EXCELLENT information. We already have the Letters of Admin., and we have them now. So we wait the four months and will follow this guideline. Thank you so very much. This is a simple estate, so it should not be difficult. The first part was a bit challenging. But we did it. However, it took far longer because we didn't really know what we were doing and we had to go to court FOUR times to get the administrator approved. We did it tho!! If I had found this video 8 months ago, I don't think I would have understood any of it. But now I surely do.

I do have a troubling question that I am currently facing and would love to hear your answer based on the following facts: Decedent passed away intestate. He left a young wife and one young child (three other adult children were left from a previous marriage). He married his most recent wife in Mexico to avoid having to pay an attorney for a prenuptial agreement. Apparently, in Mexico, on the date of marriage you can request that the marriage certificate contain a clause that states all marriage assets shall be deemed separate property as opposed to community property. After the marriage to his new Mexican wife, Decedent purchased a home in California as an "unmarried man". He lied when he purchased home because he purchased it as an unmarried man when he was already married. He apparently did so in an attempt to keep his home as his separate property. My question now is whether the home purchased in California by the decent during his marriage with his Mexican wife is deemed or will be deemed his "separate property" or is it or will it be deemed the marriage's "community property"? In short, does the Mexican Marriage Certificate control and determine the nature of the property even though Decedent purchased property as an unmarried man when he was actually married? I am assuming that if the property is deemed surviving spouse's "community property", she should receive 50% of property's appraisal plus 20% share from decedent spouse's separate property. If the property is deemed decedent's separate property based on Mexican Marriage Certificate, only one-third will go to surviving spouse with the remaining two-thirds to be divided amongst four surviving children. My gramma died & im paying mortgage taken out by my uncle. $2500/mo +utilities (lived here alone 3 yrs.) Paid almost $100,000 so far & They won’t give me any info on the debt. All I know, is that more than half my pension goes to this house. I’m an Army combat-vet/100% disabled. My sister thinks they’re taking advantage of me. I can’t leave or I’ll lose my investment. Im a bit confused on the title while the house is in probate and before an administrator or executor is named.......who actually holds title to a house after the owner dies and it goes into probate. Is it considered abandoned property? Since homeowners insurance wont cover a property without an owner/title holder, he how is the property safe from vandals and squatters....who is liable for damages if they happen.

We never got any letter from the Trustee after my dad's passing. What he did tell my family in person after the funeral was, " Dad made me Trustee and Beneficiary of his entire estate and I dont have to notify anybody about anything and I don't have to answer any questions." And then he walked away. The estate was over a million dollars plus 4 or 5 houses dad owned, plus a safe depost box and several annuities. My dad had a last will and testament for decades. It was after my brother obtained power of attorney that quickly put everything in a trust, made himself sole heir and Trustee. My dad was scared to death of my brother.
great video. if the probate only include a real estate property with value around $260k,as is, reverse mgt $218k going up $1700 evrey month. if a probate is se the beneficiary will net after all cost maybe $5k probate fee + reverse mgt add up, closing cost and real estate commission.. There is a house involved that the mother (deceased) and the adult son resided for 20+ yrs. also a vehicle. If the will states these assets are to go to the adult son who is named the beneficiary, without probate....I am trying to help him. No. In that case the house can be directly transferred to the beneficiaries under the will or intestate heirs through a court procedure which is much simpler than probate. Once they own the property, they can sell it. Call me
