone that has done piece work knows you can make more then you would hourly. Like laying tile floors, you make more money charging per sq foot than you would by the hours it takes to do it. Same with hair styling, truck driving, and commercial fishing. But the “experts” were focused on ride share and shopping services, and figured they should apply the law to other things that aren’t equal in how they work.

My husband is in the machinist union. They sent out a memo recently that was endorsing , first time in decades they've endorsed a Republican.

They did this in UK already. It's called IR35 and gave tax responsibility to the hirer. They didn't want that responsibilty and thus killed freelance industry. I am now paid less and pay less tax - huge fail.

small business? bro... Lyft, Uber combined has about 50,000 employees this isn't counting the contractors they have. Probably with that, the number is probably around the 200,000 mark. I barely consider that "small"

I live in CA, I lost all the tax breaks I once could take on the thousands of dollars in software I still have to pay for in doing remote work.
This is going to be a killing blow for the middle class and anyone who had designs on getting there. Why do you think people are leaving CA in droves? They can't afford to live here anymore and it's a 3rd world s-hole on the streets.

I’m so I got out of Califfornia right before it become one of the worst states to live in! I escaped far away from the lower 48 by moving to beautiful Alaska! Women, God and man!
I worked as a contractor for 7.5 years for a large delivery company. I didn't have benefits, but I had flexibility. And I made good money because I was being paid what they would've had to pay for the benefits. That ended on December 31 when they dumped all their contractors. Fortunately I'm retired, but many of my colleagues are still looking for jobs. There's nothing worse than a politician who helps you to death...while they make their money from the state and lobbyists. No wonder they won't talk to you; you might actually ask them a question.

I left California for Washington state 20 years ago and the political climate here is just as bad and getting worse. I lived in California for 48 years I miss my family but not the politics. I love that we have 50 UNIQUE STATES that can all try different things SO WE CAN SEE WHAT WORKS AND WHAT DOESN'T! We need a new law system where laws cannot be passed unless they can PROVE they will fix some problem. AND EVERY YEAR they must prove those laws are still working or they're REMOVED! GOVERNMENT NEEDS ACCOUNTABILITY!

It's about the government having the paperwork for the tax money coming in instead of trusting the contractor to pay their own taxes. I don't care what they tell you, The issue is that they aren't getting their tax money on contractor income.

I’ve been a remodeling contractor for years, hiring day labor for the grunt work and sub-contractors. None of them want to be company employees, if they are they have to do things as I want them to be done, be on the job at the time I want them to be and so forth. They are independent yet we work together to provide what the customer wants. A 1099 works for them.
And let's be realistic. A lot of those guys just want cash with no trace. They don't want to fill out any paperwork.
@@mediocreman2I'm a contractor as well, and if I can pay a laborer for the two weeks of work I need them for, and not 8 weeks for the duration of the project where they'd be standing around doing nothing, it keeps the customers cost reasonable. This skyrockets the cost for the customer with no benefit. Thats why you see 6 people standing around watching 1 person work. Those are union workers.
I have 5 gig jobs in NC & would be highly upset if this were to happen. I ran 4 hours every day this weekend, but I'm choosing not to work this week. I like not having a boss or a business to run.
Politicians don't give a 💩 about the little guy. They care about lining their pockets, and that's it. I'm sick of them controlling literally everything we do, or trying to.

I was a music education independent contractor for public elementary schools for eight years in CA. The law changed, and my degree no longer qualified to work in the classrooms that I had cultivated for almost a decade. I had to spend 10k to open up my own music teaching studio, which at least was less than going back to get the education I would’ve needed to continue the work that I had already been doing.
When I left the system, so many teachers and families were upset, and even blamed me! It was really heartbreaking. Those laws were completely uncalled for, and I don’t even know how they got passed in the first place.
Because our government wasn't really elected. That's the only answer which makes sense.

It gets worse. This is also about taxes. When you are a W2 employee you get almost no tax deductions. As a contractor you are self employed and can write off business expenses such as depreciation, mileage or auto expenses, business meals, bank charges, etc. enough to potentially generate a book loss…. And they get no payroll or income tax out of you.
Yep. You'll still have those expenses, but now you can't deduct them. What's more, if you want to be a business of one, you still have to do all the tons of paperwork as a business of 100 employees and spend extra money on the accountants who can manage all of it.

I lived in California and did freelance work (I'm a musician, but I'm also a writer and transcriptionist) and I lost actual jobs because of this law. It was the last straw that finally motivated me to move out of the state.
I don't live in California but there does need to be something done with doordash and Uber ripping off the drivers

They don't want people to be able to deduct expenses that's what it boils down to. As an independent contractor if you gross $1,000 and you spend $900 to gross that 1k and you only have $100 in taxable wages that's what the government is trying to stop my friends plain and simple
True. I knew an independent trucker who grossed around $125,000 a year but could write off $100,000 for business expenses since he was always on the road. That was a while ago so the amounts have gone up.

If they can get $5000 in deductions disqualified on 50 million of those type of people's returns, they net a heck of a lot more money than if they go after 100,000 people who make 10Million in income a year and get 50k each. The very wealthy use smart accounting firms and can spend money contesting an audit. Someone who makes 125k will just pay up
